A workable Etsy shop policies template covers five required areas — returns and exchanges, cancellations, shipping, payments, and privacy — plus optional clauses for custom work, digital downloads, intellectual property, children’s product safety, and limitation of liability. Etsy requires a return policy on every physical listing, and the privacy section is a free-text field you’re legally responsible for. The structure below walks through what each section should say and the outside rules (FTC, GDPR, EU withdrawal rights, CPSC) that override anything you write to the contrary.
Where Policies Live in Your Shop
Policies are set in Shop Manager under Settings, then Policy Settings. You’ll find separate tabs for Returns and exchanges, Cancellations, Privacy, and Fixed. The returns tab offers standardized options; the privacy tab is a free-text box where you paste your own language. Etsy provides a sample privacy policy you can start from if you select “Create a policy” under the Privacy tab.1Etsy Help. How to Set Up Your Shop Policies Processing times are set separately, inside your shipping profiles under Shipping settings.2Etsy. How to Set Up Shipping Information
Returns and Exchanges
Every physical listing on Etsy must have a return policy attached, even if that policy is that you don’t accept returns.3Etsy. Refunds, Returns, and Exchanges for Sellers Etsy’s simple template applies a 30-day window from delivery for buyers to return or exchange.4Etsy. 5Etsy. Seller Policy – Our House Rules A “no returns” policy does not override this right for those buyers. If you ship internationally, acknowledge the withdrawal right in your policy so buyers know you’re aware of it. Custom items and perishables are exempt, which is covered further down.
Cancellations
If you can’t complete a transaction, Etsy requires you to message the buyer, cancel the order, and issue a full refund when payment has already been made.5Etsy. Seller Policy – Our House Rules Keep records of every refund you issue; proof of the refund is your defense if a dispute surfaces later.
Your policy should also address buyer-initiated cancellations. Common approaches: cancellations allowed only before production begins, or within a set number of hours after purchase. For made-to-order items where you’ve already bought materials or started work, it’s reasonable to state that cancellations aren’t possible once production has begun. Make that cutoff visible before checkout, not buried in fine print.
Shipping and Processing Times
Processing time is the window you need to prepare and ship an order, measured in business days. Weekend orders count as Friday orders for processing purposes.2Etsy. How to Set Up Shipping Information Be honest about how long production actually takes. Overcommitting is one of the fastest ways to tank your shop ratings; buyers forgive a realistic estimate far more readily than a missed promise.
The FTC 30-Day Default
Under the FTC’s Mail, Internet, or Telephone Order Merchandise Rule, if you don’t state a specific shipping timeframe, you’re required to have a reasonable basis for believing you can ship within 30 days of receiving payment.6Federal Trade Commission. Business Guide to the FTCs Mail, Internet, or Telephone Order Merchandise Rule If you can’t meet that deadline, you must notify the buyer and offer them the choice to wait or cancel for a full refund.7eCFR. 16 CFR Part 435 – Mail, Internet, or Telephone Order Merchandise A clearly stated longer timeframe at the point of sale satisfies the rule. Silence triggers the 30-day default, which matters most if you have a long production queue.
Payments
Payment language is simpler on Etsy because eligible sellers are required to use Etsy Payments, which accepts credit cards, debit cards, PayPal, Apple Pay, and other methods.8Etsy. Etsy Payments You don’t need to list individual methods in your policies. What this section should address is anything that happens around the payment itself: deposits on custom orders, payment plans if you offer them, and what happens to any deposit if an order is cancelled after production starts. If you collect a non-refundable deposit, state the amount or percentage and the exact conditions under which it’s forfeited.
Privacy Policy
The privacy tab is a free-text field. Every Etsy seller collects personal data through checkout — buyer name, email, shipping address, and payment details that Etsy passes along to fulfill the order. Your privacy policy needs to explain what you collect, why, who you share it with, and how long you keep it. Etsy’s sample policy covers the basics of data collection for order fulfillment and sharing with shipping carriers.9Etsy. How to Write On-Point Privacy Policies Where your customers live determines whether that’s enough.
GDPR Items for EU and UK Buyers
If you sell to anyone in the EU, the General Data Protection Regulation applies regardless of where your shop is based.10Your Europe. Data Protection Under GDPR The UK’s parallel version, UK-GDPR, works the same way for UK buyers. In practice, your privacy policy should cover:
- The legal basis for processing. For most Etsy sellers, this is contract fulfillment — the buyer placed an order and you need their address to ship it.
- How long you keep buyer data. The IRS generally requires business records to be kept for at least three years from when you filed the return, with longer periods for specific situations like bad debt deductions, which extend to seven years.11Internal Revenue Service. Topic No. 305, Recordkeeping
- Buyer rights under GDPR, including the right to request access to personal data you hold, correct inaccurate data, or request deletion.12GDPR Info. Art. 15 GDPR – Right of Access by the Data Subject
- Contact information for privacy inquiries — your Etsy shop email or a dedicated address.
California (CCPA)
The California Consumer Privacy Act applies only to for-profit businesses meeting at least one of three thresholds: more than $26.625 million in gross annual revenue, handling the personal information of 100,000 or more California residents, or deriving 50% or more of annual revenue from selling personal information.13California Privacy Protection Agency. Frequently Asked Questions Most individual Etsy sellers sit well below these thresholds and don’t need CCPA-specific language. If your shop has scaled significantly or operates as part of a larger business, check whether you qualify.
Custom Items and Digital Downloads
Standard return rules don’t fit either category, and vague language is where sellers lose money.
Custom and Personalized Goods
Under EU law, goods made to a buyer’s specifications are exempt from the 14-day right of withdrawal, and the same exemption covers perishables.14EUR-Lex. Directive 2011/83/EU of the European Parliament and of the Council Etsy’s seller policy acknowledges these exceptions.5Etsy. Seller Policy – Our House Rules The exemption protects you only if your policy explicitly states that custom orders become final once production begins. “All sales final” without distinguishing custom from ready-made items is weaker than a clause that specifically identifies the personalized nature of the product. State the point of no return plainly: “Once your custom order enters production, it cannot be cancelled or returned because it is made specifically for you.”
Digital Downloads
Digital files lose their right of return the moment the download begins, provided the buyer gave prior consent and acknowledged waiving the withdrawal right.14EUR-Lex. Directive 2011/83/EU of the European Parliament and of the Council On Etsy, digital purchases deliver instantly, so this consent happens at checkout. Your policy should still state that digital items are non-refundable once downloaded, and separately address what the buyer can do if a file is corrupted or doesn’t match the description. That’s a different situation from buyer’s remorse and should be handled differently.
Intellectual Property Clause for Custom Orders
If you accept custom orders where buyers supply images, logos, or designs, you need a clause addressing copyright. Etsy holds sellers responsible for ensuring they have the rights to every piece of content in their shop.15Etsy. Intellectual Property Policy – Our House Rules When a buyer sends a copyrighted image they don’t own and you print it, you’re both exposed, but Etsy will act against your shop first.
Your policy should state that by submitting artwork or images for custom production, the buyer represents they hold the legal right to use that material. This doesn’t make you bulletproof, but it shifts some responsibility to the person providing the content. Etsy can disable listings, shops, or entire accounts for IP violations, and repeat offenders lose selling privileges permanently.15Etsy. Intellectual Property Policy – Our House Rules
Children’s Products
If you sell items designed or intended for children 12 and under, federal safety rules add requirements that go beyond shop policy language. The Consumer Product Safety Commission requires children’s products to undergo third-party testing and be accompanied by a written Children’s Product Certificate demonstrating compliance with applicable safety rules.16CPSC. Children’s Products The certificate must include seven specific elements covering product identification, the safety rules tested against, manufacturer information, and testing dates and locations.17CPSC. Children’s Product Certificate You can’t opt out by labeling a product “not for children” if it’s clearly designed for kids; CPSC looks at design, marketing, packaging, and common consumer recognition. If you sell children’s items, your policies should note that products meet applicable CPSC safety standards and that documentation is available on request.
Limitation of Liability
A limitation of liability clause caps your financial exposure. The standard approach for small sellers is to limit total liability to the purchase price of the order, so if a buyer claims damages beyond what they paid — lost profits from a delayed shipment, say — your maximum obligation is a refund. Keep the language simple. Courts are less likely to enforce vague or confusing limitation clauses, especially in consumer contracts, and some jurisdictions restrict certain caps outright. Place the clause in the Fixed or additional information section where buyers can read it before purchasing.
If you sell items that could cause injury (candles, bath products, food, toys), a disclaimer is not a substitute for product safety testing and insurance. No policy clause protects you from a legitimate product liability claim the way insurance does.
How Etsy’s Purchase Protection Overrides Your Policies
Most policy templates skip this, and it’s the most important thing to understand. Etsy runs a Purchase Protection program that can override your shop policies. If a buyer’s order doesn’t arrive, arrives damaged, shows up more than seven days past the estimated delivery window, or differs significantly from the listing description, Etsy may issue a full refund regardless of what your return policy says.18Etsy. Etsy’s Purchase Protection Program
If a buyer contacts you about a problem and you don’t resolve it within 48 hours, they can open a case with Etsy. Once a case is open, Etsy may resolve it automatically, including by issuing a refund from your account.19Etsy. Cases Policy – Our House Rules When Etsy asks for information about a case, you have two calendar days to respond; silence works against you.
The practical takeaway: your shop policies govern situations Purchase Protection doesn’t cover, like buyer’s remorse on a correctly described, timely delivered item. For everything else, Etsy’s rules sit on top of yours. A “no refunds under any circumstances” policy will not prevent Etsy from refunding a buyer whose package never showed up. The real protection is operational, not textual: ship with tracking, photograph items before packing, and answer buyer messages fast.
