Can Asylum Seekers Work in the USA? EAD Filing and Waiting Period

Asylum seekers can work in the USA, but only after receiving an Employment Authorization Document (EAD) from U.S. Citizenship and Immigration Services. You cannot apply for that work permit until your asylum application (Form I-589) has been pending for 150 days, and USCIS will not actually issue the card until day 180. The 150 and 180-Day Waiting Period

Work eligibility is measured by what USCIS calls the 180-Day Asylum EAD Clock. The clock starts the day USCIS or an immigration court receives your complete Form I-589. The clock is not just calendar time. Delays you cause freeze it, and frozen days do not count toward either threshold. Common triggers are failing to appear at a scheduled asylum interview, missing a biometrics appointment, or filing a motion that pushes back court proceedings. Restarting the clock after a stoppage is not automatic. If you missed a decision pickup at an asylum office, the clock will not resume until your first hearing before an immigration judge at the earliest. Filing Form I-765

You can file online through a USCIS account or by mailing a paper application to the correct USCIS lockbox for your state. Either way, you will get a receipt notice (Form I-797C) confirming submission with a case number for tracking.4U.S. Citizenship and Immigration Services. Your package needs to include:

  • Full name, current U.S. address, and Alien Registration Number (A-Number) if one has been assigned
  • Your I-94 Arrival/Departure Record number
  • Proof your asylum case is pending: a copy of the I-589 receipt notice, your date-stamped I-589, or equivalent evidence
  • Two recent, identical passport-style photos meeting USCIS specifications
  • A copy of a government-issued ID such as a passport

Requesting a Social Security Number on the Same Form

Most employers cannot put you on payroll without a Social Security Number. The easiest way to get one is to check the box on Form I-765 requesting an SSN and provide your name, date of birth, parents’ names, country of birth, and sex. Your card should arrive by mail no later than 14 days after your EAD. If it does not, contact your local SSA office. How Long the EAD Lasts and How to Use It

For applications filed or pending on or after December 5, 2025, the maximum validity is 18 months. If asylum is denied and appeals run out, the EAD ends on its expiration date. If asylum is granted, you move to asylee status under category (a)(5), which comes with its own work authorization.

When you start a job, the EAD (Form I-766) is a “List A” document on Form I-9, meaning it proves both identity and work authorization by itself. Renewing Before the Card Expires

Asylum cases often take years to decide, so most people will renew the EAD at least once. Filing on time matters. A timely renewal automatically extends your existing work authorization for up to 540 days while USCIS processes the new card. Let your current EAD expire before you file, and you lose that automatic extension along with your legal ability to work in the meantime.4U.S. Citizenship and Immigration Services. Why You Should Not Work Before the EAD Arrives

The wait is long and the financial pressure is real, but working before the EAD is issued creates lasting problems. Unauthorized employment is a permanent bar to adjusting status through certain pathways (for example, from asylee to lawful permanent resident). The bar covers any unauthorized work during any period of stay in the United States, and leaving the country and returning does not clear it.10U.S. Citizenship and Immigration Services. Unauthorized work does not, by itself, disqualify you from asylum, but it can hurt your credibility with an immigration judge and complicate the case in ways that are hard to reverse. Community organizations and legal aid groups can sometimes help with emergency assistance while the application is pending.
