Can I Live in the UK If I Marry a British Citizen?

Yes, you can live in the UK after marrying a British citizen, but the marriage on its own does not give you the right to be here. You need a Spouse Visa (part of the Family Visa route under Appendix FM), and you and your partner must meet income, English language, and relationship requirements before the Home Office approves it. The visa runs for two and a half years initially, extends once, and leads to permanent settlement after five years.1GOV.UK. Family Visas: Apply, Extend or Switch – Overview

Who Qualifies

Both of you must be at least 18. Your partner has to be a British citizen or someone with settled status (permanent residency) in the UK. Civil partnerships count the same as marriage, so everything below applies to civil partners too.2GOV.UK. Family Visas: Apply, Extend or Switch – Apply as a Partner or Spouse

The Home Office also has to be satisfied that your relationship is genuine and that you plan to live together permanently. A marriage or civil partnership certificate is the starting point. On top of that, caseworkers look for joint financial accounts, tenancy agreements in both names, utility bills at the same address, and records of regular communication.2GOV.UK. Family Visas: Apply, Extend or Switch – Apply as a Partner or Spouse

Couples who have been living in different countries need to show more. Flight tickets from visits, money transfers, holiday bookings, and communication history all help. Work, study abroad, and cultural norms are accepted reasons for living apart, but where partners are apart caseworkers expect stronger evidence of shared finances or regular visits.3GOV.UK. The Money Requirement

For new applications, you and your partner need a combined gross annual income of at least £29,000. This threshold took effect in April 2024 and applies to all first-time Spouse Visa applications.4GOV.UK. Financial Requirements if Youre Applying as a Partner or Spouse Salaried employment, self-employment profits, and certain investment or pension income all count. The evidence you provide differs by source, and the Home Office publishes detailed guidance for each type.

One important carve-out: if you first applied before 11 April 2024 and are extending with the same partner, your threshold stays at £18,600.4GOV.UK. Financial Requirements if Youre Applying as a Partner or Spouse The higher figure only hits new applicants.

Using Savings Instead of Income

If your income falls short, cash savings above £16,000 can make up the difference. The formula multiplies the shortfall by 2.5 and adds £16,000. Meeting the whole £29,000 threshold on savings alone therefore takes £88,500 (£29,000 × 2.5 + £16,000).4GOV.UK. Financial Requirements if Youre Applying as a Partner or Spouse It’s a high bar, which is why most applicants build their case on employment income.

You also need somewhere adequate to live in the UK. The Home Office applies statutory overcrowding standards to whatever address you name, so a tenancy agreement, mortgage statement, or a letter from a host you’ll live with is part of the file.5GOV.UK. Part 8 – Family Members Adequate Maintenance and Accommodation

English Language at Each Stage

Your English has to improve as you move through the route:

  • First application: CEFR Level A1 in speaking and listening (basic).
  • Extension at 2.5 years: CEFR Level A2 (elementary), unless you already passed at A2 or higher the first time.
  • Settlement at 5 years: CEFR Level B1 (intermediate).

You prove your level by passing a Secure English Language Test (SELT) from an approved provider. A degree taught in English from a UK institution satisfies the requirement on its own. A degree taught in English from a non-UK institution needs an equivalency assessment from Ecctis.6GOV.UK. Family Visas: Apply, Extend or Switch – Knowledge of English

Nationals of majority-English-speaking countries, including the United States, Australia, Canada, New Zealand, and Jamaica, are exempt from proving English at the settlement stage.7GOV.UK. Prove Your Knowledge of English for Citizenship and Settling The exemption does not apply to the initial visa or the extension, so a SELT is still required at those earlier stages regardless of nationality.

You Cannot Switch from a Visitor Visa

This trips people up all the time. If you enter the UK as a Standard Visitor, you generally cannot switch to a Spouse Visa from inside the country. You have to leave and apply from abroad.1GOV.UK. Family Visas: Apply, Extend or Switch – Overview The narrow exceptions are holders of a six-month fiancé or fiancée visa and people with permission to stay for the outcome of a family court case or divorce. Choosing the right entry route from the start saves a wasted flight and months of delay.

What You Pay and How Long It Takes

The application fee is £1,938 per person from outside the UK and £1,321 per person from inside. On top, the Immigration Health Surcharge (IHS) is £1,035 per year of visa granted. For a 33-month visa from abroad that comes to £3,105; for a 30-month grant from inside the UK it’s £2,587.50. The IHS gives you NHS access on the same footing as a permanent resident.1GOV.UK. Family Visas: Apply, Extend or Switch – Overview

Standard decisions take roughly eight to twelve weeks. Two paid upgrades are available: priority service (£500) for a decision within 30 working days on applications from outside the UK, and super priority service (£1,000) for a decision by the end of the next working day.8GOV.UK. What the Visa Lets You Do

You can work in any job, pay UK tax, use the NHS, and study. What you cannot do is claim most means-tested public benefits: the visa carries a No Recourse to Public Funds (NRPF) condition. The restricted list includes Universal Credit, Housing Benefit, Personal Independence Payment, Carer’s Allowance, and social housing allocation, among others.9GOV.UK. Public Funds (Accessible)

If you become destitute or your child’s welfare is at stake, you can apply through a change-of-conditions application to have NRPF lifted. And if your British partner claims benefits in their own right, being included in their claim for assessment purposes does not breach your NRPF condition.9GOV.UK. Public Funds (Accessible)

Visa Length, Extension, and Settlement

Apply from outside the UK and you get 33 months. Apply from inside the UK and you get 30 months.1GOV.UK. Family Visas: Apply, Extend or Switch – Overview Either way you extend once, because the full route to settlement is five years.

At the extension you show the relationship is continuing, your household income still meets the threshold that applies to you, and your English has reached A2.6GOV.UK. Family Visas: Apply, Extend or Switch – Knowledge of English The extension fee is £1,321 per person, plus IHS again for the new period.1GOV.UK. Family Visas: Apply, Extend or Switch – Overview File before your current visa expires so your status stays lawful while the Home Office decides.

After five continuous years on the route you can apply for Indefinite Leave to Remain (ILR). ILR removes the time limit on your stay and lifts NRPF. Two extra requirements apply at this stage: English at B1 (with the exemption above for nationals of majority-English-speaking countries), and the Life in the UK test, a 45-minute multiple-choice paper on British history, values, and institutions with 24 questions and unlimited retakes.10GOV.UK. Knowledge of Language and Life in the UK Guidance

There is no fixed cap on days spent outside the UK during the five years, but the Home Office expects the UK to be your main home throughout. Long or repeated absences can cause problems at the ILR stage, so short and well-documented trips are the safer approach.

Bringing Children

Children under 18 can be added as dependents if they are not living independently.11GOV.UK. Appendix Children Guidance Each child costs £1,938 from outside the UK or £1,321 from inside, plus their own IHS.1GOV.UK. Family Visas: Apply, Extend or Switch – Overview

After Settlement: British Citizenship

ILR is not the last step if you want a passport. You can apply for naturalisation once you have lived in the UK for at least twelve months after receiving ILR. Your absences during the five years before the citizenship application must total no more than 450 days, and no more than 90 days in the final twelve months.12GOV.UK. Apply for Citizenship if You Have Indefinite Leave to Remain or Settled Status You’ll need the Life in the UK test (a previous pass counts) and to meet the English requirement. Citizenship brings full voting rights, a British passport, and the ability to pass citizenship to your children.

If Your Application Is Refused

A refusal is not necessarily the end. If you applied from inside the UK, you have 14 days to request an administrative review, which costs £80 and looks for caseworker error.13GOV.UK. Ask for a Visa Administrative Review: If Youre in the UK Submitting another immigration application, or asking for your passport back to travel, cancels the review.

If administrative review is not open to you, your decision letter will say whether you can appeal. Reapplying is often the practical route, because a large share of refusals come down to insufficient financial evidence or documentation gaps rather than any fundamental problem with the relationship. A stronger resubmission frequently succeeds where the first attempt did not.
