The DMX estate is being administered under New York’s intestacy rules because the rapper, born Earl Simmons, died in April 2021 without a will. That means his 15 children stand to split whatever is left in equal shares once paternity is confirmed and the estate’s debts, including a reported $700,000 owed to the IRS, are paid. The Westchester County Surrogate’s Court has been supervising the process for years, and final distributions are still not settled.
Who Inherits When There Is No Will
New York’s Estates, Powers and Trusts Law section 4-1.1 controls. When a person dies with children but no surviving spouse, the entire estate passes to the children in equal shares, by representation.1New York State Senate. New York Estates, Powers and Trusts Law 4-1.1 – Descent and Distribution of a Decedents Estate There is no discretion for the court to honor verbal promises or informal arrangements.
Two women who might have expected a claim did not get one. DMX divorced Tashera Simmons in 2016, so she was not a surviving spouse. She later sued the estate arguing she owned half of his copyrights, trademarks, and likeness rights from their 16-year marriage; a judge ruled against her. His fiancée Desiree Lindstrom petitioned to be recognized as a common-law wife, which would have put her ahead of the children on the priority list. The court rejected that petition because New York does not recognize common-law marriage. With no spouse in the picture, the children take everything.
Proving Paternity for 15 Children
DMX had 15 children by nine different women, and not all of them can automatically claim a share. Children born within a marriage inherit as a matter of course. Children born outside of marriage have to establish paternity under EPTL section 4-1.2, which offers three paths:2New York State Senate. New York Estates, Powers and Trusts Law 4-1.2 – Inheritance by Non-Marital Children
- A court order of paternity entered during the father’s lifetime, or a formal acknowledgment filed with New York’s public health records.
- A witnessed, notarized instrument in which the father acknowledged paternity, filed with the state within 60 days.
- Clear and convincing evidence, typically genetic testing or proof that the father openly treated the child as his own.
The third path is what most contested claimants will rely on. Because DMX is deceased, DNA testing generally means comparing a claimant’s sample against a confirmed biological relative, such as a sibling, aunt, uncle, or grandparent. One trap for anyone assuming child support settled the question: the statute is explicit that a child support agreement alone does not establish inheritance rights without a formal paternity order or acknowledgment.2New York State Senate. New York Estates, Powers and Trusts Law 4-1.2 – Inheritance by Non-Marital Children A person who received support payments for years could still be shut out without independent proof.
Any confirmed heirs who are minors get a court-appointed guardian to protect their interests, and cash distributions for children under 18 typically go into restricted accounts that release only at the age of majority.
Who Is Running the Estate
Without a will naming an executor, the court had to appoint administrators through the petition process in Article 10 of the Surrogate’s Court Procedure Act.3New York State Senate. New York Surrogates Court Procedure Act Article 10 – Intestate Administration DMX’s three eldest sons from his marriage to Tashera Simmons, Xavier, Tacoma, and Sean, were appointed temporary co-administrators.
They are fiduciaries. Their job is to collect assets, manage bank accounts, respond to creditor claims, and preserve the estate’s value while the paternity questions and other disputes work through the court. Administrators must post a bond as a financial guarantee of faithful performance, though interested parties can consent to waive or reduce it.4New York State Senate. New York Code SCP 805 Once letters of administration issue, they have nine months to file a full inventory of estate assets. Miss that, and the court can revoke their authority and cut off their commissions.
The role carries personal exposure. An administrator who pays the wrong creditor first, distributes to someone who turns out not to be an heir, or lets the estate lose value can be held personally liable for the loss.
Debts Come Before Heirs, and the IRS Comes First
The children see nothing until the estate’s debts are satisfied. DMX’s financial life was heavy on obligations, and reports at the time of his death put the IRS debt for unpaid federal income taxes at roughly $700,000, with other creditors on top of that.
Federal law puts the government at the front of the line. Under 31 U.S.C. section 3713, when a deceased debtor’s estate cannot pay all its debts, federal claims are paid first, and an administrator who pays other creditors ahead of the government can be personally liable for the unpaid federal claim.5Office of the Law Revision Counsel. 31 USC 3713 – Priority of Government Claims That gives the IRS real leverage over how any available cash gets allocated.
Other creditors have a window to make themselves heard. New York gives them seven months from the date letters of administration issue to file claims. The administrators verify each one and pay according to the legal hierarchy: administrative expenses and taxes, then secured creditors, then everyone else. When paper assets outpace liquid ones, property may need to be sold or royalty streams redirected to cover the shortfall.
Federal estate tax is a separate question. It applies only if the total value at death exceeds the basic exclusion amount, which was around $11.7 million in 2021 when DMX died.6Internal Revenue Service. Whats New – Estate and Gift Tax Given the reported debt load, the net taxable estate may sit below the threshold, but the administrators still had to run the numbers and file the appropriate returns.
The Music Catalog and Likeness Rights
The most valuable piece of the estate is almost certainly DMX’s music catalog. It generates income from streaming royalties, radio, sync licenses for film and television, and mechanical royalties, and revenue typically spikes after an artist’s death before settling into a longer-term pattern. His posthumous album, Exodus, was released on Def Jam in May 2021, weeks after his death, and featured Jay-Z, Nas, Lil Wayne, and others. Every dollar it earns flows into the estate.
The IRS expects the fair market value of intangible property to be reported. Appraisers usually take an income approach: analyze historical earnings, project future revenue based on streaming and licensing trends, and discount that to present value. The IRS accepts this capitalization-of-income method and also looks at comparable catalog sales, though a true comparable for a hip-hop catalog of this size is hard to find.7Internal Revenue Service. Publication 561, Determining the Value of Donated Property
Likeness rights are more complicated because of timing. New York’s post-mortem right of publicity law, Civil Rights Law section 50-f, protects a deceased person’s name, image, and voice from unauthorized commercial use for 40 years after death.8New York State Senate. New York Civil Rights Law 50-F The statute took effect on May 29, 2021 and applies only to people who died on or after that date. DMX died on April 9, 2021, about seven weeks earlier. The estate has to look to other legal theories to protect his likeness, and that gap may limit what merchandising and endorsement rights are worth.
There is one real tax benefit for the heirs. Under federal law, property passing through an estate gets a step-up in basis to fair market value as of the date of death.9Office of the Law Revision Counsel. 26 USC 1014 – Basis of Property Acquired From a Decedent If the children eventually sell the catalog, they owe capital gains tax only on appreciation above that reset value, not on the original production costs from decades ago.
The Copyright Termination Window Coming in 2033
Federal copyright law gives authors, and after their death their heirs, the right to reclaim rights they transferred to a publisher or label 35 years after the original grant.10Office of the Law Revision Counsel. 17 USC 203 – Termination of Transfers and Licenses Granted by the Author DMX’s debut album came out in 1998, so his children could begin exercising termination rights over those early recordings around 2033. For a multi-platinum catalog, that future right may be worth more than the current royalty stream, and it cannot be waived by contract.
The termination interest, with no surviving spouse, is divided among the children per stirpes, so they collectively hold the entire interest. A majority of the interest must agree to exercise the termination.10Office of the Law Revision Counsel. 17 USC 203 – Termination of Transfers and Licenses Granted by the Author Getting 15 children to line up on any single decision is its own hurdle.
The Planning Lesson
Nearly every problem the DMX estate has run into traces back to the missing will. A will could have named an executor, acknowledged each child directly, created trusts for the minors, spelled out who controls the music catalog, set the royalty split, and addressed digital assets and future uses of recorded performances. The paternity fights, the common-law marriage petition, the competing administrator claims, and the missed publicity-rights window were all avoidable.
The Surrogate’s Court has been working the case for years, legal fees keep drawing down the pool, and what the children ultimately receive is still unsettled. For anyone with children, intellectual property, or both, that is the practical takeaway.
