Age of Consent in Pakistan: Section 375 and Marriage Age

The age of consent in Pakistan is 16. Section 375 of the Pakistan Penal Code classifies any sexual act with a person under 16 as rape, whether or not that person appeared to agree.1Pakistani.org. Pakistan Penal Code (Act XLV of 1860) The number is straightforward. What sits around it is not, because marriage-age rules differ by province, a 2025 law reshaped the situation in Islamabad, and separate statutes reach conduct that Pakistani law treats as legal at 16.

What Section 375 Says

Section 375 lists seven circumstances that make a sexual act rape. The sixth sets the age line: intercourse “with or without B’s consent, when B is under sixteen years of age.”1Pakistani.org. Pakistan Penal Code (Act XLV of 1860) Verbal agreement, initiation, or apparent willingness by a person under 16 does not change the legal characterization. The act is treated as non-consensual by operation of law.

The current text is gender-neutral, using “person A” and “person B,” and defines “person” to include male, female, and transgender individuals.1Pakistani.org. Pakistan Penal Code (Act XLV of 1860) Consent is defined as “an unequivocal voluntary agreement” shown through words, gestures, or other clear signals. Absence of physical resistance is not consent.

Marriage Age Is a Separate Question

The minimum age to marry in Pakistan does not track the age of consent, and it does not sit at a single number across the country. The federal baseline in the Child Marriage Restraint Act of 1929 set the floor at 18 for males and 16 for females. Provinces can legislate independently on this, so those numbers no longer apply uniformly.

Province by Province

Sindh moved first. The Sindh Child Marriage Restraint Act of 2013 set the minimum at 18 for both brides and grooms, and anyone who performs, facilitates, or solemnizes a marriage involving someone under 18 faces criminal penalties.2Sindh Judicial Academy. Sindh Child Marriage Restraint Rules, 2016 Punjab passed its own child marriage restraint law in 2026, also fixing the threshold at 18 for both sexes.

Balochistan and Khyber Pakhtunkhwa still operate under the 1929 federal act, which means girls as young as 16 can be legally married there. The position in Gilgit-Baltistan is not clearly documented in available sources.

The 2025 Islamabad Capital Territory Act

In May 2025, Parliament passed the Islamabad Capital Territory Child Marriage Restraint Act. The law repealed the 1929 Act within the capital territory and set 18 as the minimum marriage age for both boys and girls.3UN Women Pakistan. Islamabad Capital Territory Child Marriage Restraint Bill 2025 Anyone who facilitates or forces a child into marriage, including family members, religious clerics, and marriage registrars, can face up to seven years in prison.

The ICT Act also declared, in express terms, that sexual relations with a minor spouse constitute statutory rape, even within marriage and even where the minor appears to have agreed. That provision closed a colonial-era marital exception in the Penal Code that had historically shielded some spousal sexual contact from rape charges. The status of that exception outside the capital territory varies.

The Gap Between Marriage Age and Consent Age

Where a province has raised the marriage age to 18 but the Penal Code still fixes the age of consent at 16, a 16- or 17-year-old is old enough to consent to sex under criminal law but too young to marry. In provinces still on the 1929 Act, both numbers can align at 16 for girls. This mismatch affects how courts handle cases involving adolescents who marry across provincial lines or through religious ceremonies that are never registered with civil authorities.

Enforcement is the weak point. The Muslim Family Law Ordinance of 1961, which governs marriage registration, does not lay out a procedure for Nikah Registrars to verify the ages of the parties before officiating. Underage marriages continue to occur in significant numbers despite being illegal on paper.

Penalties When the Victim Is a Minor

Section 376 sets the sentence for a standard rape conviction at 10 to 25 years of imprisonment, with the death penalty available and a fine imposed on the convicted person.4Office of the United Nations High Commissioner for Human Rights. Submission to the UN SRVAW Thematic Report on Rape

When the victim is a minor or a person with a mental or physical disability, the mandatory minimum jumps to life imprisonment, and the death penalty remains available.4Office of the United Nations High Commissioner for Human Rights. Submission to the UN SRVAW Thematic Report on Rape The same enhanced sentencing applies to a public servant who exploited their position, such as a police officer, medical professional, or jailer.

Child-marriage violations carry their own penalties, which vary by jurisdiction. Under the 2025 ICT Act, facilitating a child marriage can bring up to seven years of imprisonment. In areas still governed by the 1929 Act or lighter provincial equivalents, penalties tend to be shorter prison terms and fines.

Same-Sex Conduct Is Criminalized at Any Age

The 16-year threshold applies only to heterosexual conduct. Same-sex sexual activity is illegal in Pakistan regardless of the ages of the participants. Section 377 criminalizes what the statute calls “carnal intercourse against the order of nature” and provides for two to ten years of imprisonment, with life imprisonment as the maximum. Both participants can be prosecuted. Enforcement is inconsistent, but the section remains actively on the books. No “age of consent” framework applies to same-sex relations because the conduct itself is prohibited.

U.S. Citizens Are Reached by U.S. Law

American citizens and lawful permanent residents remain subject to U.S. federal law when they are in Pakistan. Under 18 U.S.C. ยง 2423, a U.S. citizen or permanent resident who engages in sexual conduct with a person under 18 while in a foreign country faces up to 30 years in federal prison. The federal age is 18, not 16. Conduct that is legal under Pakistan’s Penal Code because the other person is 16 or 17 can still be charged and convicted in U.S. federal court. Attempts and conspiracies carry the same penalties as completed offenses.5Office of the Law Revision Counsel. 18 USC 2423 – Transportation of Minors The Department of Justice pursues these cases through its Child Exploitation and Obscenity Section.
