Can Mexicans Get Spanish Citizenship? 2-Year Track and Dual Passport

Mexican citizens can obtain Spanish citizenship after just two years of legal residency in Spain, rather than the ten years required of most other nationalities. Spain grants this shortened timeline to nationals of Ibero-American countries, and Mexico qualifies. Mexicans also keep their original nationality when they naturalize, so Spanish citizenship for Mexicans does not force a choice between the two passports.

The Two-Year Residency Track

The main route is naturalization by residency. Spain’s general rule is ten years, but for nationals of Latin American countries, Andorra, the Philippines, Equatorial Guinea, and Portugal, the requirement drops to two.1Punto de Acceso General. Acquiring Nationality – Residence – Citizens It is the same citizenship-by-residency process everyone uses, with a shorter clock.

Those two years must be spent on a proper residency permit, and the residency must be continuous. Absences from Spain generally cannot exceed three consecutive months. Short trips home are fine; spending an entire summer in Mexico can jeopardize the application, and extended absences can reset the clock entirely.

Student Visa Time Does Not Count

Time spent in Spain on a student visa does not count toward the two-year residency requirement. A student visa grants permission to stay but does not confer legal residency status for nationality purposes.2Ministry of Foreign Affairs, European Union and Cooperation. Long-Stay Visas for Studying in Spain Required Documentation If you studied in Barcelona for four years and then switched to a work permit, your two-year clock starts the day you received the work residency permit, not the day you first arrived as a student.

Faster and Alternative Routes

Residency is the most traveled path, but some situations qualify for a shorter timeline or a different route entirely.

Marriage to a Spanish Citizen

Marrying a Spanish citizen doesn’t grant automatic nationality, but it cuts the residency requirement to one year. You must be legally resident in Spain during that year and maintain genuine cohabitation with your Spanish spouse. A marriage certificate on its own is not enough; you have to demonstrate actual coexistence.

Descendants of Spanish Nationals

People born outside Spain to a parent or grandparent who was originally Spanish qualify for a one-year residency track.1Punto de Acceso General. Acquiring Nationality – Residence – Citizens Given the deep historical migration from Spain to Mexico, many Mexican families have Spanish ancestry that opens this door. The obstacle is usually documentation: proving the ancestor’s original Spanish nationality often means tracking down birth records or consular registrations from decades ago.

Citizenship by Origin or Option

If your mother or father is a Spanish citizen, you may already be Spanish by origin regardless of where you were born. Citizenship by option covers a related group: people who are or were under the parental authority of a Spanish national, or who were adopted by Spanish citizens, can opt into Spanish nationality.1Punto de Acceso General. Acquiring Nationality – Residence – Citizens These paths depend on family ties rather than years spent living in Spain.

The Democratic Memory Law Window Has Closed

Spain’s Democratic Memory Law offered a special pathway for descendants of Spaniards who lost or renounced their nationality due to political exile, ideological persecution, or certain gender-based discrimination under earlier legal regimes. The application window closed on October 22, 2025, and no extensions have been announced.3Ministry of Foreign Affairs, European Union and Cooperation. Urgent Notice Regarding Spanish Nationality: Democratic Memory Law Applications filed or with appointments secured before that date are still being processed, and some resolutions may not arrive until 2028 or later. If you missed the window, the residency-based paths above remain available.

You Keep Your Mexican Passport

Most foreign nationals gaining Spanish citizenship must formally renounce their prior nationality. Mexicans do not. Spain exempts nationals of Ibero-American countries from renunciation, so Mexican applicants keep their original nationality when they naturalize.

From the Mexican side, the arrangement is equally favorable. Mexican law has permitted dual nationality since 1998, so acquiring Spanish citizenship does not affect your Mexican nationality.4Secretaría de Relaciones Exteriores | Gobierno. Double Nationality You can hold both passports, own property in both countries, and move between them freely.

Exams and Civic Conduct

Every applicant for citizenship by naturalization must show integration into Spanish society. Spain checks this with a standardized exam and a review of civic conduct.

The CCSE

The CCSE (Constitutional and Sociocultural Knowledge of Spain) is a 25-question exam covering Spanish government, law, history, and daily life. You need at least 15 correct answers to pass.5DELE. CCSE – Constitutional and Sociocultural Aspects of Spain The Instituto Cervantes administers it at testing centers worldwide, and registration costs €85.6Instituto Cervantes. Precio de la Prueba CCSE The Instituto Cervantes publishes a question bank that mirrors the actual test closely.

Mexicans Skip the Language Exam

Spain also requires the DELE A2 Spanish language exam for non-native speakers, but nationals of countries where Spanish is an official language are exempt.7Federación Comunidades Judías España. Instituto Cervantes – Tests Mexican applicants skip it entirely. You still have to sit the CCSE.

Good Civic Conduct

Authorities review your conduct during the residency period. At minimum you need a clean criminal record from both Mexico and Spain. The assessment can extend further: outstanding fines, administrative infractions, and unpaid taxes have been flagged in applications. The legal standard is “good civic conduct,” which gives reviewers discretion. A serious criminal conviction will almost certainly sink an application; minor issues are less predictable and worth resolving before you file.

Documents You Will Need

Incomplete files are one of the most common reasons for delays. For a citizenship-by-residency application, gather:

  • Your current Mexican passport.
  • Your birth certificate from the Mexican Civil Registry, apostilled and translated into Spanish by a sworn translator recognized by the Spanish Ministry of Foreign Affairs.
  • Criminal record certificates from Mexico (apostilled and translated) and Spain.
  • Proof of legal residency: your valid tarjeta de residencia and your empadronamiento showing your registered address.
  • Your CCSE passing certificate from the Instituto Cervantes.
  • Your marriage certificate, if applying through the marriage path, apostilled and translated if issued outside Spain.
  • Proof of payment of the application fee (Tasa 790-026).

Mexican documents need an apostille from the Mexican Foreign Ministry (SRE) before Spain will accept them, and each document must then be translated by a traductor jurado officially registered in Spain. Between apostilles, shipping, and translations, this stage can easily take several weeks.

What It Costs

There is no single fee that covers everything. Costs stack across a few line items:

  • CCSE exam registration: €85, paid to the Instituto Cervantes.6Instituto Cervantes. Precio de la Prueba CCSE
  • Application fee (Tasa 790-026): approximately €104, paid at submission and non-refundable regardless of outcome.
  • Apostille fees, which vary by document and issuing office.
  • Sworn translations, priced by the translator and by document length.

The government fees are modest. Document preparation is where the bill grows.

Filing the Application

Applications go through the Ministry of Justice’s Sede Electrónica.8sede.mjusticia.gob.es. Spanish Citizenship Application To file online you need a digital certificate or Cl@ve credentials, Spain’s electronic identification system for government services.9Cl@ve. Frequently Asked Questions About Registration Set up Cl@ve well before your filing date, since registration requires either an in-person visit or verification through an electronic certificate.

After submission you’ll receive a digital confirmation. Authorities may later contact you to request additional documents or clarification, which is common. Respond quickly to avoid further delays.

Processing Times and Final Steps

Citizenship-by-residency applications generally take between one and two years from submission, though backlogs can push individual cases longer. A favorable resolution isn’t the final step. Within 180 days you have to swear or promise allegiance to the King and the Spanish Constitution, formally renounce any prior nationality that Spain does not recognize for dual citizenship purposes (which does not apply to Mexican nationals), and register the acquisition of nationality in the Spanish Civil Register.1Punto de Acceso General. Acquiring Nationality – Residence – Citizens Missing the 180-day window can void the favorable resolution, so schedule the oath ceremony promptly. Once registered, you can apply for your Spanish passport and DNI and hold full rights as a Spanish and EU citizen.
