Asylum granted indefinitely means your permission to live and work in the United States has no expiration date, but it is not the same as permanent residency and it can be ended under specific circumstances. Your Form I-94 will typically show no end date, and your authorization continues until the government formally terminates it.1U.S. Citizenship and Immigration Services. Asylees and Refugees The practical takeaway: you do not have a deadline to leave, but you do have a strong reason to apply for a green card as soon as you are eligible.
What Indefinite Status Actually Means
When USCIS grants asylum, it issues a Form I-94 (Arrival/Departure Record) annotated with language like “asylum granted indefinitely,” a citation to 8 CFR 274a.12(a)(5), or a reference to INA 208. Unlike most other Forms I-94, an asylee’s version typically carries no expiration date.1U.S. Citizenship and Immigration Services. Asylees and Refugees Your status remains active until the government formally terminates it through proceedings under 8 CFR 208.24.2eCFR. 8 CFR 208.24 – Termination of Asylum or Withholding of Removal or Deportation
The distinction that trips people up is between “indefinite” and “permanent.” A lawful permanent resident holds a green card and has a guaranteed right to live in the United States. An asylee has ongoing permission to stay, but that permission depends on the original reasons for protection still being valid and on your continued good conduct. It lasts as long as it is needed, not forever by right.
Work Authorization and Identification
You are authorized to work the moment asylum is granted, and that authorization does not expire.3U.S. Citizenship and Immigration Services. Handbook for Employers M-274 – 7.3 Refugees and Asylees You do not need a separate Employment Authorization Document (EAD) to start a job. Your Form I-94 with the asylum notation already proves eligibility.4U.S. Department of Justice. Refugees and Asylees Have the Right to Work: Information for Employers
Many asylees still apply for a physical EAD (Form I-765) because the card works as a government-issued photo ID. That comes in handy for banks, landlords, and other everyday situations. USCIS should issue an EAD after granting asylum; if one does not arrive, contact the asylum office that handled your case.5U.S. Citizenship and Immigration Services. You can also apply for an unrestricted Social Security card as soon as you have asylee status. Unrestricted means the card carries no employment limitations, unlike the versions issued to some temporary visa holders.5U.S. Citizenship and Immigration Services. When Asylum Can Be Terminated
Because indefinite is not the same as unconditional, it helps to know exactly what can end your status. Under 8 U.S.C. ยง 1158(c)(2), USCIS can terminate asylum in several situations.6Office of the Law Revision Counsel. 8 USC 1158 – Asylum The most common triggers:
- Fundamental change in country conditions, so the original basis for persecution no longer exists.6Office of the Law Revision Counsel. 8 USC 1158 – Asylum
- Fraud or misrepresentation in the original application that affected eligibility.2eCFR. 8 CFR 208.24 – Termination of Asylum or Withholding of Removal or Deportation
- Conviction for a particularly serious crime or an aggravated felony. USCIS treats any aggravated felony as a particularly serious crime for asylum purposes.7U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 7 Part M Chapter 6 – Termination of Status and Notice to Appear Considerations
- Voluntarily returning to your home country and obtaining or seeking permanent resident status there.6Office of the Law Revision Counsel. 8 USC 1158 – Asylum
- Acquiring a new nationality and enjoying its protection.6Office of the Law Revision Counsel. 8 USC 1158 – Asylum
Termination is not automatic. Before ending your status, USCIS must give you at least 30 days’ written notice of the reasons and an opportunity to respond in a hearing.2eCFR. 8 CFR 208.24 – Termination of Asylum or Withholding of Removal or Deportation
Traveling Abroad Without Jeopardizing Your Status
Before any international trip, you need a refugee travel document. File Form I-131 (Application for Travel Document) with USCIS; the document itself is issued as Form I-571.8eCFR. 8 CFR Part 223 – Reentry Permits, Refugee Travel Documents, and Advance Parole Documents Trying to reenter without it can lead to serious delays at the border or denial of entry.
The bigger risk is traveling back to the country you fled. Returning there can be treated as evidence that you no longer fear harm, and voluntarily returning to seek or obtain permanent status in that country is an explicit statutory ground for termination.6Office of the Law Revision Counsel. 8 USC 1158 – Asylum Even a short visit can raise questions during a later green card interview. The safest approach is to avoid travel to your home country entirely while you hold asylee status.
Bringing Your Spouse and Children
You can petition to bring your spouse and unmarried children under 21 by filing Form I-730, Refugee/Asylee Relative Petition. The deadline matters: file within two years of your asylum grant date. Miss that window and you lose the straightforward reunification path. USCIS can waive the deadline for humanitarian reasons, but counting on a waiver is a gamble.9U.S. Citizenship and Immigration Services. I-730, Refugee/Asylee Relative Petition
Only a spouse and unmarried children under 21 qualify. In limited circumstances, unmarried children over 21 may qualify under the Child Status Protection Act, but the general rule is strict on both relationship and age. Parents, siblings, and other relatives are not eligible through Form I-730.9U.S. Citizenship and Immigration Services. I-730, Refugee/Asylee Relative Petition
Ongoing Responsibilities
Two obligations catch asylees off guard more than any others.
Report address changes within 10 days of moving. Every noncitizen must notify USCIS of a new address using Form AR-11 online or by mail. Skipping this step means USCIS mail goes to the wrong place, which cascades into missed deadlines and procedural problems.10U.S. Citizenship and Immigration Services. AR-11, Alien’s Change of Address Card
Male asylees between 18 and 26 must register with the Selective Service System. Registration is required within 30 days of turning 18, or within 30 days of entering the United States for men who arrive between ages 18 and 25. Failing to register can jeopardize a future citizenship application.5U.S. Citizenship and Immigration Services. Benefits and Responsibilities of Asylees11Selective Service System. Applying for a Green Card After One Year
After one year of physical presence in the United States following your asylum grant, you become eligible to apply for lawful permanent resident status by filing Form I-485, Application to Register Permanent Residence or Adjust Status.12Office of the Law Revision Counsel. 8 USC 1159 – Adjustment of Status of Refugees Congress eliminated the annual cap on asylee adjustments in 2005, so there is no numerical limit on how many asylees can move to green card status each year.13U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 7 Part M Chapter 1 – Purpose and Background
The application requires documentation of your asylum grant and your continuous physical presence during the qualifying year. You will also need an immigration medical examination on Form I-693, completed by a USCIS-designated civil surgeon.14U.S. Citizenship and Immigration Services. Report of Immigration Medical Examination and Vaccination Record The exam covers required vaccinations under immigration law, and missing vaccinations can render you inadmissible unless the civil surgeon administers them.15U.S. Citizenship and Immigration Services. Vaccination Requirements
USCIS filing fees have changed significantly since early 2026. Check the current schedule at uscis.gov/forms/filing-fees before filing, because amounts in older guides are likely outdated. The civil surgeon’s exam is a separate out-of-pocket cost that USCIS does not regulate, and prices vary widely; getting quotes from a few designated civil surgeons is worth the effort.
There is no legal penalty for staying in asylee status indefinitely without adjusting, but it leaves you more exposed. Asylum can be terminated on the grounds listed above; permanent residency is not vulnerable to the same mechanisms. Filing for adjustment as soon as you hit the one-year mark is the single most important step you can take to secure your long-term future.
Federal Support During Resettlement
Asylees can access programs administered through the Office of Refugee Resettlement (ORR), including Refugee Cash Assistance (RCA) and Refugee Medical Assistance (RMA), which help with basic needs during early resettlement. For individuals whose ORR eligibility date falls on or after May 5, 2025, each program provides up to four months of assistance. RMA is available to those who do not qualify for Medicaid and provides equivalent coverage.16Office of Refugee Resettlement. Benefits and Services Available for Asylees
ORR-funded social services such as English classes, job placement help, and case management run on longer timelines. To access any of these programs, bring proof of your asylum status to a local ORR-funded provider. Eligibility windows are counted from your asylum grant date, so reaching out to a local resettlement agency soon after your grant helps you avoid missing time-limited benefits.16Office of Refugee Resettlement.
