A Discord subpoena can force the company to hand over your account records, but not the contents of your messages. Under the Stored Communications Act, a plain subpoena reaches only basic subscriber information: username, email address, IP login history, account creation date, and payment method on file. To get the actual text of your direct messages or server posts, law enforcement generally needs a search warrant backed by probable cause. Civil litigants face an even tighter ceiling and usually cannot get message content from Discord at all.
What a Subpoena Actually Unlocks
The Stored Communications Act sorts Discord data into two buckets, and the legal process required for each is different.
A subpoena, whether administrative, grand jury, or civil, is the lowest bar. It lets the requesting party obtain the categories of non-content subscriber information listed in 18 U.S.C. § 2703: name, address, session times and durations, length and type of service, subscriber number or network address, and means of payment.1Office of the Law Revision Counsel. 18 USC 2703 – Required Disclosure of Customer Communications or Records Translated to Discord, that means your username, email, phone number on file, account creation date, IP login history, and billing details if you have paid for Nitro.
A court order under § 2703(d) sits a step above. To get one, the government must offer “specific and articulable facts showing that there are reasonable grounds to believe” the records are relevant and material to an ongoing criminal investigation.1Office of the Law Revision Counsel. 18 USC 2703 – Required Disclosure of Customer Communications or Records A 2703(d) order can reach further into non-content data than a bare subpoena, pulling more detailed transaction logs and metadata.
A search warrant is the top of the ladder and the only tool that reliably pries loose message content. Under § 2703(a), content stored for 180 days or fewer requires a warrant based on probable cause.1Office of the Law Revision Counsel. 18 USC 2703 – Required Disclosure of Customer Communications or Records In practice, law enforcement obtains warrants for message content regardless of how long it has been stored, because courts have grown skeptical of warrantless access to stored communications.
Federal Rule of Criminal Procedure 41 sets out what a warrant has to show: sufficient facts to believe the data contains evidence of a crime, and a description of what will be seized.2Legal Information Institute. Federal Rules of Criminal Procedure Rule 41 – Search and Seizure A subpoena cannot substitute for that.
Civil Subpoenas Have a Lower Ceiling
If someone sues you and subpoenas Discord for your message history, Discord will almost certainly refuse to produce the content. Section 2702(a) prohibits electronic communication service providers from divulging the contents of stored communications, and civil subpoenas are not among the listed exceptions.3Office of the Law Revision Counsel. 18 USC 2702 – Voluntary Disclosure of Customer Communications or Records The SCA operates as a shield in that scenario.
Civil litigants can still use a subpoena to obtain non-content records like your account registration details and IP logs. But if they want the messages themselves, they generally have to get them from you directly through ordinary civil discovery, not from Discord as a third party.
Will You Find Out
Discord’s general practice is to notify users when a government entity requests their data through legal process. The purpose is to give you time to consult a lawyer and, if warranted, challenge the request before Discord produces anything.
Notification is not guaranteed. Under 18 U.S.C. § 2705, the government can delay user notification for up to 90 days if a court determines, or a supervisory official certifies in the case of a subpoena, that telling you could endanger someone’s life, lead to flight from prosecution, result in evidence destruction, enable witness intimidation, or otherwise seriously jeopardize an investigation. These delays can be renewed in additional 90-day increments, so months can pass before you learn your data was requested. Once the delay expires, the government is supposed to serve you with a copy of the original legal process along with a notice explaining what happened.4Office of the Law Revision Counsel. 18 USC 2705 – Delayed Notice
Discord also does not notify users about emergency disclosures.
Preservation Holds Come Before the Subpoena
Law enforcement can freeze your data before obtaining any subpoena, court order, or warrant. Under 18 U.S.C. § 2703(f), when a government entity requests preservation, Discord must “take all necessary steps to preserve records and other evidence in its possession” while the legal process is pending. The initial hold runs 90 days and can be renewed for another 90 days.1Office of the Law Revision Counsel. 18 USC 2703 – Required Disclosure of Customer Communications or Records
A preservation hold is not a disclosure. It only prevents deletion. You will not necessarily know one is in place, because the statute does not require notification at the preservation stage. That also means deleting your account after a hold has been issued does not clear the underlying data.
The Emergency Bypass
Under 18 U.S.C. § 2702(b)(8), Discord may voluntarily disclose both content and non-content data to the government without any subpoena, court order, or warrant if the company has a good-faith belief that an emergency involving danger of death or serious physical injury requires immediate disclosure.3Office of the Law Revision Counsel. 18 USC 2702 – Voluntary Disclosure of Customer Communications or Records These situations are uncommon and generally involve active threats of violence or self-harm.
How to Challenge a Discord Subpoena
If you receive notice, you can fight the subpoena by filing a motion to quash with the issuing court. That motion asks the judge to invalidate the subpoena and block the data release.
Timing is unforgiving. Under the Federal Rules of Civil Procedure, written objections to a subpoena for documents or records must be served before the compliance date or within 14 days of service, whichever comes first. Courts have found seven days or fewer to be an unreasonably short compliance period, while 14 days or more is generally treated as presumptively reasonable. Miss the window and you lose most of your leverage.
The grounds courts most often accept:
- Undue burden. The request is so broad or invasive that compliance would be unreasonable, such as a demand for every message a user has ever sent across every server.
- Privileged or protected material. The data is covered by attorney-client privilege, work product protection, or another recognized privilege.
- First Amendment concerns. Unmasking an anonymous speaker implicates the right to anonymous speech. Courts weigh the requesting party’s need for the information against the chilling effect on expression, with mixed results depending on the strength of the underlying claims.
- Overbreadth or irrelevance. The subpoena sweeps in data that has no connection to the case.
If the motion succeeds, Discord is relieved of any obligation to comply. If it fails, Discord will produce the data as directed. Discord can also move to quash or modify a court order on its own if compliance would be unusually burdensome, a right explicitly granted by § 2703(d).1Office of the Law Revision Counsel. 18 USC 2703 – Required Disclosure of Customer Communications or Records
What Discord Doesn’t Have
Not everything on Discord is retrievable. The company’s privacy policy states that Discord does not generally store the contents of voice calls, video calls, or streams.5Discord. Discord Privacy Policy Audio and video calls are also end-to-end encrypted, meaning even Discord cannot access their contents in transit.6Discord. End-to-End Encryption for Audio and Video A subpoena demanding “all voice chat recordings” will likely produce nothing.
Deleted accounts are another dead end, though not immediately. Discord first places the account on a 15-to-30-day hold in case the deletion was accidental. After that, identifying information is removed, but some data can persist in backups for another 30 to 45 days before the backups are purged. Email addresses and phone numbers are retained for 180 days after deletion for trust and safety purposes, extended to two years if the account was flagged for policy violations.7Discord. How Long Discord Keeps Your Information A deletion started today will not fully purge for roughly two to three months, and preservation requests trump deletion entirely.
Requests From Outside the United States
Discord is a U.S.-based company, and its legal obligations are governed primarily by U.S. law. Foreign law enforcement generally cannot serve U.S. legal process directly. Instead, international authorities typically use Mutual Legal Assistance Treaties or similar cross-border mechanisms to obtain Discord user data, a process that often takes months. Preservation requests under § 2703(f) exist in part to keep the data frozen while that slower machinery runs.
