China Divorce Law: Process, Property Division, and Custody

Divorce under China divorce law follows the Civil Code that took effect on January 1, 2021, and the process runs on two tracks: an administrative divorce at the Civil Affairs Bureau when both spouses agree, and a judicial divorce through the People’s Court when they don’t.1Ministry of Justice of the People’s Republic of China. China’s Civil Code Takes Effect The Civil Code’s family provisions apply to every marriage registered in China, including marriages where one spouse is a foreign national. Which track you use determines almost everything else: how long the divorce takes, what documents you need, and how disputes over property, money, and children get resolved.

The Administrative Route: Divorce by Mutual Agreement

If both spouses want to end the marriage, they file jointly at the Civil Affairs Bureau where one spouse’s permanent household is registered.2Gov.cn. Divorce Registration in China This is the faster path, but it is no longer immediate.

Article 1077 of the Civil Code imposes a thirty-day cooling-off period that begins the moment the couple submits the application. During those thirty days, either spouse can withdraw the application unilaterally, without giving a reason, and the process stops. If neither withdraws, both spouses must return to the bureau together within the next thirty days to collect the divorce certificate. Missing that second window is treated as a withdrawal, and the couple has to start over.3National People’s Congress of the People’s Republic of China. Civil Code of the People’s Republic of China

The cooling-off period applies to the administrative track only. If your marriage involves domestic violence or coercion, the judicial route is the safer choice, because no cooling-off period applies there and the court can issue protective measures.

Documents You Need for Administrative Divorce

Both spouses must appear in person and bring:2Gov.cn. Divorce Registration in China

The divorce agreement carries most of the weight. Bureau clerks will not accept vague terms like “property to be divided later”; every major issue has to be settled on paper before the certificate can issue.

The Judicial Route: Contested Divorce

When one spouse refuses to agree, the other petitions the People’s Court. Under Article 1079, a court will grant divorce if mutual affection between the spouses no longer exists and mediation has failed. The Civil Code lists five specific grounds:3National People’s Congress of the People’s Republic of China. Civil Code of the People’s Republic of China

  • Bigamy, or cohabitation with someone outside the marriage.
  • Domestic violence, or mistreatment or abandonment of a family member.
  • Habitual gambling or drug use that continues despite repeated warnings.
  • Separation of at least two full years caused by marital conflict.
  • Other circumstances showing mutual affection has clearly broken down.

The court must also grant divorce if one spouse has been legally declared missing. Before ruling, the court is required to attempt mediation, and in many straightforward cases judges take that step as a genuine reconciliation effort rather than a formality.

Why First Petitions Are Often Rejected

Chinese courts frequently reject a first divorce petition when the petitioner cannot clearly prove one of the statutory grounds. Under the Civil Procedure Law, a rejection triggers a six-month waiting period before the same spouse can file again, and the refiling must show new circumstances.5Supreme People’s Court of the People’s Republic of China. Article 1079 provides a route through this bottleneck. Once a petition has been rejected and the spouses have then lived separately for at least one more year, the court shall grant the divorce if either spouse files again.3National People’s Congress of the People’s Republic of China. Civil Code of the People’s Republic of China A determined spouse can obtain a judicial divorce even without clear fault grounds, but the full timeline can stretch to one or two years.

How Long a Judicial Divorce Takes

Simple cases with limited property disputes can conclude in roughly three months under the simplified procedure. Cases involving significant assets, custody disputes, or contested evidence follow the ordinary procedure and typically take six months or longer. Either party has fifteen days from the date the written judgment is served to file an appeal.5Supreme People’s Court of the People’s Republic of China. Civil Procedure Law of the People’s Republic of China Filing fees start at RMB 50 to RMB 300; when marital property to be divided exceeds RMB 200,000, an additional 0.5% applies to the amount above that threshold.

Court petitions typically require a written statement of grounds and supporting evidence such as financial records, property deeds, communications, or police reports for abuse cases. Filings can be submitted through China’s online litigation platform, which carries the same legal weight as in-person filings, provided both parties consent to online proceedings.6China International Commercial Court. Dividing Marital Property

Chinese law separates community property (owned jointly by both spouses) from separate property (belonging to one spouse alone). Only community property is on the table when a marriage ends.

What Counts as Community Property

Under Article 1062, the following belong to both spouses regardless of whose name is on them:3National People’s Congress of the People’s Republic of China. Civil Code of the People’s Republic of China

  • Salaries, wages, bonuses, and other employment income.
  • Proceeds from business operations and investments.
  • Income derived from intellectual property rights.
  • Inherited property or gifts, unless a will or gift contract specifically designates the asset to one spouse.

Both spouses have equal rights to manage community property, and one spouse cannot secretly dispose of major assets like real estate.

What Counts as Separate Property

Article 1063 identifies four categories that stay with one spouse:3National People’s Congress of the People’s Republic of China. Civil Code of the People’s Republic of China

  • Property owned before the marriage.
  • Personal-injury compensation.
  • Property designated to one spouse by a will or gift contract.
  • Personal-use items.

Commingling is where these lines blur. Premarital funds deposited into a joint account, or separate property that appreciates during the marriage because of the other spouse’s contributions, are handled case by case.

How Courts Split Community Property

Under Article 1087, when spouses cannot agree, the court considers the actual state of the property and favors the interests of any children, the wife, and the no-fault party.7China Daily. Civil Code of the People’s Republic of China The result is not automatically fifty-fifty. A spouse who committed domestic violence or adultery may receive a smaller share. Debts taken on for the family’s common benefit are joint obligations and are settled from community property first.

Compensation, Assistance, and Fault Damages

Chinese law provides three separate financial remedies at divorce, and they are not interchangeable.

Housework compensation. Article 1088 lets a spouse who took on a disproportionate share of childcare, elder care, or household duties claim financial compensation from the other. If the parties cannot agree on an amount, the court sets it. Under the current Civil Code this right is available to all couples, not just those who kept their finances separate during the marriage.

Hardship assistance. China has no Western-style alimony system. Article 1090 provides that if one spouse faces genuine financial hardship at the time of divorce, the other must provide “appropriate assistance” if able.8Wikisource. Civil Code of the People’s Republic of China – Book Five This is typically a one-time or short-term payment, not ongoing monthly support.

Fault damages. Under Article 1091, an innocent spouse can claim damages when the divorce was caused by the other spouse’s serious misconduct. The triggering situations are bigamy, cohabitation with someone outside the marriage, domestic violence, mistreatment or abandonment of a family member, and “other serious faults.”7China Daily. Civil Code of the People’s Republic of China The fifth category was added deliberately in the 2021 Civil Code to give courts flexibility. Damages can cover both financial losses and emotional harm.

Custody, Support, and Visitation

Article 1084 sets age-based custody rules. Children under two are raised by the mother as a near-automatic default absent extraordinary circumstances. For children between two and eight, the court weighs each parent’s circumstances against the child’s best interests. Once a child reaches eight, the court must give genuine weight to the child’s own preference.

Under Article 1085, the non-custodial parent pays child support. Judicial guidelines put the typical range at twenty to thirty percent of the paying parent’s monthly income for one child, with a cap of around fifty percent when multiple children are involved. Payments cover basic living expenses, education, and medical care, and continue until the child reaches adulthood. Amounts can be adjusted later if the child’s needs change.

Visitation belongs to the non-custodial parent. Courts prefer that parents work out a schedule privately and will impose one when they cannot. The custodial parent is not permitted to interfere with visitation.

If You or Your Spouse Is a Foreign National

Since November 7, 2023, mainland China has been a party to the Hague Apostille Convention. Foreign public documents from other convention countries — U.S. income records, property titles, identity documents — no longer need consular legalization. The originating country’s competent authority issues a single apostille certificate, and the document can then be used in China.9Consulate General of the People’s Republic of China in New York. How to Apply for Apostilles in the Consular Jurisdiction An apostille does not guarantee acceptance on its own. Chinese authorities may still require certified Chinese translations, and specific format requirements should be confirmed with the bureau or court in advance.

Recognition of a Chinese divorce abroad is a separate question governed by the destination country’s law. In the United States there is no treaty on foreign divorce recognition; each state decides for itself. States generally consider whether both parties had notice, whether both had the opportunity to participate, and whether at least one party was actually living in the foreign country at the time. A divorce where one spouse had no knowledge or involvement may be rejected.10Travel.State.gov. Divorce Certified and authenticated copies of the divorce certificate and translated copies of the original marriage certificate are typically needed.

What the Finalized Divorce Looks Like

An administrative divorce takes a minimum of about sixty days: thirty days of cooling-off, followed by the appointment within the next thirty to collect the certificate. If everything is in order, the bureau issues the certificate that day.

A judicial divorce runs longer. The court schedules mediation before trial. If mediation fails, both parties present evidence, the judge issues a written judgment, and the divorce becomes final fifteen days later if neither party appeals.5Supreme People’s Court of the People’s Republic of China. Civil Procedure Law of the People’s Republic of China Build in the six-month waiting period if a first petition is denied. A divorce certificate from the Civil Affairs Bureau and a court judgment granting divorce are equally valid; you do not need both, and whichever you receive is your proof that the marriage has ended.
