Conjugal visits for prisoners exist in only four states — California, Connecticut, New York, and Washington — and the federal Bureau of Prisons does not allow them at all.1Federal Bureau of Prisons. How to Visit a Federal Inmate The surviving programs are now called “extended family visits” or “family reunion programs,” and they are open to a broader group of relatives than just spouses. Qualifying is harder than most families expect: the incarcerated person needs a clean disciplinary record, the relationship has to be documented, and the review can take months.
Which States Still Allow Them
California runs “family visits” in apartment-like units on prison grounds, lasting roughly 30 to 40 hours.2California Department of Corrections and Rehabilitation. Types of Visits – Visitation Information New York’s Family Reunion Program uses a private, home-like setting for an extended stay.3Department of Corrections and Community Supervision. Family Reunion Program Connecticut’s program runs 24 hours, from 8:30 a.m. on a Saturday or Wednesday until the following morning, and requires a minor child to participate, which makes it a parent-child program rather than a traditional spousal visit.4Connecticut General Assembly. Extended Family Visits in Prison Washington’s Extended Family Visit program follows a similar family-focused model.5Washington State Department of Corrections. The other 46 states offer no form of private overnight family visitation. Anyone in a federal prison has no path to this kind of visit regardless of offense, behavior, or family circumstances.
Who Counts as Family
These visits are not limited to legal spouses. Each state defines eligible relatives differently, but all four go well beyond marriage.
California allows legal spouses, registered domestic partners, parents, children, siblings, and people in a verified foster relationship with the incarcerated person.6Legal Information Institute. Cal. Code Regs. Tit. 15, 3177 – Family Visiting (Overnight) New York accepts legal spouses, children over 18, parents, grandparents, and siblings, with minor children permitted when accompanied by an eligible adult. Spouses must produce a valid marriage certificate, and in New York the marriage must have existed for at least six months before applying.3Department of Corrections and Community Supervision. Connecticut requires that a minor child of the incarcerated person attend every visit, accompanied by a spouse, the child’s legal guardian, or the incarcerated person’s parent.4Connecticut General Assembly. Extended Family Visits in Prison Washington requires visitors to already be on the incarcerated person’s approved visitor list and to have visited at least six times in the previous 12 months, including at least one in-person visit.7Washington State Department of Corrections. Extended Family Visit Eligibility New York similarly requires a “recent and consistent visiting pattern” of at least three regular visits in the past year.3Department of Corrections and Community Supervision. Family Reunion Program
Since the Supreme Court’s 2015 decision in Obergefell v. Hodges, same-sex married couples have the same legal standing as any other married couple, and any program that accepts legal spouses must accept them equally. California also explicitly includes registered domestic partners.6Legal Information Institute. Cal. Code Regs. Tit. 15, 3177 – Family Visiting (Overnight)
Visitors face their own screening. Washington disqualifies anyone under correctional or court-ordered supervision and anyone with pending felony charges. A documented history of domestic violence against someone in a similar relationship to the incarcerated person triggers additional review.7Washington State Department of Corrections. Who Qualifies on the Inside
The eligibility rules for the incarcerated person are strict, and they function as a behavioral incentive. Every state requires a clean disciplinary record.
New York requires at least six months in custody with no major, chronic, severe, or excessive disciplinary problems. A single serious infraction in the eight weeks before applying can disqualify someone. Spending more than 20 percent of the prior three years in disciplinary confinement is an automatic bar.8Department of Corrections and Community Supervision. Directive – Family Reunion Program Anyone within 90 days of release is also ineligible.3Department of Corrections and Community Supervision. Family Reunion Program
Washington also requires six months of continuous incarceration plus active participation in work, education, or treatment programming. Anyone in maximum or close custody, restrictive housing, or facing unresolved felony charges is excluded. People convicted of sex offenses or serious violent offenses face additional screening through treatment assessments and must be individually approved by a review committee.7Washington State Department of Corrections. Extended Family Visit Eligibility
California bars anyone convicted of a sex offense or a violent offense where the victim was a minor or a family member. People on death row, those in reception centers, anyone in restrictive housing, and anyone found guilty of a serious disciplinary offense in the past 12 months are all excluded.9Legal Information Institute. Cal. Code Regs. Tit. 15, 3177 – Family Visiting (Overnight)
How the Application Works
The incarcerated person starts the application through their assigned correctional counselor.2California Department of Corrections and Rehabilitation. Types of Visits – Visitation Information Washington’s Department of Corrections estimates two to three months for review when everything is in order, and up to six months when documents are missing or the offense history requires extra scrutiny.10Washington State Department of Corrections. Extended Family Visit Fact Sheet
Review typically involves verifying each visitor’s identity and relationship, running background checks, confirming the incarcerated person’s disciplinary record, and checking for any disqualifying offenses. In California, denials come with a written notice explaining the reason and instructions for filing an appeal.11Legal Information Institute. Cal. Code Regs. Tit. 15, 3176 – Denial, Restriction, Suspension, Termination or Revocation of Visits The most common reason applications stall is incomplete paperwork from the family, so gathering documents like marriage certificates, birth certificates, and identification early makes a real difference.
What a Visit Looks Like
Visits happen in private units inside the prison perimeter. California’s apartment-style units let families cook meals, spend time together, and sleep overnight for roughly 30 to 40 hours.2California Department of Corrections and Rehabilitation. Types of Visits – Visitation Information New York uses a similar home-like setting.12New York Codes, Rules and Regulations. New York 7 CRR-NY 220.1 – Description Connecticut’s visits last 24 hours.4Connecticut General Assembly. Extended Family Visits in Prison
Facilities generally provide basic supplies such as linens, soap, and towels. Frequency varies by state. Connecticut allows up to four visits per year, spaced at least 90 days apart.4Connecticut General Assembly. Extended Family Visits in Prison Both the incarcerated person and all visitors are searched before and after every visit, and any rule violation during the visit can end it immediately and cost future visitation privileges.
What You Can and Cannot Bring
California publishes a detailed list of what visitors may bring: up to $100 in cash (bills, dollar coins, and quarters only), one small clear plastic bag no larger than roughly 6 by 8 inches, two keys on a ring, a comb without a pointed end, and up to 10 photographs no larger than 8 by 10 inches. Visitors bringing infants may carry a limited supply of formula, diapers, and baby food in sealed packaging.13California Department of Corrections and Rehabilitation. Items a Visitor May Bring
Cell phones, cameras, and other personal electronics are prohibited everywhere. So are tobacco, lighters, and any unauthorized food or drink. Life-sustaining prescription medications may be permitted with a doctor’s letter, but only in the original pharmacy container.13California Department of Corrections and Rehabilitation. Items a Visitor May Bring
Smuggling contraband into a prison is a criminal offense, not just a policy violation. Most states treat introducing drugs, weapons, or other prohibited items into a correctional facility as a felony. The administrative consequences are also severe: a visitor caught passing contraband will typically lose visiting privileges permanently, and the incarcerated person can face disciplinary confinement and lose access to future extended family visits. A single incident closes the door on the program for both people.
