Can You Sue Over a COVID Vaccine? CICP Claims and Deadlines

If a COVID-19 vaccine seriously harmed you, suing over a COVID vaccine injury is almost never an option. A federal law called the PREP Act shields the manufacturers, distributors, pharmacies, and the person who gave you the shot from lawsuits in state or federal court. Instead, Congress routed injury claims into a single federal program, the Countermeasures Injury Compensation Program (CICP), and you generally have one year from the date of vaccination to file.

Why Lawsuits Are Blocked

The Public Readiness and Emergency Preparedness Act gives broad legal immunity to everyone in the COVID-19 vaccine chain, from the drugmaker through the pharmacist who administered your dose. A “covered person” is immune from claims of loss caused by the administration or use of a covered countermeasure whenever the Secretary of Health and Human Services has issued a declaration for that product.1GovInfo. 42 U.S.C. 247d-6d – Targeted Liability Protections for Pandemic and Epidemic Products and Security Countermeasures That declaration has been in force since March 2020 and has been amended twelve times through December 2024. The end of the COVID-19 public health emergency did not end this protection.2ASPR. PREP Act – Public Readiness and Emergency Preparedness Act

The immunity reaches design, development, testing, manufacturing, labeling, distribution, marketing, sale, and administration of the vaccine.3Office of the Law Revision Counsel. 42 U.S. Code 247d-6d – Targeted Liability Protections for Pandemic and Epidemic Products and Security Countermeasures Courts have dismissed ordinary negligence and product-liability suits against vaccine makers and providers on that basis, regardless of how severe the alleged injury was.

The Narrow Willful Misconduct Exception

There is one crack in the wall. The PREP Act allows a lawsuit if you can prove willful misconduct. The statute defines that as conduct meeting all three of these tests at once: an intentional wrongful purpose, no legal or factual justification, and disregard of a known or obvious risk so great that the probability of harm clearly outweighed any benefit.

You must prove all three by clear and convincing evidence, a higher standard than “more likely than not,” and the statute makes clear it is stricter than negligence or even recklessness.4Office of the Law Revision Counsel. 42 USC 247d-6d – Targeted Liability Protections for Pandemic and Epidemic Products and Security Countermeasures Any such case has to be filed in one specific court: the U.S. District Court for the District of Columbia.5ASPR. PREP Act Question and Answers Between the evidentiary bar and the single venue, successful willful misconduct suits over COVID-19 vaccines are essentially nonexistent.

The Countermeasures Injury Compensation Program

Because the courthouse door is closed, CICP is the practical remedy. The Health Resources and Services Administration (HRSA) runs it, and it looks nothing like a lawsuit. No judge, no jury, no hearing. Government medical reviewers read your file and issue a written decision.6Congressional Research Service. Compensation for COVID-19 Vaccine Injuries

What CICP will pay is narrow. Three categories: unreimbursed medical expenses your insurance did not cover, lost employment income, and a death benefit for eligible survivors.7Health Resources & Services Administration. Countermeasures Injury Compensation Program (CICP) There is no compensation for pain and suffering or any other non-economic harm. The program also does not pay your attorney’s fees, so most claimants navigate it without a lawyer.

The injuries that have been found eligible so far include Guillain-BarrĂ© syndrome, myocarditis, myopericarditis, vaccine-induced immune thrombotic thrombocytopenia (VITT), thrombosis with thrombocytopenia syndrome (TTS), and severe febrile reactions.8Health Resources & Services Administration. Table 3 – CICP Claims Pending Compensation Unlike the vaccine court program, CICP has no fixed injury table listing presumptive conditions. Each claim is evaluated individually on whether the medical evidence shows the vaccine directly caused the injury.

This Is Not “Vaccine Court”

People often confuse CICP with the National Vaccine Injury Compensation Program (VICP), the “vaccine court” that handles routine childhood and adult vaccines. COVID-19 vaccines are not in VICP. While the PREP Act declaration is active, CICP is the only route.9Health Resources and Services Administration. Comparison of Countermeasures Injury Compensation Program (CICP) to the National Vaccine Injury Compensation Program (VICP) The differences matter: VICP can award up to $250,000 for pain and suffering and can pay your lawyer if the petition was filed in good faith; CICP awards zero for non-economic harm and pays no attorney fees. VICP decisions are made by Special Masters and can be appealed to federal court; CICP decisions are made by HHS staff and cannot be appealed to any court. VICP gives three years to file an injury claim; CICP gives one.

The Odds, in Numbers

As of March 2026, CICP has received 14,129 claims tied to COVID-19 countermeasures, 10,981 of them for COVID-19 vaccines specifically. Of the total, 6,732 have been denied. Only 95 claims have been found eligible for compensation, and 44 have actually been paid. Total compensation across all CICP claims sits just above $6 million.10Health Resources & Services Administration. The One-Year Filing Deadline

You must file a Request for Benefits within one year of the date you received the vaccine.7Health Resources & Services Administration. Countermeasures Injury Compensation Program (CICP) Miss it and the program will not consider your claim no matter how serious the injury. Survivors filing on behalf of someone who died face the same deadline.

If the clock is running out and you do not yet have every medical record, submit the Request for Benefits Form on its own to lock in your filing date. HRSA will not start reviewing until the full package arrives, but the form alone preserves your eligibility.11Health Resources and Services Administration. What Goes in the Package

A complete Request for Benefits package has several pieces, and HRSA will not begin review until all of them are in.7Health Resources & Services Administration. Countermeasures Injury Compensation Program (CICP)

Proof of vaccination. Your CDC vaccination card, a state immunization registry record, or a record from your provider. The program needs the date and the specific product.

Medical records. This is the spine of the claim. Hospital admission summaries, diagnostic tests, imaging, and physician notes documenting when symptoms began and how they connect in time to your vaccination. The program is looking for a serious physical injury, typically one requiring hospitalization or causing significant disability. Minor or temporary reactions will not clear the threshold. Providers usually charge per-page copying fees, which add up quickly if your treatment history is long.

Financial documentation. For lost income, provide federal tax returns or pay stubs showing your gross employment income at the time of the injury, plus documentation of the specific workdays you missed, such as timesheets. Include your tax return for the year of injury if you had dependents. You must also disclose any disability insurance or workers’ compensation payments you received, because the program offsets third-party payments against your benefits. Medical bills and insurance explanation-of-benefits statements document your unreimbursed out-of-pocket costs.

Survivor claims. If you are filing because someone died as a direct result of a covered countermeasure, CICP can pay certain survivors or the estate.12Health Resources & Services Administration. Frequently Asked Questions A minor or an adult who lacks legal capacity must have a legal or personal representative file on their behalf. Death benefits are calculated by reference to the Public Safety Officers’ Benefits Program amount for the fiscal year of death, with an alternative calculation for surviving dependents under 18 capped at $50,000 per year.13eCFR. 42 CFR Part 110 – Countermeasures Injury Compensation Program

How to Submit

You can submit electronically through the HRSA Injury Compensation Programs website, or mail the package to: Health Resources and Services Administration, Countermeasures Injury Compensation Program, 5600 Fishers Lane, 08N186B, Rockville, Maryland 20857.14Federal Register. Federal Register Vol. 87 No. 121 Email and fax are not accepted.7Health Resources & Services Administration. Countermeasures Injury Compensation Program (CICP) HRSA confirms receipt, checks the package for completeness, has medical staff evaluate the evidence, and issues a written decision. No timeline is published, and given claim volume, expect long waits.

If Your Claim Is Denied

You have 60 calendar days from the determination to request reconsideration in writing. Mail it to the Associate Administrator, Healthcare Systems Bureau, at the same Rockville address.15Health Resources & Services Administration. Countermeasures Injury Compensation Program (CICP) Filing Process The program does not publish specific rules for what new evidence a reconsideration request needs.

Reconsideration is the end of the road. Unlike VICP, CICP offers no judicial appeal at all.9Health Resources and Services Administration. Comparison of Countermeasures Injury Compensation Program (CICP) to the National Vaccine Injury Compensation Program (VICP) If reconsideration also denies your claim, no court will hear the case unless you can meet the willful misconduct standard. Practically, that means treating your first submission as your only real shot: put in the medical records, the financial documentation, and the causation evidence you would want a reviewer to see if you knew you would not get a second look.
