The license requirements for an ATM business sit in layers: a business entity and federal tax ID, often a state money-services or ATM-operator license, local permits where the machines are placed, a sponsor bank agreement to reach the card networks, and ADA-compliant equipment. Federal registration with FinCEN as a Money Services Business is required only if your machines do more than let customers withdraw cash from their own accounts. Skipping any required piece can trigger civil penalties of $5,000 per day and criminal exposure of up to five years in prison.
Do Your ATMs Trigger FinCEN Registration
This is the question that reshapes everything else, and it has a clearer answer than most operators realize. FinCEN guidance states that an ATM owner-operator whose machines only let customers withdraw cash from their own bank accounts and check balances is generally not a Money Services Business. The machine acts as a terminal for the customer’s own bank, dispensing the customer’s own funds. No third-party transmission, no currency exchange.1Financial Crimes Enforcement Network. Add features, and that changes. If your ATMs sell prepaid cards, allow bill payments, enable money transfers to third parties, or exchange currency beyond $1,000 per person per day, you likely meet the MSB definition and must register federally. That registration pulls in a written anti-money laundering program, suspicious activity reporting, and ongoing compliance costs. A plain cash-withdrawal operation skips the federal MSB piece but still needs everything else below.1Financial Crimes Enforcement Network. Form the Entity and Get an EIN
Before any financial regulator will deal with you, you need a legal entity and a federal tax ID. Most ATM operators form an LLC or corporation to separate personal assets from business liabilities. Then apply for an Employer Identification Number through the IRS. An EIN is required to operate a partnership, LLC, or corporation and serves as your business’s identity for tax filings and regulatory registrations.2Internal Revenue Service. Employer Identification Number
The IRS issues EINs immediately through its online application, at no cost. Keep the confirmation letter. You’ll use the EIN for FinCEN registration if applicable, your sponsor bank application, state licensing, and your business bank account.
State Licenses and Local Permits
State requirements vary widely, and this is where new operators often stumble. Some states require non-bank ATM operators to hold a money transmitter license or a specialized ATM operator registration issued through the state’s banking or financial regulation department. Others treat basic ATM operation as exempt, particularly when machines only dispense cash from customer accounts. A handful of states require no special financial-services license for ATM operators at all.
Where a license is required, three conditions tend to recur:
- A surety bond, with amounts for money-services businesses ranging from roughly $50,000 to $500,000, and some states allowing the commissioner to raise the requirement based on transaction volume.
- Application fees ranging from a few hundred dollars to over $1,000, depending on the jurisdiction.
- Fingerprinting and background checks for all principal owners and officers.
Local municipalities add another layer. Some cities and counties require vending-machine or mechanical-device permits for ATMs in commercial locations, usually with modest annual fees per machine. Check with the local clerk’s office in each jurisdiction where you plan to place equipment. Failing to pull a required local permit can result in fines or equipment seizure, and the rules vary enough that a phone call ahead is worth the ten minutes.
What MSB Registration Involves
If your machines offer services beyond basic cash withdrawals and balance inquiries, you must register as a Money Services Business with FinCEN. The registration must be filed within 180 days of establishing the business.3Office of the Law Revision Counsel. United States Code Title 31 Section 5330 – Registration of Money Transmitting Businesses
Registration happens through FinCEN Form 107, filed electronically through FinCEN’s BSA E-Filing System.4Financial Crimes Enforcement Network. BSA E-Filing System The form asks for your legal name, EIN, business address, and date the MSB was established; the owner or controlling person (the largest single shareholder for a corporation, each general partner for a partnership, the individual for a sole proprietorship) with name, Social Security Number, and home address; the MSB activity categories you fall into, such as money transmitter, currency dealer or exchanger, or provider of prepaid access; and the number and physical addresses of your branch locations or individual machines. Post office boxes don’t count.5Financial Crimes Enforcement Network. AML Program and Ongoing Reports
Registered MSBs must establish and maintain a written anti-money laundering program with four minimum components:7eCFR. 31 CFR 1022.210 – Anti-Money Laundering Program
- Internal controls, meaning written policies and procedures for verifying customer identity, filing required reports, creating and retaining records, and responding to law enforcement requests.
- A designated compliance officer responsible for day-to-day compliance, keeping the program current, and ensuring staff training.
- Training for employees who handle transactions or compliance functions.
- Periodic independent review by someone not involved in daily operation of the program.
Two ongoing reports follow. File a Suspicious Activity Report (FinCEN Form 111) whenever you know or suspect a transaction is suspicious and involves $2,000 or more.8Internal Revenue Service. Sponsor Bank Agreement
Licensing makes your business legal. A sponsor bank is what actually makes your ATMs work. Independent ATM operators cannot connect directly to payment networks like Visa, Mastercard, Plus, or STAR. You need a financial institution that is already a network member to vouch for you and register your machines for access.10Federal Financial Institutions Examination Council. FFIEC BSA/AML Manual – Independent Automated Teller Machine Owners or Operators
Expect two contracts. A sponsorship agreement with a bank that registers you as an Independent Sales Organization with the EFT networks, and a processing agreement with an acquiring processor that routes transactions through those networks for authorization and settlement. Some processors act as the sponsor bank too, bundling both into one relationship.
Sponsor banks absorb regulatory risk by associating with your operation, so they scrutinize compliance. They’ll ask for your FinCEN registration if applicable, your AML program, proof of insurance, and documentation of your machine locations. If your compliance slips, the sponsor can terminate the relationship, which shuts down every machine on your network until you find a replacement.
ADA Compliance
Every ATM in a location open to the public must comply with Section 707 of the 2010 ADA Standards for Accessible Design. Where multiple machines sit at one location, at least one must meet the standard. Most operators make all machines compliant to avoid liability.11U.S. Department of Justice. 2010 ADA Standards for Accessible Design
The requirements fall into three areas:
- Physical access, including a clear floor space of at least 30 by 48 inches in front of the machine for wheelchair access, and controls reachable between 15 and 48 inches from the ground. Drive-up-only machines are exempt from the reach-range rules.
- Speech output. The machine must be speech-enabled, delivering operating instructions, transaction prompts, error messages, balance inquiries, and receipt information through a headphone jack or telephone handset. Speech must be recorded or synthesized human voice, and the user must be able to repeat or interrupt it.
- Tactile input. At least one input control for every function must be distinguishable by touch. Braille instructions must identify how to initiate speech mode. The machine must offer the same degree of privacy for input and output that sighted users receive.
No regulator checks ADA compliance during licensing. Enforcement runs through lawsuits, often filed by advocacy organizations after a complaint. Settlements routinely include machine replacement costs, retrofitting fees, and attorney’s fees, so buying compliant equipment up front is cheaper than retrofitting or defending a case later.
Penalties for Operating Without the Right Licenses
Federal penalties stack fast. If your business qualifies as an MSB and you fail to register, the civil penalty is $5,000 per violation, with each day of continued non-compliance counting as a separate violation.3Office of the Law Revision Counsel. United States Code Title 31 Section 5330 – Registration of Money Transmitting Businesses Six months unregistered puts potential penalties above $900,000 before criminal exposure enters the picture.
Operating an unlicensed money transmitting business carries a fine and up to five years in federal prison. The statute applies whether or not you knew your operation required a license.12Office of the Law Revision Counsel. United States Code Title 18 Section 1960 – Prohibition of Unlicensed Money Transmitting Businesses BSA reporting and recordkeeping violations carry additional civil money penalties assessed through FinCEN’s enforcement division.13Financial Crimes Enforcement Network. Enforcement Actions
State penalties vary and can include license revocation, additional fines, and referral to federal authorities. The practical consequence can be worse than the legal one. Losing your sponsor bank over a compliance failure means dark machines, lapsed location agreements, and rebuilding from zero.
Renewals and Recordkeeping
Federal MSB registration is filed electronically and posts to FinCEN’s public MSB list within roughly two weeks. Paper filings take about 60 days. FinCEN no longer sends acknowledgment letters; your appearance on the public list is the confirmation.14Financial Crimes Enforcement Network. MSB Registration Web Site
MSB registration must be renewed every two years.5Financial Crimes Enforcement Network. Money Services Business (MSB) Registration You also need to re-register before the two-year mark if more than 10 percent of the voting power or equity interest in the business transfers. State license renewals follow their own schedules, often annual. Calendar both federal and state deadlines with lead time. A lapsed registration can trigger the same penalties as never having registered.
Keep a complete archive of every confirmation, filing receipt, and renewal notice. Sponsor banks and state examiners request these during audits, and reconstructing a missing compliance record after the fact is expensive and looks suspicious to regulators.
