Digitalprincxss Arrest: Florida Charge, Dropped Case, and Response

TikTok and OnlyFans creator Marrissa Cloutier, known online as digitalprincxss, was arrested in Fort Myers, Florida, on August 25, 2021, on a felony charge of child neglect after neighbors found her young son alone outside her home late at night. Prosecutors dropped the charge about six weeks later, on October 4, 2021, citing insufficient evidence to prove the case beyond a reasonable doubt.¹

What Happened the Night of the Arrest

Around 10:20 p.m. on August 24, 2021, neighbors called Fort Myers police after finding Cloutier’s son crying alone outside the house.¹ Cloutier wasn’t there when officers arrived. When she got back, she told them she had run out to a nearby 7-Eleven for laundry detergent and “had not been gone long.”²

Officers didn’t buy it. The police report noted she was in a black mini dress and full makeup, which they described as “not conducive to a late-night run to a convenience store,” and she had no receipt.³ After being read her Miranda rights, Cloutier changed her account. She said she had put her son to bed at 9 p.m. and then driven roughly 11 miles to meet a friend.¹ She told officers she had “made a mistake,” that her actions were “selfish,” and that her “anxiety made her lie.”

The report said the boy had been left unsupervised for more than an hour in an area surrounded by “bodies of water, wildlife, and vehicle traffic as well as other potentially dangerous hazards.”² Cloutier told officers the home had no security cameras that could have been used to monitor him.³ Her mother came to the scene that night and took custody of the child.⁴

The Child Neglect Charge Under Florida Law

Cloutier was booked into the Lee County Jail and charged with neglect of a child without great bodily harm, a third-degree felony under Florida Statute 827.03.⁴ Florida law defines child neglect as a caregiver’s failure to provide essential care, including adequate supervision, where that failure rises to willfulness or culpable negligence.⁵ Even without great bodily harm, the offense carries up to five years in prison, up to five years of probation, and fines of up to $5,000.

Cloutier was released from custody, pleaded not guilty, and was scheduled for arraignment on September 27, 2021.⁴

Why the Charges Were Dropped

On October 4, 2021, the State Attorney’s Office of the 20th Judicial Circuit dropped the felony charge. Prosecutors said they had determined there was “insufficient evidence to prove beyond a reasonable doubt” that Cloutier committed the offense.¹ No conditions or alternative resolution were announced with the decision, and it wasn’t clear at the time of reporting whether Cloutier had regained custody of her son.²

Cloutier’s Response and the Online Fallout

The mugshot moved fast. By August 27, 2021, TikTok videos and Twitter threads featuring it were circulating widely. Cloutier set her TikTok, Twitter, and Instagram accounts to private, and an OnlyFans creator who had planned a September collaboration with her publicly canceled the project.²

A few days after the arrest, Cloutier posted a short TikTok addressing the situation. “Legally, I’m only allowed to say so much regarding it, and I know there’s a lot of things being posted online that are out of context and very much untrue, so please do not believe everything you read on the internet,” she said.¹ She later deleted the video, though others continued to share it. Neither Cloutier nor her attorney responded to press requests for further comment at the time.²
