Animal Welfare (Sentience) Act 2022: Committee, Duties, and Scope

The Animal Welfare (Sentience) Act 2022 is a UK law that requires the government to consider how its policies affect the welfare of sentient animals, and creates an independent expert committee to publicly assess whether ministers are doing so. It does not regulate how individuals treat animals, ban any specific practice, or give anyone new rights to enforce in court. It fills the gap left when the UK’s departure from the European Union removed Article 13 of the Lisbon Treaty from domestic law, and its enforcement runs entirely through transparency and parliamentary accountability.

Which Animals Are Covered

Section 5 defines “animal” as any vertebrate other than humans, any cephalopod mollusc, and any decapod crustacean.1Legislation.gov.uk. Animal Welfare (Sentience) Act 2022 Vertebrates cover mammals, birds, reptiles, amphibians, and fish. The two invertebrate groups, which include octopuses, squid, cuttlefish, crabs, lobsters, crayfish, and shrimp, were added after a government-commissioned review at the London School of Economics found substantial scientific evidence that they can experience pain and distress.2London School of Economics and Political Science. Review of the Evidence of Sentience in Cephalopod Molluscs and Decapod Crustaceans

Recognising these species as sentient did not, on its own, change anything for the fishing or restaurant industries. The government stated at the time that there would be “no direct impact on the shellfish catching or restaurant industry.”3GOV.UK. Lobsters, Octopus and Crabs Recognised as Sentient Beings The effect is prospective: welfare must be weighed when future policies are made.

How New Species Can Be Added

The Secretary of State can amend the definition by regulations to bring in additional invertebrate species. Any change must be laid before both Houses of Parliament in draft and approved by resolution of each House.1Legislation.gov.uk. Animal Welfare (Sentience) Act 2022 As of early 2026, no species have been added through this mechanism.

The Animal Sentience Committee

The Act’s operational core is the Animal Sentience Committee, an independent body chaired by Michael Seals CBE with members drawn from veterinary science, agricultural economics, bioethics, and animal behaviour research.4GOV.UK. Animal Sentience Committee The committee chooses which government policies to scrutinise, whether those policies are still being drafted or already in force.

Its reports address one specific question: whether the government is having, or has had, “all due regard” to the ways a policy might adversely affect the welfare of animals as sentient beings. Reports can recommend steps ministers should take. In carrying out this work the committee is required to have regard to religious rites, cultural traditions, and regional heritage.5Legislation.gov.uk. Animal Welfare (Sentience) Act 2022 – Section 2

What the committee cannot do is just as important. It cannot veto legislation, block a policy, or override a ministerial decision. Ministers are under no statutory duty to accept its recommendations. The committee’s power is publicity: forcing the government to justify its position in public, on the record, in response to expert analysis.

Published reports have ranged across glue traps, lead ammunition restrictions, the XL Bully dog ban, pet import rules, livestock protection legislation, the Renters’ Reform Bill, the Online Safety Act, and veterinary medicine regulations.4GOV.UK. Animal Sentience Committee The committee has also flagged that decapod crustaceans, though recognised as sentient under this Act, are not classified as protected animals under the Animals (Scientific Procedures) Act 1986, and has recommended aligning the two definitions.6GOV.UK. What “All Due Regard” Actually Requires

The phrase “all due regard” is the legal standard, and it is deliberately narrower than it sounds. The Explanatory Notes state that the requirement does not mean animal welfare must “take precedence over other considerations when formulating or implementing a particular policy.”7Legislation.gov.uk. Animal Welfare (Sentience) Act 2022 Explanatory Notes A minister can acknowledge that a policy harms animals and proceed with it, provided welfare impact was genuinely considered in the decision.

The Act creates no statutory penalties for ministers who fall short. There is no fine, no criminal liability, and no mechanism for the committee to halt a policy. Enforcement runs through parliamentary accountability alone. Because “all due regard” is not defined in the legislation and no court cases have tested it through judicial review as of early 2026, its precise legal boundaries remain unsettled.

The Government’s Duty to Respond

When the committee publishes a report, the Secretary of State must lay a written response before Parliament within three months.8Legislation.gov.uk. Animal Welfare (Sentience) Act 2022 – Section 3 The clock pauses during periods when Parliament is dissolved or prorogued, or during adjournments of four or more days in both Houses, so the effective deadline can stretch longer than three calendar months.

The response has to address the committee’s findings and explain the government’s position on the welfare issues raised. Laying it before Parliament puts it on the official record, where MPs and peers can use it for further scrutiny. The Explanatory Notes describe this requirement as intended to “encourage Ministers to engage with the Committee’s recommendations in appropriate detail in a timely manner.”7Legislation.gov.uk. Animal Welfare (Sentience) Act 2022 Explanatory Notes

How This Differs From the Animal Welfare Act 2006

The Sentience Act does not replace the Animal Welfare Act 2006, and the two laws do different jobs. The 2006 Act imposes a duty of care on individuals: it is an offence to cause unnecessary suffering to animals in your care, and owners must meet five welfare needs covering environment, diet, normal behaviour, housing, and protection from pain, suffering, injury, and disease.6GOV.UK. Animal Sentience Committee: Welfare Implications of Legislative Differences in the Definition of Animals

The 2022 Act imposes a duty on the government. It creates no criminal offences, regulates no private conduct, and adds no requirements for how you look after your pets or livestock. It also reaches wider in species terms, covering cephalopods and decapods that the 2006 Act does not, and covering wild animals regardless of whether they are captive.

Territorial Reach

The Act extends to England and Wales, Scotland, and Northern Ireland.1Legislation.gov.uk. Animal Welfare (Sentience) Act 2022 The committee’s scrutiny power, however, does not reach into devolved matters. Policy areas within the legislative competence of the Scottish Parliament, the Senedd Cymru, or the Northern Ireland Assembly sit outside its remit.5Legislation.gov.uk. Animal Welfare (Sentience) Act 2022 – Section 2 Because animal welfare is largely devolved, the committee’s effective focus falls on UK-wide areas such as international trade, border controls, and reserved regulatory frameworks. The devolved administrations can adopt their own sentience legislation, but this Act does not bind their policy-making.
