Can You Drive a Commercial Vehicle With a Defibrillator?

You cannot drive a commercial vehicle with an implanted defibrillator in interstate commerce. Federal Motor Carrier Safety Administration (FMCSA) rules disqualify any driver with an implantable cardioverter-defibrillator (ICD), and the agency has never granted an exemption from that rule. Depending on your state and the size of vehicle you want to drive, intrastate work or lighter vehicles below federal thresholds may still be open to you.

Why an ICD Is Disqualifying

Federal physical qualification standards require that a commercial driver have no current diagnosis of a cardiovascular condition known to cause fainting, sudden collapse, or heart failure.1eCFR. 49 CFR 391.41 – Physical Qualifications for Drivers An ICD is never implanted in a healthy heart. It is placed because the person has a condition that puts them at high risk of dangerous rhythms, and that condition on its own can cause syncope or gradual incapacitation at the wheel.

The device adds a second layer of risk. When the ICD detects a dangerous rhythm and fires, the shock can be forceful enough to momentarily incapacitate the driver. FMCSA’s Medical Advisory Criteria say this directly: ICDs are installed for an ongoing cardiovascular condition and are likely to cause syncope both from the underlying disease and when the device discharges.2Cornell Law School. 49 CFR Appendix A to Part 391 – Medical Advisory Criteria For someone controlling a loaded tractor-trailer, even a brief loss of vehicle control is catastrophic.

A Pacemaker Is Not the Same Thing

If your cardiologist is discussing a pacemaker rather than a defibrillator, the answer changes. FMCSA’s Medical Advisory Criteria classify pacemaker implantation as a remedial procedure that does not preclude medical certification.2Cornell Law School. 49 CFR Appendix A to Part 391 – Medical Advisory Criteria A pacemaker sends small, steady pulses to maintain rhythm; an ICD delivers a strong shock to interrupt a life-threatening one. FMCSA’s cardiovascular guidelines require at least a one-month waiting period after pacemaker implantation, with documented correct function confirmed by a pacemaker center, and up to three months for certain underlying conditions.3Federal Motor Carrier Safety Administration. Can You Get an FMCSA Exemption for an ICD?

FMCSA runs an exemption program for drivers with certain medical conditions. To receive one, you must demonstrate that granting the exemption would achieve a level of safety equal to or greater than the level maintained without it.4eCFR. 49 CFR Part 381 – Waivers, Exemptions, and Pilot Programs For ICD applicants, that showing has never been made.

In a November 2023 Federal Register notice, FMCSA denied ICD exemption applications and stated that the available medical and scientific literature provides insufficient data to conclude that granting one would maintain equivalent safety.5Federal Register. Qualification of Drivers Exemption Applications – Implantable Cardioverter Defibrillator (ICD) The most recent denial, published in May 2025, used virtually identical language in rejecting two more applications.6Regulations.gov. Exemption Application – Qualification of Drivers You can still apply, but every published ICD decision to date has ended in denial, and no amount of favorable documentation from a cardiologist has moved the agency off that position.

Intrastate Driving May Still Be Possible

Federal physical qualification standards apply to interstate commerce. If your commercial driving stays entirely within one state, federal rules don’t automatically decide your eligibility. Each state sets its own medical requirements for intrastate commercial drivers. Some adopt the federal standards wholesale, which means an ICD would disqualify you there as well. Others keep separate, sometimes less restrictive, criteria for drivers who never cross state lines.

Whether intrastate work is realistic depends on your state’s motor vehicle agency and the medical standards it has adopted. FMCSA itself notes that drivers with physical impairments affecting their ability to safely operate a commercial vehicle may need a variance from their state to be approved for commercial driving.7Federal Motor Carrier Safety Administration. Medical Contact your state’s commercial driver licensing office directly to ask whether an ICD is disqualifying for intrastate-only driving and whether any state-level waiver process exists.

Vehicles Under 10,001 Pounds

Federal motor carrier safety rules, including the medical certification requirement, apply to commercial motor vehicles with a gross vehicle weight rating or gross combination weight rating of 10,001 pounds or more.8Federal Motor Carrier Safety Administration. GVWR Under 10001 Pounds Towing Trailer – Regulations Guidance Vehicles that transport 16 or more passengers (including the driver) or carry hazardous materials also trigger federal requirements regardless of weight.

Delivery vans, smaller box trucks, and many passenger vehicles used for commercial purposes fall under 10,001 pounds. If you have an ICD and want to keep working in transportation, driving a vehicle below the threshold takes the federal medical disqualification off the table. Your regular driver’s license medical standards and any state-specific commercial requirements would still apply. This is not a workaround for someone set on driving an 18-wheeler, but it does open a range of commercial work that would otherwise be closed.

What to Do If You Get an ICD While Holding a CDL

Getting an ICD implanted while you hold an active CDL creates an immediate problem. You no longer meet the federal physical qualification standards, and continuing to drive interstate is illegal. The FMCSA Medical Examiner’s Handbook states that a driver who has an illness or medical procedure that interferes with driving ability must undergo a new medical examination even if the current certificate has not expired.9Federal Motor Carrier Safety Administration. Medical Examiners Handbook 2024 Edition

  • Stop driving commercially. Once the ICD is implanted, you are not physically qualified under federal standards. Do not wait for your certificate to expire.
  • Notify your employer. Your motor carrier maintains a qualification file for every driver, and the carrier needs to know your medical status has changed.
  • Update your state licensing agency. CDL holders who fail to maintain valid medical certification have their commercial driving privileges downgraded.7Federal Motor Carrier Safety Administration. Medical

Concealing an ICD at your next medical examination carries real consequences. By signing the examination report, you certify that the information is accurate. False or incomplete answers can invalidate the examination and any certificate issued from it. A certified medical examiner who finds the ICD during the exam will not certify you, and the omission itself becomes a mark on your record. The safer path, and the only legal one for interstate driving, is to report the device, look at intrastate options through your state agency, and consider whether a vehicle below the federal weight threshold fits the work you want to do.
