Charlie Kirk Shooter Tyler Robinson: Charges, Evidence, Hearing

Tyler Robinson, the 22-year-old accused of fatally shooting conservative activist Charlie Kirk at Utah Valley University on September 10, 2025, faces seven criminal charges in Utah state court, including aggravated murder, and prosecutors are seeking the death penalty. The charges and evidence against Tyler Robinson rest on DNA recovered from the rifle’s trigger, a handwritten note, text messages to his roommate, a confession posted in a Discord group chat, and statements Robinson made to his parents. One notable weakness: a federal ballistics analysis of a bullet fragment from Kirk’s autopsy came back inconclusive. Robinson has not entered a plea, and a preliminary hearing is scheduled for July 6–10, 2026.

The Seven Charges

Utah County Attorney Jeff Gray filed formal charges on September 16, 2025.1NPR. Utah Files Murder Charges Against Tyler Robinson They are:

  • Aggravated murder
  • Felony discharge of a firearm causing serious bodily injury
  • Obstruction of justice (two counts, tied to hiding the rifle and clothing)
  • Witness tampering (two counts)
  • Violence offense committed in the presence of a child

The witness tampering counts stem from allegations that Robinson instructed his roommate, Lance Twiggs, to delete incriminating messages and to avoid speaking with police.2New York Times. The Physical and Forensic Evidence

Investigators say the shot that killed Kirk was fired from the rooftop of the Losee Student Success Center using a Mauser Model 98 bolt-action rifle chambered in .30-06, from roughly 400 feet away. According to the FBI, Robinson arrived on campus at 11:52 a.m., accessed the roof through the building’s stairwells, fired one round, then moved to the opposite side of the building, jumped off, and fled into a nearby residential neighborhood.4FBI. On the rooftop, investigators recovered shoe impressions, a forearm imprint, and a palm print. A rifle and ammunition were found in a wooded area near campus. Three unfired casings on the roof carried inscribed messages, including “Hey, fascist!, Catch!” — phrases investigators later connected to Robinson’s online communications.6PBS NewsHour. DNA consistent with Robinson was recovered from the trigger of the rifle, and also from a towel and associated ammunition found near the scene.7CNN. Tyler Robinson Charlie Kirk Court Appearance

The forensic picture is not uniformly strong for the state. A federal ballistics analysis of a bullet fragment recovered during Kirk’s autopsy came back “inconclusive,” meaning the fragment could not be definitively matched to or excluded from Robinson’s rifle. That report became a source of public controversy and drove one of the most contentious pretrial fights in the case.8Salt Lake Tribune. Utah Judge Punishes Prosecutor

After the ballistics finding became public, Deputy Utah County Attorney Christopher Ballard told several media outlets, including TMZ on March 31, 2026, that the state had “ample evidence” and that he was “confident they would overcome Robinson’s presumption of innocence.” Fourth District Court Judge Tony Graf found the remarks violated a pretrial gag order and held Ballard in civil contempt on June 26, 2026. The defense asked the judge to strike the death penalty as a sanction; Graf refused, calling that request “grossly disproportionate to the misconduct and legally unavailable in this civil contempt framework.” He ordered prosecutors to pay defense attorney fees tied to the contempt proceedings and signaled that jury selection would be expanded, with additional questionnaires, to address potential bias.9The Guardian. Robinson’s Own Words

According to charging documents, Robinson told his roommate he had been planning the attack for “a little over a week.” A handwritten note found under his keyboard read: “I had the opportunity to take out Charlie Kirk and I’m going to take it.”2New York Times. Kirk Shooting Suspect Motive Messages

In text messages to Twiggs after the shooting, Robinson wrote: “I had enough of his hatred. Some hate can’t be negotiated out.” When his parents later asked why he did it, he told them “there is too much evil and the guy spreads too much hate.”11ABC News. Shortly before surrendering, Robinson posted in a Discord group chat: “Hey guys, I have bad news for you all” and “It was me at UVU yesterday. im sorry for all of this.” The FBI investigated “a lot more than 20 people” who had participated in online chats with him, though Discord’s internal review found “no evidence that the suspect planned this incident or promoted violence on Discord.” No co-conspirators have been charged.12KATV. Robinson was identified after his father recognized him in FBI surveillance images and confronted him. According to federal law enforcement sources, Robinson admitted to his father that he was the person in the photos but initially refused to surrender, saying he would rather die by suicide. A family friend contacted the Washington County Sheriff’s Office, and Robinson turned himself in on September 11, 2025.13CBS News. Charlie Kirk Shooting Arrest: Tyler Robinson14NBC News. On the question of motive, authorities have been careful. Investigators noted that Robinson had “become more political in recent years,” and his mother told authorities he had “turned hard left politically in the last year” and become “more pro-gay and trans-rights oriented.” A family member reported that Robinson had discussed Kirk’s upcoming campus appearance at a recent dinner and expressed dislike for the activist. Utah County Attorney Jeff Gray declined to state whether Kirk was targeted specifically for his anti-transgender views, and the charging documents note it is “unclear” whether Robinson’s support for transgender rights directly influenced his actions.15PBS NewsHour. Testimony From Lance Twiggs

Twiggs, Robinson’s roommate and romantic partner, provided a recorded statement under oath to authorities on April 20, 2026, after receiving “use-immunity” from the U.S. and Utah County Attorney’s offices. Under that arrangement, his own statements cannot be used against him. Prosecutors intend to use Twiggs’ recorded testimony and the text exchanges between the two men at the preliminary hearing. The Death Penalty and Robinson’s Plea Status

Prosecutors announced their intent to seek the death penalty when the charges were filed.1NPR. Robinson’s defense is led by Kathryn Nester, a former head of the federal defender offices in Salt Lake City and San Diego, alongside Richard Novak, a Los Angeles-based attorney who holds the federal designation of “learned counsel” for capital cases and has worked on more than two dozen death penalty matters. Nester was appointed lead counsel on September 29, 2025.18Fox News. Charlie Kirk Assassination Suspect’s Expanded Defense Team19Washington Times. What Happens at the Preliminary Hearing

The preliminary hearing, originally set for May and postponed because of the volume of discovery, is scheduled for July 6–10, 2026. It functions as a mini-trial in which prosecutors must establish probable cause on each count for the case to proceed toward a full trial. No trial date has been set.20NewsNation. Judge Graf denied a defense motion on June 1, 2026, to close the hearing to the public, and in April 2026 he rejected a broader defense request to ban cameras from the courtroom, ruling instead that media organizations must request access at least two weeks in advance and that cameras will remain restricted to the back of the courtroom.22Courthouse News.
