Bill Referral Process: Committee Assignment and Multiple Referrals

The bill referral process is the step, taken almost immediately after a bill is introduced, in which the House Speaker or the Senate’s presiding officer sends the measure to the standing committee whose jurisdiction covers its subject. In the House, the Speaker must designate a single primary committee under Rule XII.1U.S. House of Representatives. Introduction and Referral In the Senate, Rule XVII sends the bill to the committee whose subject matter “predominates.”2U.S. Senate Committee on Rules and Administration. Rules of the Senate The choice looks clerical, but it usually decides whether the bill lives or dies: most introduced legislation never leaves the committee it lands in.

Who Makes the Referral Decision

Formal authority belongs to the Speaker in the House and to the presiding officer in the Senate. Neither person actually reads incoming bills to decide where they go. The day-to-day work is done by the House Parliamentarian and the Senate Parliamentarian, nonpartisan officials who evaluate each bill’s text and recommend a committee based on the rules and on past practice.3EveryCRSReport.com. The Parliamentarians work from published volumes of precedent stretching back over a century, applying the same principle a court would: stand by earlier decisions to keep results predictable.4GovInfo. House Practice: A Guide to the Rules, Precedents and Procedures of the House A referral question about a crop insurance bill today gets answered partly by how similar agricultural bills were handled decades ago. How the Matching Committee Is Identified

Each chamber’s standing rules spell out committee jurisdiction in detail. House Rule X lists every standing committee and the subjects it covers. Agriculture handles crop insurance, rural development, livestock inspection, and forestry. Financial Services handles banking, housing, insurance, and securities.5GovInfo. When a bill sits between two committees’ turf, the Parliamentarian looks for the topic that dominates the bill’s text and checks how earlier bills with similar overlap were routed. Consistent reliance on precedent keeps jurisdictional fights from erupting over every hybrid proposal.

The One Constitutional Rule

Article I, Section 7 of the Constitution requires bills raising revenue to originate in the House. The Supreme Court has read this to reach bills that levy taxes to fund general government operations, not bills that impose a targeted fee for a specific program.6Legal Information Institute (LII). Origination Clause and Revenue Bills Tax bills in the House go to Ways and Means; the Senate can amend a revenue bill the House has passed, but cannot introduce one.

From Introduction to Referral

The referral clock starts the moment a bill is formally introduced. A House member drops a physical copy of the bill into the hopper, a wooden box next to the Clerk’s desk on the floor.1U.S. House of Representatives. Introduction and Referral A senator introduces a bill from the floor during morning business or hands it to the clerks; under a standing order, Senate bills and resolutions can be introduced at any point during a daily session.7EveryCRSReport.com. The Clerk of the House or the Secretary of the Senate assigns the bill a number. House bills carry an H.R. prefix, Senate bills an S.8United States Senate. Key to Legislative Citations The Parliamentarian evaluates the text, the referral is entered in the Congressional Record, and the bill is printed. This usually happens the same day the bill is introduced or very shortly after.

When a Bill Touches More Than One Committee

Bills often cover subjects that don’t sit inside one committee’s jurisdiction. Both chambers have procedures for splitting or sharing the work, and they operate differently.

House Referrals

Before 1995, the House allowed joint referrals with no single committee in charge. That approach produced accountability problems and jurisdictional gridlock and was abolished. Under the current Rule XII, the Speaker must designate one committee of primary jurisdiction on every multi-committee referral.3EveryCRSReport.com. Committee Jurisdiction and Referral in the House From there, the Speaker has three options:

  • An additional initial referral, in which secondary committees receive the bill at the same time as the primary committee but the primary committee remains in the lead.
  • A sequential referral, in which the bill goes to the primary committee first and then moves to additional committees after that panel reports.
  • A split referral, in which different portions of the bill are carved out and sent to different committees based on subject matter.

The Speaker can set deadlines on secondary committees so a bill doesn’t stall indefinitely in a sequential chain.9Committee on House Administration. Rules of the House of Representatives (118th Congress)

Senate Referrals

The Senate still permits true joint referrals, but requires more consensus to trigger one. Under Rule XVII, a joint or sequential referral needs a motion supported by both the majority and minority leaders (or their designees). The motion must be printed in the Congressional Record and cannot be considered until at least 24 hours have passed.2U.S. Senate Committee on Rules and Administration. Rules of the Senate Committees involved in a joint referral must report the bill jointly with a single report. The motion can also allocate specific portions of the bill to specific committees, effectively creating a split referral, and can include time limits.10Congressional Research Service. What Happens Once a Committee Has the Bill

Referral is where most bills quietly end. The committee chair controls the schedule. If the chair doesn’t want to move a bill, nothing happens: no hearing, no markup, no vote. The bill sits until the two-year Congress ends and then expires.

Bills that do draw attention typically start with a hearing. Witnesses from executive agencies, industry, and advocacy groups testify; members ask questions. A hearing isn’t procedurally required, but it’s standard for anything of consequence.11Congress.gov. The Legislative Process: Committee Consideration

If support is there, the committee schedules a markup. Members propose and vote on amendments to the bill’s text, which can range from small edits to a full substitute. The markup ends when a majority votes to report the bill to the full chamber. Committees generally don’t schedule a markup unless the votes are already lined up.11Congress.gov. When a Bill Skips Referral

Committee referral is the default, but not the only path. Both chambers have procedures for putting a bill on the floor without waiting for a committee to act.

Senate Rule XIV

The Senate’s most-used bypass is Rule XIV, which places a bill directly on the Senate Calendar of Business instead of sending it to committee. The procedure runs on the two-readings requirement: a senator asks for the first reading, then requests a second reading and immediately objects to their own request. The second reading comes the next legislative day, another senator objects to further proceedings, and the objection places the bill on the calendar with the same status a committee-reported bill would carry.12EveryCRSReport.com. Senate Rule XIV Procedure for Placing Measures Directly on the Senate Calendar Leaders use it to preserve their ability to bring a bill up when a committee might sit on it or rewrite it.

Discharge Petitions in the House

The House equivalent is the discharge petition, which is harder to use. A member can file the petition once a bill has been in committee for at least 30 legislative days. If 218 members sign it, the bill can be brought to the floor over the committee’s objection. A discharge motion can then be offered on the second or fourth Monday falling at least seven legislative days after the signature threshold is reached.13EveryCRSReport.com. The Discharge Rule in the House: Recent Use in Historical Context Successful petitions are historically rare because signing one cuts against the majority party’s leadership.

Privileged Measures

Some business bypasses referral because the rules or the Constitution give it privileged status. In the House, that category includes general appropriation bills, conference reports, presidential veto messages, and special orders reported by the Rules Committee.14U.S. Government Publishing Office. House Practice: A Guide to the Rules, Precedents and Procedures of the House – Chapter 36 – Order of Business; Privileged Business Impeachment carries constitutional privilege.

Why the Referral Choice Shapes a Bill’s Fate

Referral is one of the most powerful levers in the legislative process precisely because it looks routine. A bill sent to a sympathetic chair gets hearings, staff attention, and a real chance at markup. The same bill sent to a chair who opposes it never moves. When a proposal touches multiple subjects, the choice of primary committee also sets the frame: a healthcare bill routed to a health committee is evaluated differently from one routed to a tax-writing committee because of the revenue provisions in its text.

Sponsors know this, and draft with jurisdiction in mind, sometimes framing a bill so it lands with a friendlier committee. Lobbyists watch referrals closely because the committee assignment tells them which members to work. That gatekeeping is a large part of why popular ideas stall for years while narrower proposals move quickly.
