Can You Change Your Last Name to Anything After Marriage?

You cannot change your last name to anything you want after marriage using the marriage certificate alone. Most states let you pick from a short menu of surname options on the marriage license application — taking your spouse’s name, hyphenating, or shifting your birth surname into the middle slot — and the certificate works as legal proof for those changes. A surname with no connection to either spouse falls outside that menu and requires a court petition, the same one anyone uses to change a name without getting married.

What the Marriage Certificate Alone Will Do

When you apply for a marriage license, the application asks what name each spouse will use after the wedding. The options vary slightly by state, but most jurisdictions allow the following without any court involvement:

  • Taking your spouse’s last name.
  • Hyphenating your surname with your spouse’s (for example, Garcia-Thompson).
  • Moving your birth surname into the middle name position and taking your spouse’s surname.
  • Keeping your current name. Marriage does not automatically change your legal name.

Once the marriage is recorded, the certified marriage certificate is the legal document you present to update government records. Order several certified copies from the vital records office in the county where you married, because most agencies will not accept a photocopy.

When You Need a Court Petition Instead

If you want an entirely new surname — one invented by the two of you, borrowed from a different family line, or otherwise unrelated to either spouse — the marriage certificate alone will not carry it in most states. You file a formal name change petition in your local court, pay a filing fee that typically runs from $65 to $450 depending on jurisdiction, and in some places publish a notice in a local newspaper. A judge reviews the petition to confirm it is not motivated by fraud and does not infringe on anyone else’s rights. The process usually takes a few weeks to a few months.

A handful of states let both spouses include a broader name change request directly on the marriage license application regardless of what name they choose, but that is the exception.

Names That Will Not Be Approved

Some names get rejected no matter which route you take. Courts turn down name changes that look designed to dodge debts, evade law enforcement, or commit fraud. Marrying for the purpose of evading immigration law is separately a federal crime, with penalties of up to five years in prison and a $250,000 fine.1Office of the Law Revision Counsel. 8 USC 1325 – Improper Entry by Alien

Government record systems also impose practical limits. Names made up entirely of numbers or symbols are rejected because vital records databases cannot process them. The Social Security Administration shows up to 26 characters for the last name on the card itself, and its internal system caps the last name field at 21 characters. Longer surnames get truncated.2Social Security Administration. Making the New Name Official

The name on your marriage certificate has no practical effect until you update it with the agencies that matter. Order matters here.

Start with Social Security

Update Social Security first, because almost every other agency wants your SSN record to match your new name. Depending on your situation, you may be able to request the change online through the SSA’s website; otherwise, you’ll schedule an appointment at a local office.3Social Security Administration. Driver’s License

Once Social Security has processed the change, visit your state DMV in person with your current license, certified marriage certificate, and updated Social Security card or proof the update is in progress. Fees vary by state, and some states waive them if your license is close to renewal.

Passport

The form and fee depend on how long ago your current passport was issued and how long ago the name changed. Recent changes within a year of issuance can be handled by mail at no cost on Form DS-5504; older passports go through renewal on Form DS-82 or an in-person application on DS-11.6U.S. Department of State. Watch Out for the Tax Mismatch

This is the one that catches people. The name on your tax return has to match what the SSA has on file for your Social Security number. If it doesn’t, the IRS flags the mismatch and your return — and any refund — gets held up.8Internal Revenue Service. Name Changes and Social Security Number Matching Issues

If you married mid-year and have not updated SSA before filing, use your former name on the return. You can still file jointly under your old name. If your employer issues a W-2 under your new married name before SSA has processed the change, ask for a corrected W-2 that matches your Social Security card.8Internal Revenue Service. Other Records to Update

Marriage does not automatically update property deeds. If you own real estate, you’ll generally prepare a quitclaim deed transferring the property into your new name (or into both spouses jointly), have it notarized, and record it with the county recorder’s office. Recording fees typically run from $10 to $100. Contact your mortgage lender before recording anything, since lenders have their own requirements.

You’re required to update your voter registration after a legal name change. Most states let you do this online, by mail, or in person at your local election office through vote.gov. Some treat it as a simple update; others require full re-registration.9USAGov. How to Update or Change Your Voter Registration

Banks and credit card companies will want your certified marriage certificate and a photo ID in the new name. Your employer’s HR department needs the updated Social Security card to fix payroll and withholding. Professional license holders — nurses, lawyers, accountants, real estate agents — should contact their state licensing board. Boards usually charge $25 to $100 and ask for proof of the legal name change; some waive the fee during a regular renewal cycle.

Green Card Holders

Lawful permanent residents need to replace their green card after a marriage name change. File Form I-90 with USCIS and submit a registered copy of your marriage certificate as evidence. A photocopy will not be accepted — the document has to have been registered with the proper civil authority.10U.S. Citizenship and Immigration Services. If you’re currently applying for a green card through marriage, you can put your new married name on the application itself by attaching a copy of the marriage certificate.
