Drugs in Egypt: Laws, Penalties, and Arrest Procedures

The drug laws in Egypt are among the strictest in the world: simple possession or use of any controlled substance is a felony carrying mandatory prison time, and trafficking, production, or cultivation can carry the death penalty. The governing statute, Anti-Narcotics Law No. 182 of 1960, applies equally to Egyptian citizens and foreign visitors, and not knowing the rule is not a defense. Substances that are legal, decriminalized, or routinely prescribed elsewhere, including CBD and common ADHD medications, are treated as prohibited narcotics at an Egyptian border.

What Egypt Treats as a Controlled Substance

Egypt organizes prohibited drugs into schedules modeled on international narcotics conventions. Schedule 1 covers the most dangerous substances, including cannabis, opium, heroin, and a growing list of synthetic compounds that the government updates regularly to capture newly emerging drugs. Synthetic cannabinoids sold under street names like “Voodoo” and “Strox” have been added by name in successive amendments.

There is no minimum quantity threshold. The presence of a listed substance on your person, in your luggage, or in your bloodstream is enough to trigger prosecution, and prosecutors do not need to prove you knew the item was illegal.

Prescription Medications You Cannot Bring

This is where well-meaning travelers get into the most trouble. Several medications prescribed routinely in the United States and Europe sit on Egypt’s Schedule 1 and cannot be brought into the country at all, even with a prescription from your home doctor. Explicitly banned substances include amphetamine and dexamphetamine (the active ingredients in Adderall), methylphenidate (Ritalin, Concerta), and methadone in any form.

Medications You Can Bring With Documentation

Controlled medications outside the absolutely prohibited schedules, including certain codeine-containing painkillers, anti-anxiety medications such as diazepam, and some sleep aids, may be carried in with proper documentation. You need an official letter from your prescribing doctor listing your condition, the medication name and dosage, and the exact quantity you are carrying, and confirming the medication is for personal use only. CBD and Hemp Products

Egypt treats all cannabis derivatives as prohibited narcotics, including cannabidiol. CBD oil, edibles, topical creams, and any hemp-derived product will be handled at a customs checkpoint the same way marijuana would be, regardless of THC content or how the product is marketed at home. Penalties for Personal Use and Possession

Possession of any controlled substance for personal use is a felony. Convictions carry mandatory prison sentences, typically starting at a minimum of one year and climbing sharply with the type and quantity of the substance, plus substantial fines. Egyptian law separates “use” from “possession,” but both lead to custody. A fine-only outcome is not on the table.

Sentences frequently use the term “rigorous imprisonment,” which means incarceration with compulsory hard labor. It is not an administrative label; prisoners serving rigorous sentences are assigned to manual work during their terms. First-time offenders should not expect leniency, because mandatory minimums leave judges little discretion to sentence below the statutory floor.

Penalties for Trafficking, Manufacturing, and Cultivation

Trafficking, smuggling, manufacturing, and possessing quantities that suggest intent to distribute are treated as capital offenses. Importing, exporting, or possessing controlled substances for trafficking purposes carries life imprisonment with hard labor and fines. The most serious offenses, including producing or extracting narcotics, cultivating prohibited plants, and organizing drug distribution networks, carry the death penalty. For civilian offenders, execution is by hanging.

Several factors can turn what looks like a possession case into a trafficking prosecution: the quantity seized, scales or packaging materials, financial records tied to drug sales, or involvement in an organized group. Egyptian courts do not need proof of a completed sale to convict on trafficking charges. Possession plus circumstantial evidence of intent is enough.

Testing Positive Is Its Own Offense

Enforcement does not stop at catching people holding drugs. If police stop you for any reason and a blood or urine test reveals a controlled substance, that result alone can form the basis of a criminal charge. Evidence of recent drug use, even from consumption in another country before your flight, can support a prosecution once you are on Egyptian soil.

What Happens If You Are Arrested

After a drug-related arrest, police or officers from the Anti-Narcotics Administration conduct initial questioning, which in practice often begins before a lawyer arrives. How Long You Can Be Held Before Trial

For offenses punishable by more than three years, which includes virtually all drug charges, an investigating judge can order detention in 15-day increments. The total pre-trial detention period generally cannot exceed one quarter of the maximum sentence for the offense, or six months, whichever is shorter. Charges carrying the death penalty are the critical exception. For capital drug offenses such as trafficking or production, the 15-day detention period can be extended for as long as the investigation requires, with no hard cap. Bail

Bail exists in Egyptian law but is rarely a realistic option in serious drug cases. For offenses carrying more than three years of imprisonment, a judge has discretion to release a defendant on a pledge with or without bail, but only if satisfied that release will not lead to flight or prejudice the investigation. For offenses punishable by death, bail is effectively unavailable, so anyone accused of distribution-level offenses should expect to remain in custody through trial.4University of Minnesota Human Rights Library. Consular Access

If you are a foreign national, ask the arresting officers to contact your embassy immediately. Dual nationals face a harder situation. Egypt treats anyone holding Egyptian citizenship as Egyptian first, regardless of any other passport. If you hold both U.S. and Egyptian citizenship, Egyptian authorities will not notify the U.S. Embassy of your detention, will not share information about the charges, and consular officers need special authorization from Egyptian authorities just to visit you. Court proceedings are conducted in Arabic. The law provides for interpretation, but availability and quality vary in practice, and hiring a private Egyptian criminal defense attorney is strongly advisable. Anyone facing drug charges in Egypt should expect the process to be slow, the conditions difficult, and the outcome almost certainly to involve a prison sentence.
