More than a dozen drugs, medical devices, and chemical products are the subject of active class action lawsuits or mass tort claims in U.S. courts as of 2026. The list below covers pharmaceutical and consumer product litigation with pending cases, recent settlements, or open claim windows, drawn from federal multidistrict litigation dockets and reported settlements. One clarification first: most of what people call a “class action drug lawsuit” is actually a mass tort, in which each injured person files an individual case. True class actions in this space usually involve financial harm, such as price-fixing, rather than physical injury.1ClassAction.org. Why Isn’t This a Class Action
Class Action vs. Mass Tort: Why It Matters for Your Claim
In a class action, one lawsuit represents an entire group, a judge certifies the class, and members are automatically included unless they opt out. Recovery is usually divided proportionally.2ClassAction.org. How to Join a Class Action Lawsuit In a mass tort, each plaintiff files a separate suit. Cases are often consolidated for pretrial matters in multidistrict litigation, but injuries and damages are evaluated one at a time, so compensation varies from person to person.1ClassAction.org. Why Isn’t This a Class Action
Drug and medical device cases almost always use the mass tort structure because side effects differ widely among patients. Someone who developed cancer after taking a medication has a fundamentally different claim than someone who experienced chronic nausea. If you were physically injured by a drug or device below, you generally need to file your own lawsuit; you do not join automatically the way you would a consumer class action.
Drugs With Active Mass Tort Cases and No Settlement Yet
GLP-1 Weight Loss and Diabetes Drugs (Ozempic, Wegovy, Mounjaro)
Lawsuits against Novo Nordisk (Ozempic, Wegovy, Saxenda) and Eli Lilly (Mounjaro, Trulicity, Zepbound) represent one of the largest active mass torts in the country. As of early May 2026, there were 3,636 pending cases in the federal MDL in the Eastern District of Pennsylvania.3Seeger Weiss LLP. Ozempic GLP-1 Lawsuit Plaintiffs allege the manufacturers failed to warn about gastroparesis (stomach paralysis), intestinal obstructions, chronic vomiting, and a rare form of vision loss called NAION. A smaller separate MDL with 37 cases focuses on the vision loss claims. In August 2025, the judge largely denied the manufacturers’ motion to dismiss, letting the core failure-to-warn claims move forward. No settlements have been reached, and the first bellwether trials are expected in late 2026 or early 2027. The FDA has required Ozempic and Wegovy label updates for intestinal obstruction and severe constipation.4Endocrinology Advisor. GLP-1 Lawsuits
Depo-Provera (Injectable Contraceptive)
Roughly 3,790 women had joined the consolidated litigation against Pfizer in the Northern District of Florida as of March 2026, alleging that Depo-Provera caused meningiomas, typically benign but serious brain or spinal tumors.5Seeger Weiss LLP. Depo-Provera Lawsuit A March 2024 study in the BMJ found that women who used Depo-Provera for at least one year were five times more likely to develop meningioma.6Sokolove Law. Depo-Provera Lawsuit The FDA approved an updated Depo-Provera label including a meningioma warning in December 2025. A Daubert hearing on expert testimony was scheduled for June 2026, with the first bellwether trials possible in late 2026 if plaintiffs prevail. Pfizer has argued that federal law preempts the claims.
Dupixent (Dupilumab)
On June 4, 2026, the Judicial Panel on Multidistrict Litigation created a new MDL against Sanofi and Regeneron in the District of New Jersey, alleging the biologic drug Dupixent increases the risk of cutaneous T-cell lymphoma (CTCL).7FindLaw. In Re Dupixent (Dupilumab) Products Liability Litigation, MDL 3180 Research cited in the litigation reports a three- to four-and-a-half-fold increase in CTCL risk among Dupixent users.8Seeger Weiss LLP. A settlement mediator has been appointed.12ConsumerShield. Hair Relaxer Lawsuit
Suboxone Sublingual Film
Patients who used Suboxone to treat opioid addiction have sued manufacturer Indivior, alleging the film’s acidic formulation caused tooth decay, erosion, and tooth loss. Roughly 1,850 to 1,870 active cases were pending in the Northern District of Ohio as of early 2026, with thousands of additional claims filed in bulk. In early 2025, the court allowed failure-to-warn claims to proceed while dismissing certain design defect claims for cases filed after 2010. The FDA added a dental risk warning to Suboxone’s label in June 2022; plaintiffs argue Indivior knew of the risks long before. Bellwether trials are being prepared for 2026.13TruLaw. NEC Baby Formula (Similac and Enfamil)
Approximately 797 cases were pending in the federal MDL as of May 2026, with plaintiffs alleging that cow’s milk-based formulas from Abbott (Similac) and Mead Johnson (Enfamil) fed to premature infants cause necrotizing enterocolitis.14Lawsuit Information Center. NEC Baby Formula Lawsuits State court juries have delivered major verdicts: a Missouri appeals court upheld a $495 million verdict against Abbott in May 2026, an Illinois jury awarded $70 million against Abbott in April 2026, and a $60 million verdict was returned against Mead Johnson in March 2024.15Simmons Firm. NEC Baby Formula Federal bellwether trials are scheduled for July and August 2026. The Missouri appeals court rejected Abbott’s argument that its preterm formula should be treated like a prescription drug, holding instead that it is “food, not a prescription drug or medical device,” a ruling that lets parents’ failure-to-warn claims proceed.
Talcum Powder (Johnson & Johnson)
Over 90,000 talcum powder lawsuits have been filed against Johnson & Johnson, one of the largest product liability dockets in U.S. history.16Sokolove Law. Talcum Powder Lawsuit Plaintiffs allege the company marketed Baby Powder and Shower-to-Shower for feminine hygiene despite ovarian cancer risks and asbestos contamination. Johnson and Johnson Talc Lawsuit No global settlement exists for individual claims, though J&J did agree to a $700 million settlement with 42 states and Washington, D.C. over marketing allegations. Recent jury verdicts include a $1.5 billion mesothelioma award in Baltimore in December 2025 and a $10.2 million mesothelioma verdict in May 2026. Formal mediation was ordered in August 2025.
Roundup Herbicide
Bayer, which acquired Monsanto in 2018, faces roughly 65,000 claims alleging that Roundup causes non-Hodgkin lymphoma and other cancers. In February 2026, Monsanto proposed a $7.25 billion class action settlement to resolve current and future claims. A Missouri state court granted preliminary approval in March 2026; objecting plaintiffs then tried to move the case to federal court, but on June 17, 2026, a federal judge remanded it back to state court, and the objectors appealed.18Reuters. Federal Judge Sends Bayer’s $7.25 Billion Roundup Settlement Back to Missouri State The Supreme Court agreed in January 2026 to review whether federal pesticide labeling law preempts state failure-to-warn claims, a ruling that could reshape the remaining litigation. Juries continue to deliver large verdicts, including a $2.1 billion award in Georgia in March 2025 that Bayer says it will appeal.19Bayer. Managing the Roundup Litigation
Paraquat Herbicide
Over 6,600 cases are pending in an MDL in the Southern District of Illinois, where agricultural workers allege that paraquat exposure caused Parkinson’s disease. Defendants are primarily Syngenta and Chevron.20TorHoerman Law. Paraquat Lawsuit No bellwether trials have taken place; Syngenta has resolved every scheduled case before jury selection, including a February 2026 settlement on the eve of the first Philadelphia bellwether.21Sokolove Law. Paraquat Lawsuit A tentative settlement framework was reported in April 2025, and proceedings have been stayed for negotiations. In April 2026, the judge ordered both sides to submit settlement details to a Special Master and began investigating unusually high opt-out rates at certain firms. Syngenta announced it will cease manufacturing paraquat by the end of June 2026.
Tylenol (Prenatal Acetaminophen)
Parents sued Johnson & Johnson and retailers alleging that acetaminophen use during pregnancy caused autism spectrum disorder or ADHD. The federal MDL in the Southern District of New York suffered a major setback in December 2023, when the judge excluded all of plaintiffs’ general-causation experts, and about 500 cases were dismissed on summary judgment in February 2024.22U.S. District Court SDNY. In Re Acetaminophen ASD-ADHD Products Liability Litigation The litigation is paused pending a Second Circuit appeal. In September 2025, the U.S. Department of Health and Human Services issued updated guidance advising more cautious use of acetaminophen during pregnancy, and plaintiffs submitted this to the appellate court. Financial-Harm Class Actions and Enforcement Actions
Generic Drug Price-Fixing
Unlike the injury cases above, generic drug price-fixing litigation is a true class action involving financial harm to purchasers. Consolidated in the Eastern District of Pennsylvania, the MDL accuses manufacturers of conspiring to fix prices and allocate markets for numerous generic medications, from cardiovascular drugs like pravastatin and propranolol to antibiotics like doxycycline and ciprofloxacin.38GovInfo. In Re Generic Pharmaceuticals Pricing Antitrust Litigation, MDL 2724 A related consumer action led by state attorneys general has produced settlements: Apotex agreed to pay $39.1 million and Heritage Pharmaceuticals $10 million, covering consumers who purchased certain generic drugs between May 2009 and December 2019.39Ohio Attorney General. Pharmacy Benefit Manager Insulin Pricing
On February 4, 2026, the FTC reached a settlement with pharmacy benefit manager Express Scripts resolving a lawsuit filed in September 2024. The agency alleged that Express Scripts and two other major PBMs, Caremark Rx and OptumRx, artificially inflated insulin list prices through anticompetitive rebating practices. Under the settlement, Express Scripts must stop preferring high-cost drugs over identical low-cost versions, base patient out-of-pocket expenses on net cost rather than inflated list prices, and increase transparency for health plans. The FTC projects the settlement will lower out-of-pocket insulin costs by up to $7 billion over 10 years. Enforcement actions against Caremark Rx and OptumRx remain pending. This is a federal enforcement action rather than a private class action, so consumers do not file individual claims.41FTC. What to Do If You Think You Have a Claim
If you took a drug or used a product on this list and later developed an associated condition, act promptly. Statutes of limitations differ by state and by the type of claim, and several of the cases above involve filing windows that have already closed or are approaching bellwether trial dates that may drive settlement structures. Gather your medical records, records of the medication or product used (including dates and any lot numbers), and evidence of your diagnosis. Contact a lawyer who handles mass tort or product liability work in the relevant MDL. For the true class actions, such as the generic drug price-fixing consumer settlements, watch for official claim notices rather than paying anyone up front to enroll you.
