Depo Lupron Lawsuit: Closed Fraud Case and Failed Injury Claims

A Lupron lawsuit today usually means one of two very different things: the closed pricing-fraud litigation that resolved in the mid-2000s and paid more than a billion dollars to governments, insurers, and patients, or a personal injury claim alleging that leuprolide acetate caused lasting bone, joint, or neurological damage. The fraud money is gone. The injury cases are still being filed, and plaintiffs have lost every one that has reached a public decision, most often because they filed too late.

The Pricing Fraud Case Is Closed

TAP Pharmaceutical Products Inc., the Abbott–Takeda joint venture that originally sold Lupron, pleaded guilty in 2001 to conspiring to violate the Prescription Drug Marketing Act. The scheme inflated the “Average Wholesale Price” reported for Lupron while the company sold the drug to doctors at a discount, letting physicians bill Medicare, Medicaid, and private insurers at the higher figure and keep the spread. TAP also gave doctors free samples they could bill for and offered kickbacks that included research grants of up to $100,000, televisions, VCRs, ski trips, golf outings, and resort seminars.1U.S. Department of Justice. TAP Pharmaceutical Products Inc. Settlement

The government resolution totaled $875 million: a $290 million criminal fine (the largest health care fraud criminal fine at the time), $559.5 million in federal civil restitution under the False Claims Act, and $25.5 million split among the fifty states and the District of Columbia for Medicaid losses. TAP also entered a Corporate Integrity Agreement with the HHS Inspector General.1U.S. Department of Justice. TAP Pharmaceutical Products Inc. Settlement

Because that settlement only covered public payers, private insurers and co-paying patients pursued their own consolidated class action, In re: Lupron Marketing and Sales Practices Litigation, MDL No. 1430, in the District of Massachusetts. TAP agreed in November 2004 to pay $150 million covering anyone who bought Lupron between January 1985 and March 2005, without admitting wrongdoing. The court gave final approval on May 12, 2005.2The Daily Record. TAP to Pay $150 Million to Settle Lupron Lawsuits3Community Catalyst. Personal Injury Lawsuits and How They’ve Fared

The pricing case and the injury cases are separate tracks. Injury plaintiffs argue that Abbott, TAP, and later AbbVie failed to warn adequately about Lupron’s risks, and that the drug caused permanent harm. No plaintiff in a publicly reported personal injury case has won a verdict or a disclosed settlement.

Klein v. Abbott Laboratories

The first Lupron products liability case to reach a jury was tried in 2011 in the District of Nevada. Karin Klein alleged that Lupron Depot prescribed at age 17 left her permanently disabled with degenerative disc disease, jaw-joint dysfunction, and bone thinning.4PBS NewsHour. Paulsen v. Abbott Laboratories

Terry Paulsen, a former neonatal emergency nurse, received Lupron injections in February and March 2004 for endometriosis and alleged she later developed severe joint arthropathy and osteoporosis. She said an Abbott representative had told her physician the drug would not cause long-term problems.8Bloomberg Law. Abbott, AbbVie Continue to Face Lupron Bone, Joint Damage Suit

Paulsen first sued in April 2010, voluntarily dismissed in May 2014, and refiled in May 2015.9Bloomberg Law. Abbott, AbbVie Beat Appeal in Lupron Bone, Joint Injury Suit The Seventh Circuit affirmed dismissal on July 12, 2022, holding her claims barred by Illinois’s two-year personal injury statute of limitations. Applying the discovery rule, the court pointed to her own medical records showing bone and joint complaints right after the 2004 injections, communications from 2006 and 2007 in which she and her family blamed Lupron for her problems, an FDA adverse-event form her mother filed in 2007, and her own note to doctors: “I am so sick, we know it’s from the Lupron.” Her claims accrued long before April 2008, so the 2010 filing was too late.10Findlaw. Paulsen v. Abbott Laboratories, No. 21-2877 A separate ruling by Judge John F. Kness held a strict-liability failure-to-warn claim barred by Georgia’s ten-year statute of repose because she refiled eleven years after her last injection.11Bloomberg Law. Why Injury Plaintiffs Keep Losing

The recurring problem is timing. Lupron’s effects often develop gradually, so patients may not connect symptoms to the drug for years. Courts have held that once a plaintiff has enough information to suspect the drug caused harm, the limitations clock starts running, whether or not she realizes she has a legal claim. Beyond timeliness, courts have dismissed Lupron complaints for vague pleading: failing to specify which defendant did what, whether the prescription was on-label or off-label, or which specific misrepresentation the plaintiff relied on. Fraud-based counts must plead the who, what, when, where, and how. Breach of implied warranty counts have been thrown out where the plaintiff could not show she personally purchased the product.12Drug and Device Law Blog. Guest Post: Its a Mad, Mad, Mad, Mad Case

Can You Still Sue Over Lupron Injuries

Possibly, but the deadline usually decides the case before the science does. State personal injury statutes of limitations commonly run in a two- to three-year range, and many states also have statutes of repose that cap how long after the product was used a case can be brought at all, regardless of when injury was discovered. In Paulsen, Illinois’s two-year limit and Georgia’s ten-year repose each ended the case on their own.10Findlaw. Paulsen v. Abbott Laboratories, No. 21-287711Bloomberg Law. Abbott, AbbVie Defeat Long-Running Lupron Bone, Joint Lawsuit

Two practical points follow. First, if you have written records, medical notes, emails, or FDA MedWatch submissions in which you or your family attributed symptoms to Lupron, those documents can be used to fix the accrual date and defeat a discovery-rule argument. That was the decisive evidence against Paulsen. Second, the clock does not wait for a diagnosis that names Lupron as the cause; suspicion documented in your own records can be enough.

The Injuries These Lawsuits Point To

The FDA has documented more than 25,000 adverse event reports for Lupron, including over 1,500 deaths, according to a KTNV investigation.13KTNV Las Vegas. More Women Come Forward With Complaints About Lupron Side Effects The drug suppresses sex hormones, and the loss of bone mineral density it induces may not be fully reversible, which is why the FDA caps endometriosis treatment at twelve months.14FDA. Lupron Depot Prescribing Information (Revised 2025) Between 2010 and 2013 the FDA required label updates adding warnings about bone density loss, thromboembolism, and convulsions.

Injuries the current labeling or post-marketing reports identify include:

  • Deep vein thrombosis, pulmonary embolism, myocardial infarction, stroke, and transient ischemic attack.
  • Convulsions, depression, suicidal ideation and attempt, and pituitary apoplexy, most commonly within two weeks of the first dose.
  • Stevens-Johnson syndrome, toxic epidermal necrolysis, and other severe skin reactions, added to the label in 2025.
  • Hyperglycemia and increased risk of diabetes in men.
  • Rare drug-induced liver injury.

Evidence disclosed by an expert witness before a sealing order indicated that 62% of women in certain clinical trials had not regained normal estrogen levels one year after stopping Lupron; the underlying trial results were sealed at AbbVie’s request.15WSB-TV Atlanta. Georgia Woman Says Drug Used to Treat Endometriosis Led to Series of Health Problems

Dr. David Redwine, an endometriosis specialist, has been a prominent critic. He told KTNV that “Lupron does not make endometriosis go away so the cure rate with Lupron is zero” and that the risks “far outweigh the benefits.”13KTNV Las Vegas. More Women Come Forward With Complaints About Lupron Side Effects He served as an expert in the Klein case and concluded in his report that Lupron was “completely the cause” of the plaintiff’s bone loss.16Calgary Journal. Endometriosis and Lupron AbbVie says Lupron’s safety profile is “well documented” in its prescribing information and that the company reports new safety information to regulators. The FDA has said “the benefits of Lupron outweigh its risks when used according to its approved labeling.”

Puberty Blocker Use Is a Separate Regulatory Fight

Lupron is a GnRH agonist approved for prostate cancer, endometriosis, certain infertility treatments, and central precocious puberty. It is prescribed off-label as a puberty blocker for minors with gender dysphoria; the FDA has never approved that use. In 2016 the FDA ordered AbbVie to add warnings that children taking Lupron may develop new or worsened psychiatric problems, brain swelling, and vision loss.17U.S. Congress. House Judiciary Subcommittee Hearing Document

The policy debate around that use is playing out in legislatures and health agencies, not in a consolidated U.S. product liability action. More than a dozen U.S. state legislatures have restricted gender-affirming care for minors. Finland scaled back pediatric use of puberty blockers in 2020, Sweden in 2022, and Norway in 2023. The UK NHS stopped routine prescriptions in March 2024 after the Cass Review, and in January 2025 the UK government made its ban on private-sector prescribing to under-18s indefinite on the advice of the Commission on Human Medicines.18UK Government.
