An affidavit of SSN ineligibility for state licensing is a notarized sworn statement that lets you complete a professional or occupational license application when you are legally unable to obtain a Social Security Number. Federal law requires every state to collect an SSN on license applications,1Office of the Law Revision Counsel. 42 USC 666 – Requirement of Statutorily Prescribed Procedures to Improve Effectiveness of Child Support Enforcement and the affidavit is the narrow workaround for applicants the Social Security Administration will not issue a number to. It is not available to anyone who already has an SSN, and signing one falsely is perjury.
Who Actually Qualifies
The affidavit is reserved for people who are legally ineligible for a Social Security Number. It is not available if you already have an SSN but lost the card, are waiting on a replacement, or would simply prefer not to share the number. Boards treat this distinction seriously.
The SSA generally issues SSNs to noncitizens only when the Department of Homeland Security has authorized them to work. If you are not work-authorized, you can still qualify for a number under a narrow “valid nonwork reason,” meaning a federal statute requires the SSN to receive a federally funded benefit, or a state or local law requires it for public assistance. A professional license is neither. The people who most often need this affidavit are noncitizens on nonimmigrant visas without independent work authorization: visitors on tourist or business visas, dependents of certain visa holders, and students not approved for employment training. If you are uncertain, the SSA recommends visiting a field office and asking whether you qualify before signing anything sworn.2Social Security Administration. Social Security Numbers for Noncitizens
One common trap: an Individual Taxpayer Identification Number is not a substitute. The IRS is explicit that ITINs are for federal tax purposes only, do not serve as identification outside the tax system, and do not authorize employment.3Internal Revenue Service. Individual Taxpayer Identification Number (ITIN) Writing your ITIN in the SSN field will not satisfy the board. If you have an ITIN but no SSN, you still need the affidavit.
Get Written Proof From the SSA First
Most licensing boards want documentation, not just your word. The usual route is to apply for an SSN at your local field office and, when the application cannot be processed, request the SSA-L676, a “Refusal to Process SSN Application” notice.4Social Security Administration. POMS RM 00299.020 – Form SSA-L676 – Refusal to Process SSN Application The SSA issues this form when you lack work authorization, when your immigration documents are about to expire, when the agency cannot verify your status through SAVE, or when you have no valid nonwork reason.
The form is usually handed to you at the field office or mailed shortly after. Note what it does and does not do: the SSA states the L-676 cannot be used as evidence of citizenship or immigration status, and it does not confirm you were never assigned an SSN. It documents only that the agency could not process your specific application.4Social Security Administration. POMS RM 00299.020 – Form SSA-L676 – Refusal to Process SSN Application
Ask your board how it wants the L-676 handled. Some boards accept the letter in place of a sworn statement; others treat it as supporting proof alongside their own affidavit form; a few require both.
Filling Out the Affidavit
Most boards publish a standardized affidavit template. Download it directly from the board rather than a third-party site, which may host an outdated version missing required legal language. The form generally asks for:
- Your full legal name, exactly as it appears on your government-issued identification, such as your foreign passport.
- Your date of birth and current residential address, used to distinguish you from other applicants in the state database.
- The specific license type you are applying for, whether a nursing license, cosmetology permit, accounting certification, or something else.
- A declaration, under penalty of perjury, that you do not have and are not eligible for a Social Security Number.
Use black or blue ink if you are completing the form by hand, and fill every field. A blank section gives the board a reason to reject the whole application package. Do not sign or date the form until you are in front of a notary. An affidavit signed outside a notary’s presence is not a sworn statement, and boards send those back.
Watch for an expiration window. Some boards treat the affidavit as valid for only 60 to 90 days from notarization. If your file sits in a queue past that, you may need a fresh notarized copy. Confirm the validity period before you submit so you do not lose time to an expired document.
Notarization
A notary public must witness your signature. You can find notaries at banks, shipping and mailing centers, law offices, and some public libraries. Fees are set by state law, with statutory caps ranging from a couple of dollars to $25 depending on the notarial act and jurisdiction, and several states set no maximum at all.5National Notary Association. 2026 Notary Fees By State Call ahead to avoid surprises.
Bring a valid photo ID. Most states accept a state-issued identification card or a U.S. passport, and one valid ID is usually enough.6National Notary Association. Determine if ID is Acceptable for Notarization Foreign passports are accepted in some states, but not every notary is comfortable verifying them. If your only government-issued photo ID is a foreign passport, confirm with the notary before your appointment.
Submitting the Affidavit
Once notarized, the affidavit becomes part of your permanent licensing file. Most boards want the original physical document mailed in because the notary’s embossed seal does not reproduce well in a scan. Use certified mail or a delivery service with tracking. Some newer licensing portals accept high-resolution digital uploads, but even those boards typically require you to keep the original in case of audit. Processing usually runs longer than a standard application because the board has to cross-reference the affidavit against your other materials.
After the affidavit lands, the board may verify your immigration status through SAVE, a federal database run by U.S. Citizenship and Immigration Services. To open a SAVE case, the agency submits your name, date of birth, the benefit you are requesting, and at least one immigration identifier such as an Alien Registration Number, an I-94 record number, or a SEVIS ID. SAVE cannot verify status using only a name or a foreign passport number. If the automated check does not produce a result, the agency may need to submit additional documentation for manual review,7U.S. Citizenship and Immigration Services. SAVE Verification Process and that is where delays tend to happen. Having copies of your immigration documents ready to send in can shorten the wait.
Report an SSN if You Later Get One
The affidavit does not permanently excuse you from the SSN requirement. If your immigration status changes and you become eligible, you are generally required to report the number to the licensing agency right away. Some affidavit forms build this obligation into the sworn statement itself.8National Association of State Boards of Accountancy. Affidavit of SSN Ineligibility Even where the form is silent, state laws implementing 42 U.S.C. ยง 666 still require the number to be on file, so obtaining an SSN and not reporting it puts your license at risk.
This matters most if your status is likely to change soon. Students expecting work authorization through a training program and dependents whose spouses are moving to a work visa should plan on updating the board the moment the SSN card arrives. Failing to do so can be treated as a material omission and, depending on the jurisdiction, grounds for suspension or revocation.
Consequences of Filing a False Affidavit
Because the affidavit is sworn, lying on it is perjury. Federal perjury carries a potential sentence of up to five years in prison, a fine, or both.9Office of the Law Revision Counsel. 18 USC 1621 – Perjury Generally State perjury statutes add their own penalties, which almost always include the possibility of jail time and fines. Submitting a false affidavit also guarantees denial of your license application and may lead to a permanent bar from reapplying with that board.
The most common way applicants get this wrong is filing the affidavit when they actually have an SSN but want to keep it private, or when they had work authorization years ago, were assigned a number, and now assume it expired. Social Security Numbers do not expire. If you were ever issued one, you have one, and the affidavit is not available to you. When in doubt, visit an SSA field office and have them check their records before you sign anything under oath.
