Nothing in federal law stops you from resigning after your loan funds, so if you can quit your job after closing on a house and the decision was genuinely made after the ink dried, you have not committed mortgage fraud. The risk sits in two places: whether you had already decided to leave while you were still signing paperwork, and whether you can actually afford the mortgage once the paychecks stop. Both are worth taking seriously before you hand in notice.
When Quitting Crosses Into Mortgage Fraud
The statute people worry about is 18 U.S.C. ยง 1014, which makes it a crime to knowingly make a false statement to influence a federally connected lender. The penalty reaches fines up to $1,000,000 and up to 30 years in prison.1Office of the Law Revision Counsel. 18 USC 1014 – Loan and Credit Applications Generally The word carrying the weight is “knowingly.” A statement that was true when you made it does not become a lie because your life changed later.
If you resign a few weeks after closing because an opportunity appeared, your workplace deteriorated, or you simply changed your mind, your employment certification was accurate at the time you signed. Prosecutors would need evidence pointing to pre-closing intent: an accepted offer letter dated before closing, emails planning the resignation around the funding date, a lease signed in another city. A resignation months out is nearly impossible to tie back to pre-closing fraud. One that happens within days draws attention, but timing by itself is not proof.
The genuinely dangerous version is the borrower who has already decided to leave, has a plan in motion, and stays silent through the verification process. That silence, when you have a duty to disclose, is where criminal exposure begins.
What Your Lender Checks, Before and After You Get the Keys
The Verbal Employment Verification
Fannie Mae requires a verbal verification of employment within 10 business days of the note date.2Fannie Mae. Verbal Verification of Employment The lender calls your employer or uses an automated service to confirm you are still on payroll at the income you reported. If that call shows you have already given notice, closing stops.
You also sign the Uniform Residential Loan Application, Fannie Mae Form 1003, which certifies that everything you provided is “true, accurate, and complete as of the date I signed this application” and requires you to update the application if anything changes before closing.3Fannie Mae. Uniform Residential Loan Application4Fannie Mae Selling Guide. B1-1-01, Contents of the Application Package That continuing duty to disclose is the mechanism that creates legal exposure. If you have decided to quit and say nothing through closing, you have arguably made a false certification. Federal law treats a certification signed “under penalty of perjury” as the equivalent of a sworn affidavit even without a notary.5United States Department of Justice Archives. 1760 Perjury Cases – 28 USC 1746 – Unsworn Declarations Under Penalty of Perjury
The 90-Day Audit Window
Lenders keep looking after closing. Fannie Mae requires that the entire post-closing quality control review cycle be completed within 90 days from the month of closing, with loans selected for review at least monthly.6Fannie Mae. Lender Post-Closing Quality Control Review Process These reviews can include reverifying your employment. If an auditor calls your employer during this window and finds you no longer work there, that triggers questions about when you left and whether the decision predated closing.
Beyond 90 days, routine quality control audits become unlikely, though a lender can still investigate if other red flags surface.
What a Lender Can Do If It Suspects Fraud
Standard Fannie Mae and Freddie Mac uniform mortgage instruments contain an acceleration clause. If the lender concludes the loan was obtained through misrepresentation, it can demand the full outstanding balance at once, typically after 30 days’ written notice. That right exists even if you have never missed a payment, because it is triggered by the alleged fraud rather than by default.
Almost no one can pay a mortgage balance in full on short notice, so acceleration leads to foreclosure. Timelines vary significantly by state. Many states give borrowers a right to cure, meaning you can stop the acceleration by correcting the default and covering the lender’s costs if you act before the clause is formally invoked. Finding new work and showing you can keep paying strengthens your position but does not automatically undo the lender’s right, and the legal costs of defending against a foreclosure action pile up regardless of outcome.
If Quitting Means Moving: Occupancy Rules
When you buy as a primary residence, you certify on Form 1003 that you intend to live in the home.3Fannie Mae. Uniform Residential Loan Application Most lenders expect you to occupy it for at least one year. If quitting leads to a job in another state, this matters. Fannie Mae treats a “significant or unrealistic commuting distance” between the property and the borrower’s workplace as a red flag for occupancy fraud, particularly when the type of employment is inconsistent with the commute.7Fannie Mae. Getting It Right – Reverification of Occupancy
Moving out inside that first year without telling your lender, especially if you rent the house out, can prompt an investigation into whether you ever intended to live there. Primary-residence loans carry lower rates than investment-property loans, so this is not a technicality lenders ignore. If a legitimate job change forces a move, disclose it. A documented, unavoidable relocation is treated very differently from quietly listing the place and disappearing.
Switching Jobs Is Not the Same as Quitting
Lenders care about income continuity, not employer loyalty. Moving to a comparable or higher-paying role, especially in the same industry, carries a completely different risk profile from walking away with nothing lined up. A lateral move with no income gap will not raise audit concerns, because what the lender actually cares about, your ability to repay, has not changed.
If a new position is already arranged, Freddie Mac allows income from future employment to count as qualifying income when you have a fully executed, non-contingent offer letter with the start date and salary on non-fluctuating terms, and the start date falls within 90 days of the note date under its more flexible option.8Freddie Mac. Income Commencing After the Note Date A pre-closing check that the offer terms have not changed is also required. The practical upshot: having another job lined up removes nearly all the risk of leaving the one you have.
The Financial Squeeze That Catches Most People
Legal risk aside, this is where quitting after closing actually hurts. Walking away from your income locks several doors at once.
Refinancing Goes Away
Lenders verify income through tax transcripts requested with IRS Form 4506-C before approving a refinance.9Internal Revenue Service. Form 4506-C IVES Request for Transcript of Tax Return Without a paycheck, you cannot meet the debt-to-income ratio needed to qualify for a lower rate or tap your equity. If rates drop after you buy, you watch the savings pass by.
Going Self-Employed Costs You Two Years
If you quit a W-2 job to freelance or start a business, Fannie Mae generally requires a two-year history of self-employment earnings before that income counts toward qualifying for a mortgage.10Fannie Mae. Underwriting Factors and Documentation for a Self-Employed Borrower Even if your new venture earns more than your old salary, you are locked out of refinancing for at least two full tax years.
Loan Modifications Also Need Income
If you fall behind and need help, programs like Fannie Mae’s Flex Modification require a trial period where you demonstrate the ability to make reduced payments based on verified current earnings. No verifiable income, no modification. The people most likely to need one, borrowers who quit without a plan, are the same ones who cannot qualify.
Nothing in the Loan Process Forced You to Save
Fannie Mae has no minimum reserve requirement for a one-unit principal residence purchase, which means the loan process itself did not require you to have months of payments saved.11Fannie Mae. Minimum Reserve Requirements Investment properties, for comparison, require six months of reserves. If you are seriously considering resigning after closing, building at least six months of total housing costs, mortgage, taxes, insurance, and maintenance, is the floor that makes the math work.
Unemployment Benefits Will Not Save You
Quitting voluntarily generally disqualifies you from unemployment insurance. Every state requires that you lose work through no fault of your own, and the burden is on you to prove good cause for leaving. States define good cause narrowly: unsafe working conditions, harassment, or a significant and unilateral change in your employment terms may qualify. Wanting a fresh start after buying a house does not.
Without benefits as a bridge, you are relying entirely on savings for the mortgage, property taxes, insurance, and the maintenance costs that always appear in a new home. A layoff, by contrast, would typically make you eligible. If your employer might be open to a negotiated separation rather than a resignation, that is worth exploring before you write the letter.
