Yes, your power of attorney can live in another country. Every U.S. state allows you to appoint an agent who resides abroad, and no state imposes citizenship or residency requirements on the person you choose. The harder question is whether that arrangement will function when you need it to, because banks, hospitals, and county recorders often create obstacles that a foreign-based agent cannot easily overcome from thousands of miles away.
Your Home State’s Law Controls, Not Your Agent’s
A power of attorney is governed by the law of the state where you live, not the country where your agent resides. If the document is drafted, signed, witnessed, and notarized according to your state’s rules, it is a valid grant of authority whether your agent is in Ohio or Osaka.1Justia. Power of Attorney Laws: 50-State Survey
Pay close attention to durability. A durable POA remains in effect if you become incapacitated, which is usually the whole point of having one. Some states presume durability unless the document says otherwise; others require explicit language stating the POA survives your incapacity.1Justia. Power of Attorney Laws: 50-State Survey A document that lacks the right words can collapse at the moment it matters.
Getting the Document Recognized Across Borders
If your agent will present the POA to institutions in another country, standard notarization is not enough. The authentication path depends on whether the destination country belongs to the 1961 Hague Apostille Convention.
Apostille Countries
For member countries, you obtain an Apostille certificate from your state’s secretary of state (or equivalent office). The Apostille verifies the notary’s signature and seal and is accepted in any other member country without further certification.2HCCH. Convention of 5 October 1961 Abolishing the Requirement of Legalisation for Foreign Public Documents Fees generally run from $10 to $26 per document, and the Convention covers well over 100 countries.3HCCH. Non-Apostille Countries
For countries outside the Convention, you face a longer legalization chain: authentication by your state, then the U.S. Department of State’s Office of Authentications, then the destination country’s embassy or consulate.4U.S. Department of State. Authentication Certificate Requirements Some countries also require a certified translation.
Signing a POA From Abroad
If you are the one overseas and need to sign a POA to send home, U.S. embassies and consulates provide notarial services. You must appear in person with valid government-issued ID and sign in front of a consular officer. The fee is $50 per consular seal.5U.S. Department of State. Notarial and Authentication Services at U.S. Embassies and Consulates6eCFR. Title 22, Chapter I, Subchapter C, Part 22 Consulates do not offer remote or virtual notarization.
Where It Usually Breaks: Banks and Brokerages
The most common failure point is not the law. It is the bank counter. Institutions refuse powers of attorney for a range of reasons: the document is old, it lacks durability language, it does not match internal requirements, or the bank wants the agent to appear in person. An agent who cannot walk into a branch has a real problem.
Most states have adopted some version of the Uniform Power of Attorney Act, which gives an institution seven business days to accept a properly acknowledged POA or request supporting documentation, and five more business days after that documentation arrives. Refusal without a valid reason can lead to a court order and attorney’s fees. Valid reasons include a good-faith belief the document is invalid, knowledge that the agent’s authority has ended, or suspicion of exploitation.
Many banks also demand proprietary supplemental forms, notarized affidavits, or additional identity verification before honoring a POA. A foreign-based agent may find these steps hard to complete under time pressure. Before finalizing the document, call every bank and brokerage where you hold accounts and ask what they require from an agent living outside the country.
The Medallion Signature Guarantee Wall
If your agent needs to transfer securities, sell stocks, or change brokerage account registrations, the institution will almost certainly require a medallion signature guarantee. This is not a notarization. Only eligible financial institutions participating in an SEC-approved program can provide it, including banks, brokers, credit unions, and savings associations.7eCFR. 17 CFR 240.17Ad-15 – Signature Guarantees U.S. consulates and foreign notaries cannot issue one.8U.S. Department of State. U.S. Department of State Telegram Concerning Medallion Stamp Guarantees An agent abroad with no relationship to a U.S. financial institution may find it effectively impossible to obtain, which can block securities transactions entirely.
The Day-to-Day Friction
Distance compounds. Time zones are the most persistent issue. If your agent is eight or twelve hours ahead, every call with a bank, doctor’s office, or government agency has to fit inside a narrow overlap of business hours. Urgent matters do not always cooperate.
Language is the next layer. An agent who is not fluent in English will struggle to communicate with financial institutions, negotiate with creditors, or read medical records, and hiring interpreters for every interaction is slow and expensive. International mail adds days or weeks whenever original documents are needed.
Real estate is a specific hazard. Recording a deed or mortgage executed under a POA usually requires filing the original POA with the county recorder. Many counties still require original wet signatures, and some will not accept documents notarized abroad even with an Apostille attached. Selling a home or refinancing a mortgage through a foreign agent can drag out significantly.
Medical Decisions and HIPAA Access
A healthcare power of attorney lets your agent make medical decisions for you when you cannot. Under federal privacy rules, an agent named in a healthcare POA is treated as your personal representative and has the same right to access your medical records as you do, including mental health information.9HHS.gov. Personal Representatives If the POA is limited to specific decisions such as end-of-life care, access is limited to records relevant to those decisions.10HHS.gov. Does Having a Health Care Power of Attorney Allow Access to the Patient’s Medical and Mental Health Records Under HIPAA
Federal privacy law does not disqualify an agent based on location. The practical reality is harder. Medical emergencies rarely wait for international phone calls, and hospital staff making urgent treatment decisions may not have time to verify a foreign agent’s authority. Many healthcare POAs are springing documents that only take effect when a physician certifies incapacity, so your agent may need to coordinate with your doctor from overseas just to activate their role. If medical decision-making matters to you, name a local co-agent or successor who can be at the hospital.
Tax and Reporting Side Effects
Handing financial authority to a foreign agent can trigger federal reporting obligations you did not expect.
Foreign Account Reporting
If you are a U.S. citizen or resident and your foreign-based agent manages financial accounts outside the United States on your behalf, you may need to file a Report of Foreign Bank and Financial Accounts (FBAR) with FinCEN when the combined value of those accounts exceeds $10,000 at any point in the year.11Internal Revenue Service. Report of Foreign Bank and Financial Accounts (FBAR) Reference Guide The obligation attaches to a financial interest in or signature authority over the accounts. The $10,000 threshold is set by Treasury regulation under 31 U.S.C. ยง 5314 and has not been adjusted for inflation.12Office of the Law Revision Counsel. 31 USC 5314 – Records and Reports on Foreign Financial Agency Transactions
Dealing With the IRS
Normally, only attorneys, CPAs, and enrolled agents can represent taxpayers before the IRS. For matters handled outside the United States, any individual can serve as your representative. The representative signs Form 2848 and leaves the licensing jurisdiction blank.13Internal Revenue Service. Instructions for Form 2848
Structures That Actually Work
Given the obstacles, relying entirely on someone overseas is risky. Three arrangements keep your preferred person involved while covering the gaps.
Co-Agents
You can appoint two agents at once, with one local and one abroad. The local agent handles in-person banking, closings, and medical emergencies; the foreign agent participates in financial decisions or long-term planning. You decide whether they must act jointly or can act independently. Independent authority tends to work better across borders, since requiring joint signatures on every transaction defeats the point of having someone local.
Successor Agents
You can name your foreign-based choice as primary agent and a local person as successor. The successor steps in only if the primary is unable to act. Your preferred agent stays in charge, and there is a fallback when distance makes them ineffective.
Professional Fiduciaries
A trust company or licensed professional fiduciary can serve as agent for a fee, typically billed hourly. These firms already have relationships with banks and other institutions, which smooths the acceptance process. For someone whose only trusted person lives overseas, a professional fiduciary acting as co-agent alongside the foreign agent can be the difference between a document that works on paper and one that works in practice.14American Bar Association. Revoking a Cross-Border POA
You can revoke a power of attorney at any time while you are mentally competent. Put the revocation in writing and sign it with the same formalities you used for the original document. The hard part with a foreign agent is delivering notice. Tell your agent directly, and notify every institution holding a copy, including banks, brokers, healthcare providers, and any county recorder where the POA was recorded. Until those third parties receive notice, they may continue to honor the agent’s authority in good faith. International mail adds transit time during which the agent could still act, so send the revocation by email and by international courier to build a clear record.
