Emigrating to Australia Over 45: Visa Options and Regional Pathways

You can still emigrate to Australia over 45, but the main door most skilled migrants walk through is closed to you. The General Skilled Migration program treats 45 as a hard cutoff, and no combination of experience, qualifications, or English proficiency overrides it. What remains is a smaller set of routes: employer sponsorship with narrow age exemptions, regional migration agreements, the National Innovation Visa, and family-based visas that carry no age limit at all.

Why 45 Closes the Skilled Migration Door

Australia’s points-tested skilled visas rank candidates on age, English, work experience, and education. Applicants aged 40 to 44 receive 15 points for age. At 45, you receive zero, and the SkillSelect system will not invite you to apply. The minimum pass mark is 65 points, and competitive invitation rounds often sit well above that, so even the 40-to-44 bracket is difficult in practice.

The cutoff is measured at the moment of invitation. If your 45th birthday falls after the invitation but before you lodge the application, eligibility typically survives. The policy rationale is that Australia wants migrants who will spend decades in the workforce, and the same logic drives similar age limits across other visa categories.

Employer-Sponsored Permanent Residency

The Employer Nomination Scheme (subclass 186) is the primary employer-sponsored path to permanent residency, and it generally requires applicants to be under 45 when they apply. The exemptions are narrow and tied to specific roles rather than salary alone. Under the Direct Entry stream, you can be over 45 if you are nominated as a university academic at Level B or above, or if you work as a scientist, researcher, or technical specialist at a high skill level for an Australian government science agency or university.1Department of Home Affairs. Employer Nomination Scheme Visa (Subclass 186) Direct Entry Stream

A separate transitional path exists for people who held or had applied for a subclass 457 temporary work visa on or before April 18, 2017. Under the Temporary Residence Transition stream of the 186, those workers can apply up to age 50. The 457 was abolished in 2018 and replaced by the subclass 482 (Temporary Skill Shortage) visa, so this window applies to a shrinking group of long-term temporary residents.

The Skilled Employer Sponsored Regional visa (subclass 494) follows a similar structure, with age exemptions for academics, scientists, and certain 457 or 482 holders who earned at or above the Fair Work high income threshold during their sponsorship period. That threshold is currently $183,100 per year and adjusts on July 1 each year.2Fair Work Commission. High Income Threshold The 494 also requires you to live and work in a designated regional area.

Regional Agreements That Raise the Age Limit to 55

Designated Area Migration Agreements (DAMAs) are negotiated between the federal government and specific regional authorities to fill local labor shortages. Several agreements raise the age limit to 55 for nominated occupations, which materially widens options for skilled workers over 45 who are willing to settle outside major cities.3Migration South Australia. DAMA Concessions Concessions vary by region and occupation, so not every role qualifies. DAMAs typically feed into the subclass 482 temporary visa and later transition to permanent residency through the 186 or 494, so the age concession has to carry through both stages of the process.

The practical constraint is finding an employer in a participating region willing to sponsor you. DAMA regions tend to be rural or remote, and the eligible occupations lean toward trades, healthcare, and hospitality more than corporate roles. For someone with matching skills and real flexibility about location, this is one of the more accessible options after 45.

The National Innovation Visa

The subclass 858 National Innovation Visa replaced both the former Global Talent Visa and the Business Innovation and Investment Visa (subclass 188, which closed to new applications on July 31, 2024). It is a permanent visa for people with an internationally recognized record of exceptional achievement in specific priority sectors.4Department of Home Affairs. National Innovation Visa

Priority sectors sit in two tiers. Tier one covers critical technologies (including AI, quantum computing, robotics, and cybersecurity), renewables and low-emission technologies, and health industries. Tier two covers agri-food and agricultural technology, education, and defence and space capabilities.5Department of Home Affairs. National Innovation Visa Priorities If your expertise falls outside these sectors, this visa is effectively unavailable regardless of how accomplished you are.

You need a nominator with a national reputation in your field who is an Australian citizen, permanent resident, eligible New Zealand citizen, or an Australian organization.4Department of Home Affairs. National Innovation Visa You also need to demonstrate earning capacity at or above the Fair Work high income threshold ($183,100 as of July 2025), shown through a current salary, an Australian job offer, or evidence that your field commands that level of compensation.2Fair Work Commission. High Income Threshold Patents, international awards, and significant media coverage of your work strengthen an application.

The official visa page does not specify an age limit, which makes the NIV one of the more promising options for highly accomplished professionals over 45 or over 55. The bar for exceptional and outstanding achievement is genuinely high. This is not a fallback for experienced professionals who are good at their jobs; it targets people whose work has had demonstrable impact at a national or international level.

Family and Partner Visas

Family-based migration has no age restrictions, which makes it the most straightforward path for anyone over 45 who has an Australian family connection.

Partner Visas

The onshore partner visa runs in two stages: a temporary visa (subclass 820) based on an initial assessment of your relationship, then a permanent visa (subclass 801) after a further assessment, typically two years later.6Department of Home Affairs. Partner Visa (Apply in Australia) Your partner must be an Australian citizen, permanent resident, or eligible New Zealand citizen. The application fee for most applicants is AUD 9,365, covering both stages.7Department of Home Affairs. Subclass 820 Partner Visa (Temporary) The Department of Home Affairs scrutinizes relationship evidence heavily, so financial interdependence, social recognition, and shared living arrangements all need documentation.

Parent Visas

The Contributory Parent visa (subclass 143) grants permanent residency to parents of a settled Australian citizen or permanent resident. Most applicants must pass a balance of family test, requiring that at least half of your children are Australian citizens, permanent residents living in Australia, or eligible New Zealand citizens living in Australia.8Department of Home Affairs. Balance of Family Test Applying as a retiree may waive the balance of family test and some other requirements.9Department of Home Affairs. Contributory Parent Visa

The cost is significant. The application starts at AUD 48,640 per person, paid in two installments, with additional charges for each family member included.9Department of Home Affairs. Contributory Parent Visa Processing times are lengthy because demand consistently exceeds the annual allocation. The non-contributory parent visa (subclass 103) costs far less upfront but carries wait times measured in decades.

Health, Character, and Skills Checks Bite Harder After 45

Every Australian visa requires health and character clearances, and both matter more with age.

Health examinations are conducted by panel physicians approved by the Department of Home Affairs. For applicants over 45, expect a more thorough exam. The assessment looks at whether your health condition could impose significant costs on the Australian healthcare system or affect access to services for Australian citizens. Ongoing treatment or specialist care may trigger additional scrutiny or requests for health waivers. The exam typically includes a physical, chest X-ray, and blood tests, with additional tests possible depending on your history and the visa.

Character clearances require police certificates from every country where you have lived for 12 months or more in the last 10 years. For Americans, that means an FBI Identity History Summary based on fingerprint submission, which may need apostille by the US Department of State for use in Australia. A “substantial criminal record” under Section 501 of the Migration Act 1958 can result in mandatory visa refusal, with the threshold including sentences totaling 12 months or more of imprisonment.10Department of Home Affairs. Character Requirements for Visas If you have any criminal history, get a migration lawyer’s assessment before you invest in an application.

Most employer-sponsored and skilled visas also require a positive skills assessment from a designated assessing authority. A skills assessment is typically valid for three years from issue, so timing matters: if it expires before you receive an invitation or lodge, you start again. From initial research to permanent residency, an employer-sponsored pathway after 45 realistically runs two to three years, including finding a sponsor, getting assessed, securing a nomination, and waiting for processing.

What Americans Should Know Before Moving

The United States taxes citizens on worldwide income regardless of where they live. Moving to Australia does not end your obligation to file annual US tax returns, pay estimated taxes, and report foreign financial accounts.11IRS. US Citizens and Residents Abroad Filing Requirements You will owe tax in both countries and rely on foreign tax credits and the US-Australia tax treaty to avoid double taxation.

If the combined value of your foreign financial accounts exceeds $10,000 at any point during the year, you must file a Report of Foreign Bank and Financial Accounts (FBAR) using FinCEN Form 114.12IRS. Report of Foreign Bank and Financial Accounts (FBAR) You may also need to file Form 8938 under FATCA if your foreign financial assets exceed higher thresholds.11IRS. US Citizens and Residents Abroad Filing Requirements The FBAR threshold is easy to hit once you open an Australian bank account and start receiving salary deposits.

Retirement savings are the sharpest edge. Australia’s superannuation system requires employer contributions to a super fund, but the IRS does not recognize Australian super funds the way it recognizes a 401(k) or IRA. Contributions and earnings in a super fund may be taxable in the US, and the tax treaty leaves real uncertainty about when and how accumulated super benefits get taxed for US persons. Direct transfers between a US 401(k) and an Australian super fund are not possible. If you are over 45 and have substantial US retirement savings, get specialized cross-border tax advice before you move; mistakes can lock funds into structures where they are taxed on entry, taxed on growth, and taxed again on withdrawal.

Healthcare has its own gap. Once you hold a permanent resident visa, you can enroll in Medicare, but enrollment is not automatic; you sign up through myGov or submit a form with supporting documents.13Services Australia. Enrolling in Medicare if You’re an Australian Permanent Resident Parent visa applicants are excluded from early enrollment while their application is pending. The United States does not have a reciprocal healthcare agreement with Australia.14Services Australia. Reciprocal Health Care Agreements During any period on a temporary visa before permanent residency is granted, you need private health insurance, and premiums rise with age, so budget for a gap that can stretch from months to years depending on the pathway.
