If you divorce after one year of marriage, what you are entitled to is a share of whatever property and debt the two of you accumulated during that year, possibly a short stretch of spousal support, and custody or child support arrangements if you have children together. You are not entitled to benefits that require longer marriages, most notably Social Security on your ex-spouse’s record. Because the marital pool is usually small after twelve months, most one-year divorces end with each spouse keeping what they brought in and splitting what they bought together.
What Counts as Marital Property After One Year
Marital property is essentially anything either of you acquired during the marriage, regardless of whose name is on the title or account.1Legal Information Institute. The line blurs when separate and marital assets get mixed together. This is called commingling, and it is where short-marriage divorces get complicated fast. If you deposited paychecks earned during the marriage into a savings account you opened before the wedding, those pre-marriage funds are now tangled with marital earnings. If your spouse put labor or marital income into renovating a home you owned before the wedding, part of that home’s value may now be marital. The spouse claiming an asset is separate generally has to trace its origins through bank records and documentation. Even after only a year, sloppy record-keeping can make the tracing difficult.
A valid prenuptial agreement changes this analysis by fixing in advance what stays separate and how anything shared gets divided. Courts generally enforce prenuptial agreements when both spouses signed voluntarily with full financial disclosure.
How Your State Divides It
Forty-one states and Washington, D.C. use equitable distribution, where a judge divides marital property in whatever way seems fair given the circumstances. In both systems, courts weigh each spouse’s finances, earning capacity, and contributions to the marriage. Contributions do not have to be financial; a spouse who managed the household or supported the other’s career gets credit. After only a year, though, there usually is not much to argue over.
Whether You Can Get Spousal Support
Spousal support (alimony) is awarded far less often after short marriages, and when it is awarded, the amounts and duration tend to be small. Most states treat marriages under roughly seven years as short-term for alimony purposes, and many courts apply a strong presumption against awarding alimony at all for marriages that brief.
When support does come through after a one-year marriage, it is almost always rehabilitative, meant to give the lower-earning spouse enough time to finish a degree, gain job skills, or otherwise become self-supporting. Debts You May Still Be Responsible For

Courts often look at who actually incurred the debt and who benefited. A student loan one spouse took out for their own education, or a credit card run up on personal expenses, is more likely to stay with the person who used it. One detail matters more than most people expect. A divorce decree assigning a debt to your ex-spouse does not release you from the obligation to the creditor. If both names are on a loan and your ex stops paying, the lender can still come after you. The practical move is to pay off joint debts before the divorce is final, refinance them into one spouse’s name alone, or plan for the possibility of default in your settlement.
Retirement Accounts
Even one year of marriage can create a claim on retirement benefits. Contributions to a 401(k), pension, or similar account made during the marriage are generally marital property. The pre-marriage balance and its growth typically stay separate, but marital-year contributions and their investment gains are fair game.

After a one-year marriage the marital portion is often small enough that spouses negotiate an offset instead. One keeps the full retirement account and gives up an equivalent value in other assets, avoiding the several hundred dollars in attorney and plan-administrator fees a QDRO typically requires. Any offset needs to account for taxes, because a dollar in a pre-tax retirement account is worth less than a dollar in a regular bank account once income tax on withdrawal is factored in. If You Have Children
Children change the calculus more than any other factor, and the length of the marriage has almost no bearing on custody or support decisions. Courts decide both based on the child’s best interests.
Legal custody covers who makes major decisions about the child’s education, healthcare, and religious upbringing. Physical custody determines where the child lives day to day. Either can be sole or joint. Judges look at each parent’s stability, the child’s bonds with each parent, each parent’s willingness to support the child’s relationship with the other, and any history of abuse or neglect. Every state calculates child support through statutory guidelines that draw on both parents’ incomes, the number of children, and the custody arrangement. Orders commonly include medical support: one parent may be required to carry health insurance for the child, and uninsured medical costs are typically split. What You Are Not Entitled To
Two entitlements people often assume come with marriage do not apply after just one year.

Annulment as an Alternative
Because the marriage was short, some people wonder whether annulment is available instead of divorce. An annulment declares the marriage legally void, as if it never happened, while a divorce ends a valid marriage. The distinction can strip away many of the entitlements above, including claims to marital property, spousal support, and any share of retirement benefits.
Annulment is not available just because a marriage was brief. You need specific legal grounds, typically fraud or misrepresentation by one spouse, bigamy, inability to consent due to mental incapacity or intoxication, marriages between close relatives, underage marriage, or concealment of significant facts like a criminal history or existing children. Falling out of love or regretting the marriage does not qualify.
When an annulment is granted, courts generally return each spouse to their pre-marriage financial position. Each person keeps their own assets and debts, and there is no marital property to divide because, legally, the marriage never existed. One exception is a “putative spouse,” someone who genuinely believed the marriage was valid; some states let putative spouses claim property rights and support similar to a divorce.
