Criminal rehabilitation in Canada is the formal application that permanently removes the inadmissibility caused by a past foreign conviction. You can file it once at least five years have passed since you finished every part of your sentence, and if approved, the bar is gone for good unless you pick up a new conviction. Processing typically takes over a year, so plan well ahead of any trip.1Immigration, Refugees and Citizenship Canada. Why a Foreign Conviction Blocks You
A conviction from outside Canada, or even conduct that would have been a crime under Canadian law, can get you refused a visa or turned away at the border. The age of the offense and the leniency of the foreign penalty do not matter on their own. A decades-old first-offense DUI from the United States is enough to trigger a refusal.2Immigration, Refugees and Citizenship Canada. Overcome Criminal Convictions
Canadian officers do not defer to the foreign classification. They look at what you actually did and ask what the equivalent charge would be under a Canadian federal statute, usually the Criminal Code or the Controlled Drugs and Substances Act. The maximum sentence that Canadian equivalent carries then decides how your case is classified under section 36 of the Immigration and Refugee Protection Act.3Justice Laws Website. Immigration and Refugee Protection Act SC 2001, c 27 – Section 36
Two tiers matter for your application:
- Criminality: a foreign conviction equivalent to a Canadian indictable offense with a maximum sentence under ten years.
- Serious criminality: a foreign conviction equivalent to a Canadian offense punishable by ten years or more.
The tier changes the fee you pay and how closely officers scrutinize the file. It also decides whether the automatic path described below is even available to you. One category catches Americans off guard constantly: a standard DUI, even a first offense with no accident and no jail, carries a ten-year maximum in Canada and therefore falls under serious criminality.4Department of Justice Canada. Impaired Driving Laws The same applies to drug-impaired driving and refusing to provide a sample.
Check Deemed Rehabilitation First
Before you file anything, see whether time alone has already solved the problem. Deemed rehabilitation can remove inadmissibility automatically if enough years have passed and your record fits within specific limits.5Immigration, Refugees and Citizenship Canada. Deemed Rehabilitation
- One indictable-equivalent offense with a maximum under ten years: you may be deemed rehabilitated ten years after completing the entire sentence.
- Two or more summary-conviction equivalents: you may be deemed rehabilitated five years after completing all sentences.
Deemed rehabilitation is off the table if the Canadian equivalent carries a maximum of ten years or more, which rules out impaired driving, most drug trafficking, and many assault offenses. It also requires that the offense did not involve serious property damage, physical harm, or a weapon. There is no form or fee. If you think you qualify, you can raise it at a port of entry and ask the officer to make the determination, but bring the court documents that prove exactly when your sentence ended.
When You Can Apply
If deemed rehabilitation does not cover you, the formal application is the permanent fix. The threshold requirement is that at least five years have passed since you completed every part of your sentence.2Immigration, Refugees and Citizenship Canada. Overcome Criminal Convictions
Calculating that date is where people slip up. Completion of sentence means the day you satisfied every court-imposed obligation: jail time served, probation expired, parole finished, fines paid in full, restitution completed. Conditional and suspended sentences count, but the clock starts only after every condition is met. With multiple convictions, the five years run from the last obligation on the most recent offense. Miss the date by a day and the application comes back as premature.
Beyond timing, officers evaluate whether you have genuinely reformed. They weigh the number and seriousness of the offenses, your behavior since conviction, your explanation for why you will not reoffend, community support, and your present circumstances.6Immigration, Refugees and Citizenship Canada. Rehabilitation for Persons Who Are Inadmissible to Canada Because of Past Criminal Activity Approval is permanent; you will not need to reapply unless a new conviction lands on your record.
What to File
Missing documents are the single most common reason applications stall or come back without processing. Build the package carefully.
Forms
The core form is the Application for Criminal Rehabilitation (IMM 1444), which asks for your personal details and the full history of past offenses.7Immigration, Refugees and Citizenship Canada. Application for Criminal Rehabilitation IMM 1444 You also need the Document Checklist (IMM 5507), and IMM 5476 if you are using an immigration representative.6Immigration, Refugees and Citizenship Canada. Rehabilitation for Persons Who Are Inadmissible to Canada Because of Past Criminal Activity Every entry on IMM 1444 has to match your court documents exactly. Small discrepancies invite delays.
Police Certificates
You need a police certificate from every country where you have lived six consecutive months or longer since turning 18.8Immigration, Refugees and Citizenship Canada. When to Get a Police Certificate For U.S. applicants, that means an FBI Identity History Summary, which requires a current set of fingerprints and costs $18. You can submit fingerprints electronically at participating U.S. Post Office locations or mail a fingerprint card to the FBI. The FBI does not expedite requests.9Federal Bureau of Investigation. Identity History Summary Checks Frequently Asked Questions If you have lived in multiple U.S. states, state-level background checks may also be needed, typically between $10 and $50 per state.
Court Records
For every conviction, include the original charging documents, the final judgment, and proof that the sentence was fully satisfied. This is how the officer verifies both the Canadian equivalency and your eligibility date. If records have been destroyed over the years, get a letter from the clerk of the court certifying that they are no longer available.
Personal Statement and Character Evidence
You must submit a written statement describing the circumstances of each offense, your state of mind at the time, and the concrete steps you have taken since. Officers weigh this heavily because it fills in what bare court records cannot. Reference letters from employers, community members, or family strengthen the file, as does documentation of stable employment, homeownership, volunteer work, or completed treatment programs.
Translations
Any document not in English or French needs a certified translation. The translator must swear to its accuracy in front of an authorized commissioner, and the affidavit has to accompany the translated document.10Immigration, Refugees and Citizenship Canada. What Is an Affidavit for a Translation
Where to Send It and What It Costs
Where you submit depends on your travel status. If you need a visa to enter Canada, you can apply online or mail your application to the nearest visa application centre. If you qualify for an Electronic Travel Authorization instead of a visa, you must submit the rehabilitation application separately by mail or courier to the visa office responsible for your region.11Immigration, Refugees and Citizenship Canada. Inadmissibility – Where to Submit Your Application When mailing, include a prepaid airway bill so IRCC can return your documents, and use a tracked service both ways.
Processing fees are non-refundable regardless of the outcome. Current fees are $246.25 CAD for criminality and $1,231.00 CAD for serious criminality. Add $85.00 CAD per person if biometrics are required.12Immigration, Refugees and Citizenship Canada. Citizenship and Immigration Application Fees Payment usually goes through the IRCC online portal, and the receipt must be included with your package. If IRCC requires biometrics, Guide 5312 tells applicants to pay the fee and provide them as soon as possible; U.S. applicants do so at designated visa application centres or Application Support Centers.6Immigration, Refugees and Citizenship Canada. After You Apply
Processing is slow. IRCC states that criminal rehabilitation applications can take over a year, and complex files with multiple offenses or incomplete records take longer.1Immigration, Refugees and Citizenship Canada. How Long Will It Take to Get a Decision on My Individual Rehabilitation Application A pending application gives you no right to enter Canada. Do not book travel until the approval letter is in hand.
If the application is refused, you can reapply, but the full processing fee is due again.13Immigration, Refugees and Citizenship Canada. If My Individual Rehabilitation Application Is Refused, Will I Get a Refund A refusal usually signals that the officer was not persuaded rehabilitation was genuine, so any resubmission should add stronger evidence of reform or the benefit of more time. Filing the same package again is unlikely to produce a different answer.
If You Cannot Wait Five Years
When the five-year point is still in the future, or you need to enter Canada urgently while your rehabilitation application is pending, a Temporary Resident Permit is the alternative. A TRP does not erase inadmissibility. It overrides it for a specific trip or period when an officer decides your reason for entering outweighs the risk.14Immigration, Refugees and Citizenship Canada. Temporary Resident Permits – Eligibility Business obligations, family emergencies, and medical needs are common justifications, but issuance is entirely discretionary. The fee is $246.25 CAD per person.12Immigration, Refugees and Citizenship Canada. Citizenship and Immigration Application Fees A TRP can be issued for a single entry or a fixed period, and it can be requested at a port of entry or from a visa office in advance.
Two Assumptions That Get People Turned Away
A pardon or expungement from the country where the offense occurred does not automatically clear your Canadian inadmissibility. Officers still have authority to consider the underlying conviction and may require full details of the original charges, disposition, and the pardon itself. A foreign pardon can support a rehabilitation application as evidence of reform, but it is not a substitute for one. If you received a U.S. pardon and assume you can cross freely, you will likely be refused entry.
Accuracy on the application matters more than in almost any other immigration context. If IRCC finds that you, your representative, or your interpreter submitted false or misleading information, you can be banned from Canada for at least five years, receive a permanent fraud notation, and lose any status you already hold.15Immigration, Refugees and Citizenship Canada. Consequences of Immigration and Citizenship Fraud Omitting a conviction is treated the same as fabricating one. If any part of your record is ambiguous, disclose it and explain the uncertainty rather than leaving it off the form.
