Driving with a provisional license means you can finally get behind the wheel without a licensed adult beside you, but your state still restricts when you can drive, how many passengers you can carry, whether you can touch a phone, and what your blood alcohol level has to be. These rules apply for a set period — usually six to twelve months, or until you reach a certain age — and breaking them can extend the restrictions, suspend the license, or push back the day you qualify for a full one.
Nighttime Curfews
Most states block provisional drivers from the road during late-night and early-morning hours. The common curfew window runs from 11 p.m. or midnight until 5 or 6 a.m.1NHTSA. Countermeasures That Work – GDL Nighttime Restrictions Some states start earlier, at 9 or 10 p.m., particularly in the first months after you get the license.
Nearly every state writes in exceptions for driving to and from work, school-sponsored activities, religious events, and emergencies. A few states want you to carry proof — a signed note from an employer, say, or a physician’s statement for a medical reason. If your schedule has you on the road during curfew hours regularly, check whether your state expects documentation in the car.
Passenger Limits
Passenger caps are one of the most common provisional conditions. A typical rule restricts how many passengers under a certain age (often 21) can ride with you during the first six to twelve months. Some states allow no non-family passengers at all during the opening period; others permit one. Immediate family members are almost always exempt from the count.
After the initial restricted period, states usually loosen the cap, sometimes allowing two or three non-family passengers before the license converts to full privileges. The exact numbers and timelines vary, so your state motor vehicle agency is the only authoritative source for your specific limits.
Phones and Other Devices
Thirty-six states and the District of Columbia ban all cell phone use for novice drivers, and many of those bans cover hands-free devices too.2Governors Highway Safety Association. Distracted Driving The universal exception is calling for help in an emergency. These rules go beyond what adult drivers face in most states, where hands-free use is often legal.
Penalties for a violation typically include fines and, in some states, points on your driving record. Points during the provisional period can trigger extra consequences, including a longer provisional term. Dropping the phone in the glove box before you start the engine is the simplest way around all of it.
Zero Tolerance for Alcohol
Every state has had a zero-tolerance alcohol law for drivers under 21 since 1998.3NHTSA. Countermeasures That Work – Zero Tolerance Laws Federal law conditions a portion of highway funding on it: states that don’t enforce a maximum blood alcohol concentration of 0.02 percent for under-21 drivers lose transportation dollars.4Office of the Law Revision Counsel. 23 USC 161 – Operation of Motor Vehicles by Intoxicated Minors Some states set the limit even lower, at 0.01 percent or absolute zero.
Penalties are harsh compared to a first-offense adult DUI. A provisional driver caught over the threshold typically faces an automatic license suspension of six months to a year, fines, and mandatory enrollment in a substance abuse education program. Refusing a breathalyzer carries its own suspension, often longer than the one for a positive result. A zero-tolerance violation can also push back your eligibility for a full license by months or years.
Insurance You Need Before You Drive
You need auto insurance in place before you drive alone. In most families, the teen driver is covered under a parent’s or guardian’s existing policy, but only if the insurer knows about them. Some companies add a permitted teen to the household policy automatically; others require a call. Confirm coverage before anyone hands over the keys, because driving uninsured can lead to license suspension and personal liability after a crash.
Adding a teen to a family policy raises the premium significantly. Expect an increase in the range of 50 to 100 percent or more, depending on the insurer, your location, and the driver’s record. Shopping multiple carriers, raising deductibles, and asking about good-student or driver-education discounts are the common ways families bring the number down.
What Happens If You Break a Restriction
Violations during the provisional period are often more disruptive than the fine suggests. A common consequence is extension of the provisional period itself, meaning the restrictions stay with you longer. Multiple violations in a short window can trigger a suspension, frequently 90 days for a first suspension and potentially up to a year depending on the state and the violation.
The record follows you. Insurance rates, already high for teen drivers, climb further after a moving violation. Some states charge a reinstatement fee to get a suspended provisional license back, and the suspension can reset the clock on how long you have to hold the provisional before qualifying for a full license. The provisional stage is temporary; a clean record is the fastest way through it.
Moving to a Full License
Three requirements usually control the upgrade: reach the minimum age (often 17 or 18), hold the provisional license for a set period without violations, and maintain a clean driving record. The required holding period runs from six months to over a year, and some states simply require you to hold the provisional until you turn 18, no matter when you started.5Insurance Institute for Highway Safety. Graduated Licensing Laws
Whether you take another road test depends on your state. Some states require a separate driving exam before issuing the full license. In others, the provisional converts automatically once you meet the age and time requirements, and the updated license arrives by mail or at a DMV office. Either way, convictions for moving violations or restriction violations during the provisional period can delay the upgrade. Your state’s motor vehicle agency website is the only reliable place to confirm the exact steps.
