Abortion Laws in Belgium: 12-Week Limit, Waiting Period, and Costs

Abortion laws in Belgium allow the procedure on request up to 12 weeks after conception, which is roughly 14 weeks counted from the last menstrual period.1Universiteit Antwerpen Repository. Abortion Law Reform in Europe – The 2018 Belgian and Irish Acts on Termination of Pregnancy2ScienceDirect. Characteristics of Patients Requesting an Abortion Beyond 14 Weeks of Gestation: Retrospective Study in Brussels A six-day waiting period runs between your first consultation and the procedure itself, and after the 12-week limit access is restricted to specific medical grounds. Since 2018, abortion has been governed by public health law rather than the criminal code.

The 12-Week Limit

Within the first 12 weeks after conception, you can request an abortion without giving a reason.1Universiteit Antwerpen Repository. Abortion Law Reform in Europe – The 2018 Belgian and Irish Acts on Termination of Pregnancy Clinicians usually date pregnancy from the first day of your last menstrual period, so the legal cut-off lines up with about 14 weeks on that scale.2ScienceDirect. Characteristics of Patients Requesting an Abortion Beyond 14 Weeks of Gestation: Retrospective Study in Brussels The older requirement to demonstrate a “state of distress” was removed by the 2018 reform.

The available procedures are typically vacuum aspiration or medication-based abortion, chosen according to gestational age and your medical situation. Follow-up care is provided afterward.

The Six-Day Waiting Period and Initial Consultation

Everything starts with a first consultation at an approved abortion center or hospital. It has three parts: an administrative intake that opens your file, a psychosocial conversation where you can talk through your situation and hear about your options, and a medical assessment to confirm how far along the pregnancy is and check your health. You do not have to justify your decision.

Six calendar days must then pass before the procedure can go ahead. That waiting period can only be shortened or waived if there is a medical urgency. When you return after the six days, you sign written confirmation of your decision, and the procedure takes place. For the subsidized cost to apply, the procedure has to happen at the same center that handled your first consultation.

After 12 Weeks

Past 12 weeks, an abortion is only permitted in two circumstances: continuing the pregnancy would seriously endanger your health, or it is certain that the child will be affected by a particularly severe and incurable disease at the time of diagnosis.3Universiteit Antwerpen Repository. Late Termination of Pregnancy in Belgium The law does not spell out what counts as “particularly severe and incurable,” so that judgment falls to the treating physician.

In these late cases a second doctor must be involved and their opinion added to your file. The procedure has to take place in a hospital, not an outpatient abortion center. There is no upper gestational limit written into the law for these medical exceptions.

If you are past 12 weeks but do not meet these medical grounds, Belgian centers commonly refer patients to the Netherlands, which allows abortion later in pregnancy.

What It Costs

With current Belgian health insurance (mutualité/ziekenfonds), the entire process, from consultation to procedure, costs around €5 out of pocket, because social security covers almost all of it.4Luna – Abortus. Cost

Without valid insurance, the price is much higher. At one major center network the uninsured total is about €594, split into roughly €239 at the first consultation and €355 on the day of the procedure.4Luna – Abortus. Cost Non-residents without Belgian social security coverage should plan for the full amount.

Minors and Confidentiality

The abortion law applies the same way to people under 18 as to adults. A minor can decide on her own whether to continue a pregnancy, and parents or guardians do not need to be told or to give consent.5Vrije Universiteit Brussel. href=”https://www.vub.be/en/services-vub-campuses-in-etterbeek-and-jette/health-and-safety-vub/medical-and-psychosocial-services-vub/abortion-in-brussels” target=”_blank” rel=”noopener”>Abortion in Brussels

Everyone involved in the care is bound by professional secrecy and cannot share information about your visit or decision with parents, partners, or anyone else. Financial privacy is built in as well: reimbursement statements and online medical records do not identify the nature of the consultation or treatment.

If a Doctor Refuses

Doctors, nurses, and medical assistants are allowed to refuse to take part in an abortion on personal grounds. What they cannot do is leave you stranded. A doctor who refuses must tell you at the very first visit, give you the contact details of another doctor, abortion center, or hospital, and transfer your complete medical file to whoever you see next.

Where to Go

You can contact a specialized abortion center directly, with no referral from a general practitioner required. The Luna network operates centers in Brussels, Antwerp, Ghent, and other cities, and hospitals also provide the procedure. Many centers have multilingual staff, which helps in a country where French, Dutch, and increasingly English are used in healthcare. Confidential helplines and psychosocial support are available before and after the procedure.

Reforms Under Discussion

A parliamentary bill has been debated that would extend the gestational limit from 12 to 18 weeks, remove the six-day mandatory waiting period, and further decriminalize the procedure.2ScienceDirect. Characteristics of Patients Requesting an Abortion Beyond 14 Weeks of Gestation: Retrospective Study in Brussels An expert group backed those recommendations, but the bill did not advance after a parliamentary session was cancelled for lack of quorum. The waiting period is separately under legislative review. The 12-week limit and six-day waiting period remain in force for now, so confirm the current rules with a provider before making plans.
