If your Kia was stolen because it lacked an engine immobilizer, suing Kia for your stolen car directly is no longer an option for most owners. A nationwide class action swept up those claims, and unless you formally opted out by May 3, 2024, you gave up your right to file your own lawsuit over the defect.1Kia Vehicle Theft Settlement. Kia Theft Settlement Compensation is still available though, and which door you use depends almost entirely on the date of your theft.
Which Path Applies to Your Theft
Two settlements govern this defect, and they cover different time periods.
If your car was stolen or damaged before April 29, 2025, the national class action was your route. Its claim deadline was April 28, 2025, and no new claims are being accepted. If you filed in time and your claim was approved, payments began going out after the Ninth Circuit rejected the last appeals on January 8, 2026.
If your car was stolen or damaged on or after April 29, 2025, the multistate attorney general settlement is the one to file under. The deadline is March 31, 2027.2Hyundai/Kia Multistate Immobilizer Settlement. Submit Claim – Hyundai/Kia Multistate Immobilizer Settlement
If you opted out of the class action by the May 3, 2024 deadline, you kept your right to sue Kia individually. Everyone else is limited to whatever a settlement claim can pay.
Is Your Kia One of the Affected Vehicles
The litigation covers 2011–2022 Kia vehicles with a traditional steel “insert-and-turn” key ignition and no engine immobilizer.3United States Judicial Panel on Multidistrict Litigation. In Re Kia Hyundai Vehicle Theft Marketing, Sales Practices, and Products Liability Litigation MDL No. 3052 Transfer Order If your Kia uses push-button start or came with a smart key fob, it already has an immobilizer and is not part of this litigation. Affected models generally include the Forte, Optima, Rio, Sedona, Soul, Sorento, and Sportage across various years in that range.

Filing a Claim Under the Multistate Settlement
Thirty-five state attorneys general and the District of Columbia reached a $9 million settlement with Kia and Hyundai over the same defect. Half of that fund, roughly $4.5 million, is reserved for consumers whose vehicles were damaged by thieves on or after April 29, 2025, before owners had the chance to get free protective hardware installed. The other half goes to the participating states.
Claims are filed at hkmultistateimmobilizersettlement.com by March 31, 2027. As with any theft claim, be prepared to document what happened: a police report, repair invoices, insurance correspondence showing deductibles or premium increases, and receipts for any out-of-pocket expenses.
The settlement also requires Kia to install free zinc sleeves that block thieves from reaching the ignition cylinder, provide window decals showing the hardware is in place, put immobilizers in all future vehicles, and publicize anti-theft measures for five years.
What the Class Action Paid
The class action, consolidated as MDL No. 3052 in the Central District of California, produced a common fund of $80 million to $145 million for direct payments, with a total settlement value reported above $200 million once non-cash remedies were included.1Kia Vehicle Theft Settlement. Kia Theft Settlement Final approval came on October 1, 2024. After the Ninth Circuit affirmed on January 8, 2026, the case returned to the district court and payments began.
The compensation tiers are useful context if you filed and are waiting on a determination:
- Total loss from theft: reimbursement of up to 60% of the vehicle’s Black Book value, plus licensing fees, sales tax, and registration costs.
- Damage from a theft or attempted theft without total loss: the greater of $3,375 or 33% of Black Book value per incident, covering repairs and stolen personal property.
- Insurance deductibles paid on theft claims.
- Insurance premium increases tied directly to the theft.
- Rental cars, ride-sharing, and towing costs while the vehicle was unavailable.
- Anti-theft devices bought in response to the vulnerability, even if the vehicle was never stolen.
Every category required documentation. Claims lacking it were denied, though claimants had a chance to cure deficiencies before a final determination.
Suing Kia on Your Own
An individual lawsuit is only on the table if you opted out of the class by May 3, 2024. Owners who did preserved the right to bring their own case against Kia over the same defect.
Going it alone gives you more control and, potentially, a larger recovery tailored to your specific losses. It also means bearing the full weight of litigation. Most attorneys in these cases work on contingency, so the fees come out of any recovery rather than up front. For a straightforward theft with modest losses, the class settlement was almost certainly the better deal. Individual suits make more sense when the damages are large or unusual enough that the settlement caps would leave real money behind.
If you missed both the class action claim deadline and the opt-out deadline, and your theft happened before April 29, 2025, your options are limited to whatever determination you already received through the class action. Consulting an attorney is still worthwhile if you believe a claim was wrongly denied or if your circumstances are unusual.
Free Fixes You Can Get Regardless
Independent of the settlements, Kia offers a free software update that keeps affected vehicles from starting unless the correct key is in the ignition.4National Highway Traffic Safety Administration. Hyundai and Kia Provide Anti-Theft Software Update Installation is done at an authorized dealership and takes under an hour.
Some state attorneys general alleged that the software update could be bypassed, and thefts continued to be reported after installation. The multistate settlement therefore added free zinc sleeves, a physical reinforcement of the ignition cylinder, along with a window decal warning would-be thieves the vehicle has been hardened. Vehicles that cannot accept either fix qualify for a free steering wheel lock.
These programs are open to every owner of an affected vehicle, whether or not you filed a claim in either settlement. Contact Kia at 800-333-4542 or visit a dealership if you have not had the work done.
Watch Out for Insurance Subrogation
If your insurer paid your theft claim before the settlement did, it may have a right to some of what you recover. Most auto policies include subrogation clauses that let the insurance company recoup what it paid when someone else is responsible for the loss, and Kia’s defect arguably puts the manufacturer in that role.
Many states also recognize the “made-whole doctrine,” which prevents the insurer from recovering until you have been fully compensated for your total loss. If your out-of-pocket damages exceeded what insurance covered, you may be entitled to keep the settlement funds. Check your policy language, and consult an attorney before turning anything over if your insurer contacts you about the settlement. Because the class action processed claims based on losses not already covered by insurance, most claimants who only sought deductibles and uncovered expenses will not face a subrogation problem.
Taxes on Any Payment You Receive
Settlement payments for property damage generally do not create a tax bill as long as what you receive does not exceed what you paid for the car. The payment reduces your basis in the property rather than counting as income. You would owe taxes only if total compensation from all sources, including insurance, exceeded what you paid for the vehicle, in which case the excess would be a capital gain.5Internal Revenue Service. The federal income exclusion for lawsuit damages is narrower than most people assume. It applies only to damages received on account of personal physical injuries or physical sickness, which does not cover property damage from a stolen car.6Office of the Law Revision Counsel. 26 U.S. Code 104 – Compensation for Injuries or Sickness If you already claimed a casualty loss deduction on a prior return for the same theft, you may have to report the settlement reimbursement as income to the extent it offset your taxes in the earlier year.
