Charges Against Big Brother’s Mike Boogie: Stalking, Fraud, and DUI

The criminal charges against Mike “Boogie” Malin, winner of Big Brother 7: All-Stars, span more than a decade and include a felony stalking conviction involving former castmate Dr. Will Kirby, a misdemeanor DUI in Las Vegas, a January 2025 shoplifting arrest, and a March 2025 arrest for violating the restraining order protecting Kirby. He also lost an $800,000 civil fraud judgment tied to his restaurant business.

Felony Stalking of Dr. Will Kirby

Malin and Kirby had allied on Big Brother 2 and again on the All-Stars season. The friendship ended in 2019 after both were invited to compete together on another reality show and Kirby, a cosmetic dermatologist, declined, which also kept Malin off the show. Malin then began sending threats to Kirby and his family, including photos of a gun pointed at images of Kirby’s wife and children.1Fox News. How California’s Stalking Statute Works

The charge fell under California Penal Code § 646.9, which defines stalking as willfully, maliciously, and repeatedly following or harassing another person while making a credible threat intended to place the target in reasonable fear for their safety or the safety of their immediate family. Prosecutors do not have to prove the defendant actually intended to carry the threat out, only that the threat had the apparent ability to be carried out.4FindLaw. California Penal Code § 646.9

Penalties escalate when the defendant is already subject to a restraining order. A conviction in that situation can carry two, three, or four years in state prison. Courts may also issue a protective order lasting up to 10 years and order counseling as a condition of probation.4FindLaw. California Penal Code § 646.9

Fraud Lawsuit and $800,000 Judgment

In 2012, former business partner David Hilty sued Malin and co-owner Lonnie Moore in Los Angeles Superior Court, accusing them of a “long-running, systematic, and pervasive” scheme of fraud, embezzlement, and mismanagement at their Dolce Group restaurant company. Hilty alleged the two treated the business as a “personal piggybank,” siphoned millions to cover personal expenses, falsified accounting records, and kept an off-the-books ledger tracking diverted funds.5Courthouse News Service.
