Bermuda Citizenship: Eligibility, Documents, Fees, and Processing

To meet Bermuda citizenship requirements, you need to qualify under one of the pathways set out in the Bermuda Immigration and Protection Act 1956: birth in Bermuda to a status-holding parent, ancestry through a Bermudian parent born overseas, ten years of marriage to a Bermudian combined with seven years of residency, long-term residency of twenty years (or fifteen in some family cases), or specific sibling and parent pathways for people connected to existing status holders. Each route has its own conditions, documentation, and fees, and applications go to the Department of Immigration.

What “Bermudian Citizenship” Actually Means

The legal designation people commonly call Bermudian citizenship is Bermudian Status. It is a local right under the 1956 Act to live, work, vote, and buy property on the island without restriction. It is not the same as British Overseas Territories Citizenship, which is a nationality classification under United Kingdom law. The two often overlap because BOTC holders connected to Bermuda also became entitled to full British Citizenship under Section 3(1) of the British Overseas Territories Act 2002, but holding one does not automatically give you the other. The Department of Immigration processes both types of application locally, and most long-term applicants pursue them together.1Government of Bermuda. Immigration

Qualifying by Birth or Ancestry

A child born in Bermuda holds Bermudian Status automatically at birth if the child is a Commonwealth citizen and at least one parent held Bermudian Status at the time of birth.2Bermuda Laws Online. Bermuda Immigration and Protection Act 1956 No application is required. Birth on the island alone is not enough; the parent connection and Commonwealth citizenship both have to be there.

For a child born outside Bermuda, the older rule added a domicile test: the Bermudian parent had to be domiciled in Bermuda at the time of birth, or at the time of death if the parent had died first.3International Labour Organization. Bermuda Immigration and Protection Act 1956 The Bermuda Immigration and Protection Amendment Act 2020 loosened this considerably. A child born overseas to a Bermudian parent no longer needs to prove the parent was domiciled in Bermuda at the time of birth, and the entitlement extends through two generations of overseas births: a Bermudian’s child born abroad is Bermudian from birth, and that child’s child born abroad is Bermudian from birth as well.4Government of Bermuda. The 2020 amendment also created pathways for people who were affected by arbitrary age cutoffs in the 1994 amendments and ended up with different status from their siblings. Those individuals can now apply for either Bermudian Status or a Permanent Resident’s Certificate.5Government of Bermuda. Repatriation and Mixed Status Families

One quirk to know about: a child born overseas to a Bermudian parent who is not a Commonwealth citizen still “possesses and enjoys Bermudian status indefinitely” but cannot vote in general elections until they become a Commonwealth citizen.6Government of Bermuda. Qualifying Through Marriage to a Bermudian

The spousal pathway under Section 19A of the Act has three core requirements.2Bermuda Laws Online. Bermuda Immigration and Protection Act 1956 You must have been married to your Bermudian spouse for the ten years immediately before the application, and your spouse must have held Bermudian Status throughout that whole period. You must have lived in Bermuda for seven years before applying, with the last two years continuous and the earlier five years counted only in unbroken twelve-month stretches during which you were married to the same spouse. And your Bermudian spouse must submit a letter supporting your application.

The Minister can deny the application if the couple has been estranged during the two years before filing or if the applicant has been convicted of an offense showing moral turpitude. Widows and widowers of Bermudians can still apply, with the timeline and conditions adjusted around the date of the spouse’s death.3International Labour Organization. Bermuda Immigration and Protection Act 1956 Short absences for travel or medical treatment do not necessarily break residency continuity, but prolonged periods abroad can disqualify stretches from counting.

Qualifying as a Long-Term Resident

Long-term residents without a family or spousal connection usually build toward status through a Permanent Resident’s Certificate first. A PRC is available to anyone who has been ordinarily resident in Bermuda for at least twenty years, including the two years immediately before the application.7Government of Bermuda. Permanent Resident’s Certificate Application A shortened fifteen-year track exists for non-Bermudian parents of a child who holds Bermudian Status, provided the parent has lived on the island for the two years immediately before applying.

A ten-year track is available for individuals who have been exempted from work-permit requirements under Section 5 of the Economic Development Act 1968 for at least ten years and have been ordinarily resident for that same period.8Government of Bermuda. Application for Permanent Resident’s Certificate This typically applies to senior executives in Bermuda’s international business sector.

A PRC grants the right to live and work in Bermuda but does not grant voting rights. Full Bermudian Status through the long-term residency route has historically been governed by Section 20A of the Act, which required birth in Bermuda or arrival before age six, ordinary residence on July 31, 1989, and ten years of continuous residence before applying.

One boundary worth flagging: the Economic Investment Certificate introduced in March 2021, which requires a qualifying investment of at least $2,500,000 Bermuda dollars maintained for five years, does not lead to Bermudian Status. It leads to a Residential Certificate for high-net-worth individuals who want a Bermuda base, and the application fee for the certificate alone is $2,755.9Government of Bermuda. Qualifying Through Siblings or Parents

The Act includes pathways for people connected to existing status holders through siblings or parents. Under Section 20D, you can apply if all of your siblings already possess Bermudian Status and you meet baseline requirements for good character, age, and residency.2Bermuda Laws Online. Bermuda Immigration and Protection Act 1956 Under Section 20E, parents of Bermudians can apply if they were ordinarily resident in Bermuda for at least twenty years by July 31, 1989, and their child or all of their children hold Bermudian Status.

Section 20B provides a separate pathway for Commonwealth citizens who were ordinarily resident on July 31, 1989, and who had at least one parent with Bermudian Status at the time of their birth, provided they were born in Bermuda or arrived before their sixth birthday.3International Labour Organization. Bermuda Immigration and Protection Act 1956 Each of these pathways requires ten years of continuous ordinary residence immediately before the application.

Documents You Will Need

The specific paperwork depends on your pathway, but the baseline is the same for every applicant. The official application form is Form 5, available from the Department of Immigration. The checklist calls for certified copies (not originals) of your long-form birth certificate, your marriage certificate if applicable, and all divorce decrees absolute.11Government of Bermuda. Spousal applicants need the supporting letter from their Bermudian spouse. Long-term residents need to document their entire residency history, including every period spent abroad exceeding two months, with dates and reasons for each absence.8Government of Bermuda. Application for Permanent Resident’s Certificate Gaps or inconsistencies in your travel chronology are the most common reason applications stall. If you have lived in Bermuda for twenty years, reconstructing a complete departure-and-return history is a real undertaking, and it pays to start gathering airline records, passport stamps, and employment records well before you plan to file. Passport numbers and previous work permit references must match the government’s internal records exactly.

Fees

Application fees for Bermudian Status itself are relatively modest:12Government of Bermuda. All Immigration Fees

  • Section 19 or 19A spousal application: $625
  • Section 20 long-term resident application: $275
  • Section 20B Bermudian-connection application: $630

If you are also applying for British Naturalisation as a BOTC at the same time, add $1,050 as a standalone application or $600 if filed alongside a status application.13Government of Bermuda. Bermudian Status Application PRC fees are on a different scale: a PRC under Section 31B costs $3,310, and a PRC under Section 31A carries a $50,000 fee.12Government of Bermuda. All Immigration Fees

Payment is only accepted via bank transfer or online payment. The Department no longer accepts cash or credit cards. Filing and Processing Times

Applications and supporting documents go to the Department of Immigration at the Government Administration Building, 30 Parliament Street, Hamilton. The department accepts submissions through its drop box on the first floor along with confirmation of online payment.1Government of Bermuda. Immigration

After submission, the Board of Immigration reviews the file. Processing times vary, but six to twelve months is a common range for straightforward applications. The Board may request additional documentation or schedule an interview. Once a decision is reached, you receive written notification. If your application is denied under a section that permits appeal, you can challenge the decision before the Immigration Appeal Tribunal.

How You Can Lose Status Later

Bermudian Status is not always permanent, and it is worth understanding this before you invest in an application. Under Section 22 of the Act, a person loses status automatically if they cease to be a Commonwealth citizen.3International Labour Organization. Bermuda Immigration and Protection Act 1956 This most often catches people who take up citizenship in a non-Commonwealth country and unintentionally renounce their Commonwealth citizenship.

Children and stepchildren who hold status solely through a parent can lose that status if the parent loses theirs, or when the child reaches age twenty-two. The Minister can also revoke status granted under Sections 19, 19A, 20A, or 20B if the grant was obtained through fraud, false representation, or concealment of a material fact. A person facing revocation on fraud grounds receives notice and has the right to appeal to the Immigration Appeal Tribunal, and losing status does not permanently bar someone from reapplying through the normal channels.
