Class Action Lawsuit for Pulmonary Fibrosis: Asbestos vs Silica

There is no general class action lawsuit for pulmonary fibrosis that a diagnosed worker can simply join. With one narrow exception filed in January 2026, claims for pulmonary fibrosis, silicosis, and asbestosis are pursued as individual personal injury or wrongful death lawsuits, because each worker’s exposure history, diagnosis, and damages are too specific to bundle into a single class. That structure is different from what most people picture when they hear “class action,” but it is often more valuable to the individual claimant: recent verdicts for single plaintiffs have reached $52.4 million and $17.45 million.

Why Pulmonary Fibrosis Cases Are Filed Individually

Courts have not consolidated engineered stone silicosis cases into a certified class, and no multidistrict litigation has been established for them either.1ConsumerNotice.org. Silicosis Lawsuits Class certification requires that plaintiffs share enough common facts that one trial can resolve the group’s claims. Toxic exposure cases rarely meet that bar. Each worker cut different products, at different shops, for different lengths of time, with different protective equipment, and developed disease at different rates and severities. Damages differ by the same margins.

Instead, plaintiffs bring product liability, negligence, and failure-to-warn claims. The core allegation is that manufacturers knew their high-silica slabs, or their asbestos-containing products, were dangerous and failed to warn the fabrication shops and workers who handled them.2Class Action Lawyer TN. The One Class Action That Does Exist

A putative class action was filed in January 2026 on behalf of workers who were exposed to engineered stone dust but have not yet been diagnosed with silicosis. The case, Cano et al. v. Architectural Surfaces Group LLC et al., asks the court to require manufacturers to pay for ongoing medical monitoring — periodic screenings for silicosis, lung cancer, and other silica-related diseases — for workers at high risk.4ClassAction.org. Silica Dust Silicosis Lawsuits It is in its early stages and has not been certified.

A medical monitoring class covers exposure without current illness. If you already have a diagnosis of pulmonary fibrosis, silicosis, or asbestosis, your claim is for compensation for that injury, and it moves as an individual case.

Two Different Legal Tracks Depending on the Cause

Pulmonary fibrosis is a category of lung scarring, not a single legal claim. The path a lawsuit takes depends on what caused the scarring.

Engineered Stone Silicosis

Engineered stone, sold as quartz countertops, can contain more than 90 percent crystalline silica. Cutting, grinding, and polishing the slabs releases fine dust that scars the lungs irreversibly. A 2023 JAMA Internal Medicine study of 52 male patients with silicosis from engineered stone found 20 had progressive massive fibrosis, 11 needed lung transplants, and 10 had died.5Verus LLC. Defendants in these suits are typically the slab manufacturers and distributors: Caesarstone USA, Cambria (facing roughly 400 silicosis lawsuits as of early 2026), Color Marble, Cosentino Group (Silestone and Dekton), and Hyundai USA.4ClassAction.org. Asbestos-Related Pulmonary Fibrosis

Asbestosis is a form of pulmonary fibrosis caused by inhaling asbestos fibers, and it has its own long-running legal system. A generic pulmonary fibrosis diagnosis does not on its own qualify you for asbestos compensation; the scarring has to be linked to asbestos exposure through occupational history and diagnostic testing.8ClassAction.org (Top Class Actions). What Causes Pulmonary Fibrosis Symptoms overlap heavily with idiopathic pulmonary fibrosis, and misdiagnosis can delay claims past the statute of limitations.

Recovery in asbestos cases comes through two channels: lawsuits against former employers and manufacturers, and claims filed with more than 60 active asbestos bankruptcy trust funds that have paid out over $17.5 billion in total. Per-trust payouts for non-malignant asbestos disease like asbestosis typically run from $10,000 to $150,000 per claim, and filing against multiple trusts can raise total recovery significantly.9Mesothelioma Fund. What Individual Cases Have Paid

Because these cases are tried one plaintiff at a time, verdicts and settlements vary widely.

In August 2024, a Los Angeles County jury awarded Gustavo Reyes Gonzalez $52.4 million against three engineered stone defendants. Gonzalez, then 34, had cut artificial stone for roughly 15 years and received a double lung transplant in February 2023. Twenty-nine of the 34 original defendants had already settled confidentially before trial, meaning his total recovery was substantially larger than the jury number alone. The jury assigned 15 percent fault to Caesarstone, 10 percent to Cambria, and 2.5 percent to Color Marble.3Los Angeles Times. In April 2026, a Denver County District Court jury awarded Tyler Jordan $17.45 million against Cambria and Hyundai USA. Jordan was diagnosed at 28 with silicosis and silica-caused chronic kidney disease after 10 years at his family’s fabrication shop. The award broke down as $7.6 million in economic damages, $7.6 million in physical impairment damages, $1.65 million in non-economic damages, and $600,000 in loss-of-consortium damages for his wife. The jury assigned 32 percent fault to Cambria for misrepresentation, 3 percent to Hyundai USA, 63 percent to Jordan’s employer, and 2 percent to Jordan himself. It found Cambria’s products were not defective and that Cambria was not negligent; Cambria has said it plans to appeal the misrepresentation finding.10PR Newswire. Settlements are more common than trial verdicts and are usually confidential. One published example is a $26 million total settlement for a 51-year-old California fabricator with accelerated silicosis and progressive massive fibrosis. Industry observers place individual silicosis settlements in a range from $25,000 to over $1 million, depending on severity, exposure duration, and how many defendants are held responsible.4ClassAction.org. Filing Deadlines Start at Diagnosis, Not Exposure

Statutes of limitations in toxic exposure cases generally follow a discovery rule: the clock starts when the disease is diagnosed or reasonably should have been discovered, not when the exposure happened. In California, the deadline for a personal injury claim based on toxic exposure is two years from the date the plaintiff becomes aware of the injury, its physical cause, and enough facts to suspect wrongful conduct.12Brayton Purcell LLP. Engineered Stone Quartz Silicosis and Cancer Lawsuit Other states run from one to six years for personal injury, with separate deadlines for wrongful death.

The delay between exposure and diagnosis is often years, and asbestosis and silicosis symptoms can look like idiopathic pulmonary fibrosis on first examination. If the initial diagnosis is wrong, the discovery rule can still preserve the claim once the correct cause is identified, but that fact pattern is contested in litigation and worth raising with a lawyer early.

What to Gather Before Contacting a Lawyer

Because these cases turn on linking a specific exposure to a specific diagnosis, the evidence lives in your employment and medical records. Useful items include:

  • A full work history listing every fabrication shop, construction site, or industrial job, with dates and job duties.
  • Product names and brands of the slabs, insulation, or other materials you worked with, if you can identify them.
  • Medical records showing diagnosis, imaging (chest X-rays or CT scans), pulmonary function tests, and any biopsy results.
  • Any records of respirator use, dust control equipment, or safety training at work.
  • For asbestos cases, records that place you at specific job sites during specific years, since trust claims are matched against product exposure histories.

An attorney with experience in toxic tort or occupational disease litigation can tell you whether your diagnosis fits an existing litigation track, whether the medical monitoring class action applies to you, and what filing deadline governs in your state.
