No, Indians cannot hold dual citizenship. Under Article 9 of the Indian Constitution, the moment a citizen of India voluntarily acquires the citizenship of another country, Indian citizenship ends automatically. There is no application, no grace period, and no exception. What India does offer people of Indian origin who have taken foreign nationality is Overseas Citizenship of India (OCI), which despite its name is not citizenship at all but a lifelong visa and residency-like status.
The Rule Is Automatic and Absolute
Article 9 is blunt: no person who has voluntarily acquired citizenship of a foreign country can be a citizen of India. The Citizenship Act of 1955 reinforces this by requiring anyone who obtains foreign nationality to surrender their Indian passport.1Embassy of India, Washington D C, USA. Surrender of Indian Passport and Renunciation of Indian Citizenship Traveling on or holding an Indian passport after becoming a citizen of another country is a criminal offense under the Passports Act of 1967.
The practical effect: on the day you take the oath of citizenship in the United States, Canada, the United Kingdom, Australia, or anywhere else, you stop being an Indian citizen. Nothing you sign in India before that trip changes it, and nothing you sign after it undoes it.
If You’ve Already Naturalized: Surrender the Passport
Surrendering your Indian passport isn’t optional and isn’t something to postpone. Continuing to use it after acquiring foreign citizenship is a criminal offense, and any future OCI application will require proof that you’ve completed the surrender.
The process starts on the Passport Seva Online Portal. You register, log in, select “Apply for Surrender Certificate,” complete the details, and submit the printed application along with your Indian passport and proof of foreign nationality to a Passport Office or a VFS Global center.2Ministry of External Affairs, Government of India. Apply for Surrender Certificate For applicants in the United States, the fee is $25 plus a $3 Indian Community Welfare Fund charge, on top of VFS Global’s service fee.1Embassy of India, Washington D C, USA. Once processed, your Indian passport is cancelled and you receive a Surrender Certificate. Keep it permanently. You’ll need it for OCI, and Indian authorities may ask for it years later in various administrative situations.
OCI: The Closest Thing to Dual Citizenship India Offers
OCI is a registered status that grants a lifelong, multiple-entry visa to India along with certain economic privileges. It looks and feels like permanent residency in a country where you happen to have deep roots. It is not a passport, and it does not restore citizenship.
Who Qualifies
OCI registration is open to foreign nationals in a few defined categories:
- Former Indian citizens, or anyone who was eligible for Indian citizenship on January 26, 1950, along with their children and grandchildren.
- People who belonged to a territory that became part of India after August 15, 1947, and their children and grandchildren.
- The foreign spouse of an Indian citizen or an existing OCI cardholder, if the marriage is registered and has lasted at least two continuous years.
- A minor child born abroad with at least one Indian citizen parent.
One absolute bar runs through every category: anyone who is or has ever been a citizen of Pakistan or Bangladesh, or whose parent or grandparent held that citizenship, cannot register.3Ministry of External Affairs. Overseas Citizenship of India Scheme The government can add other countries to that exclusion list by notification.
What OCI Lets You Do
The core benefit is the lifelong visa. You never apply for a tourist or business visa to India again, and there is no cap on how long you can stay per visit. OCI cardholders are also exempt from registering with the Foreigners Regional Registration Officer, which regular foreign nationals must do for extended stays.4Consulate General of India, San Francisco. General Information on OCI Card
Financially, OCI holders get the same treatment as Non-Resident Indians. You can open Indian bank accounts, invest in stocks and mutual funds, and buy residential or commercial property. Agricultural land, farmhouses, and plantation property are off-limits under India’s foreign exchange rules, the same restriction that applies to NRIs.4Consulate General of India, San Francisco. General Information on OCI Card
For education, OCI holders can sit for national entrance exams such as NEET and JEE, but seats reserved for Indian citizens remain closed; access is limited to NRI-quota or supernumerary seats.
What OCI Does Not Let You Do
The gap between OCI and citizenship shows up in specific places. You cannot vote in any Indian election. You cannot hold constitutional office, whether that’s President, Vice President, Supreme Court judge, or a seat in Parliament or a state legislature. Government employment is closed. And you cannot hold an Indian passport, because those are issued only to citizens.5Ministry of Home Affairs. FAQ – OCI
Certain activities also require separate permission from the Indian government even with OCI status: research work in India, missionary or religious outreach, mountaineering, journalism, and internships or employment with a foreign embassy or international organization based in India. Protected and restricted areas require the same advance clearance any foreign national would need.6High Commission of India, Kampala. Permission Activity – OCI
Children Born Abroad to Indian Parents
A child born outside India on or after December 3, 2004, is an Indian citizen by descent if at least one parent held Indian citizenship at the time of birth. The birth must be registered with the nearest Indian embassy or consulate within one year. Miss that window and registration requires approval from India’s central government, which is not guaranteed.7Embassy of India, Asmara. Online Registration of Children for Indian Citizenship
There is a catch that trips up many families. Registering a child as an Indian citizen requires a declaration that the child does not hold a passport from any other country. For a child born in the United States, who becomes a U.S. citizen automatically at birth, that creates a direct conflict. You cannot register the child as an Indian citizen and also obtain a U.S. passport for them. Many Indian parents in the U.S. resolve this by choosing OCI for the child, which lets them travel freely to India for life while keeping U.S. citizenship.5Ministry of Home Affairs. FAQ – OCI
The Narrow Path Back to Indian Citizenship
One route exists for resuming Indian citizenship, and it applies only in a specific situation. Under Section 8(2) of the Citizenship Act, if your parent renounced Indian citizenship and you lost yours as a minor as a result, you can file a declaration to resume Indian citizenship. The deadline is strict: within one year of turning 18. There is no extension and no waiver.8High Commission of India, Kampala. Resumption of Indian Citizenship
The application runs through the Indian Citizenship Online Portal and requires your passport, your parent’s renunciation certificate, and supporting identity documents.9Government of India, Ministry of Home Affairs. Resumption of Indian Citizenship If you succeed, the same prohibition still applies going forward: you would need to give up your foreign citizenship, since India does not permit dual nationality. That’s why most people who could qualify end up choosing OCI instead.
