The prosecution leaned heavily on the survivors. Prosecutors called Dane and Veader’s identifications the strongest evidence against the defendants. Smith’s fingerprint on the duct tape and Salley’s own admission that he was present and held the gun added to the case. Assistant District Attorney Steven Nuzzi argued that Salley was the gunman, but Justice Berkman instructed both juries that under the felony murder doctrine, anyone participating in a crime during which a murder occurs bears equal responsibility.1CBS News. 2 Convicted in Carnegie Deli Killings

The Appeal
Salley appealed. He argued that statements he made to police should have been suppressed because he was bitten by a police dog during his Miami arrest, and that the trial judge had improperly limited his duress defense by preventing him from introducing Smith’s statements and prior robbery conviction. On January 24, 2006, the Appellate Division, First Department, unanimously affirmed his conviction and the denial of a separate motion to vacate, finding that his statements were voluntary despite the dog bite and that the trial judge had properly exercised discretion on the evidentiary rulings. Smith’s conviction was affirmed in the same decision.14New York Courts. People v Salley, 25 AD3d 473People v. Salley
