No. You cannot buy cigarettes at 18 anywhere in the United States. Federal law raised the minimum age for buying any tobacco product to 21 on December 20, 2019, and that floor applies in every state, on tribal land, and to every buyer, including active-duty military. There is no grandfather clause for people who were already 18 when the law changed.1U.S. Food and Drug Administration. Tobacco 212U.S. Food and Drug Administration. The rule sits in the Federal Food, Drug, and Cosmetic Act, and the FDA enforces it through compliance checks at stores and online retailers. States and cities can be stricter, but none can go below 21.1U.S. Food and Drug Administration. Tobacco 21
Vapes, Cigars, and Everything Else Are Covered Too
The 21 minimum is not limited to cigarettes. It applies to every product that meets the federal definition of a tobacco product: cigars, smokeless tobacco, roll-your-own, pipe tobacco, hookah tobacco, and e-cigarettes.3eCFR. 21 CFR Part 1100 Subpart A – Tobacco Products Subject to FDA Authority
Since April 2022, it also covers products made with synthetic nicotine. Congress amended the definition so that anything “containing nicotine from any source” falls under FDA authority, closing a loophole some vape makers had used by switching to lab-made nicotine.4U.S. Food and Drug Administration. Expect to Be Carded Even If You Look Older
Retailers have to check photo ID for anyone who appears under 30. That threshold rose from 27 to 30 on September 30, 2024, after the FDA found that clerks often misjudge age by sight.5U.S. Food and Drug Administration. Ordering online does not get you around any of this. Under the federal PACT Act, any retailer shipping tobacco has to collect your name, date of birth, and residential address and run them against a commercial database built mainly from government records before accepting the order. At delivery, the driver has to get a signature from someone who is at least 21 and see a government-issued photo ID.6Office of the Law Revision Counsel. 15 USC 376a – Delivery Sales
What Happens If You Try to Buy Anyway
Federal law only penalizes the retailer, not the buyer. The statute makes it unlawful to sell tobacco to someone under 21, but it does not impose a federal penalty on the underage person attempting the purchase.7Office of the Law Revision Counsel. 21 U.S. Code 387f – General Provisions Respecting Control of Tobacco Products
State law is a different story. Roughly two-thirds of states have their own “purchase, use, or possession” laws that penalize people under 21 for buying, carrying, or using tobacco. Consequences typically include fines, community service, or a required tobacco education or cessation program. Some states have shifted from criminal penalties to diversion-style programs, and a few have repealed underage-buyer penalties entirely. Whether you personally face anything for trying depends on the state you’re in.
Can Anything Override the 21 Rule?
