Family Code 4057: Grounds for Child Support Guideline Deviation

Under California Family Code Section 4057, the child support amount produced by the statewide guideline formula is presumed to be the correct amount, and a parent who wants a different figure must prove one of six specific grounds by a preponderance of the evidence. The court starts every case at the formula number. If neither parent puts on evidence justifying a change, that number becomes the order without further analysis.

What the Presumption Means in Practice

Section 4057(a) calls the guideline result a “rebuttable presumption affecting the burden of proof.”1California Legislative Information. California Code FAM 4057 Two consequences follow. The parent asking for a different amount carries the burden. And that parent must show it is more likely than not that the guideline figure is unjust or inappropriate for the family’s situation.

Any deviation also has to stay “consistent with the principles set forth in Section 4053.” Those principles include the ideas that both parents share responsibility for supporting their children, that children should share in both parents’ standard of living, that the guideline is presumptively correct, and that private resources should meet a child’s needs before public assistance does.2California Legislative Information. California Code, Family Code FAM 4053 A judge who deviates has to explain how the new amount still honors them.

The Six Grounds for Deviating from the Guideline

Section 4057(b) lists six factors that can justify a departure from the formula amount. The parent requesting the deviation has to prove the factor applies, and the court has to document its reasoning.1California Legislative Information. California Code FAM 4057

Stipulated Agreement Between the Parents

Parents can agree to a different number. The court will not approve a below-guideline stipulation, though, unless both parents declare that they are fully informed of their rights, that the agreement is voluntary and not the product of coercion, that the amount is in the children’s best interests, and that the children’s needs will be adequately met.3California Legislative Information. California Code FAM 4065

The parties also have to confirm that no public assistance is being received and no application is pending. If the local child support agency is involved, it has to sign off on the stipulation. If the children are on CalWORKs, the agency cannot agree to a below-guideline amount at all. And parents should know that stipulating to a below-guideline amount forfeits an important protection: either side can later ask the court to move the order up to the guideline level without proving any change of circumstances.3California Legislative Information. Deferred Sale of the Family Home

When a court postpones the sale of the family home under Family Code Sections 3800 through 3810 so the children can stay in it, the parent living there receives a housing benefit that the formula misses. If the fair rental value of the home exceeds the combined mortgage, insurance, and property tax payments, the court may adjust support to reflect that gap. The adjustment cannot exceed the difference between rental value and those housing costs.1California Legislative Information. California Code FAM 4057

Extraordinarily High Income

When the paying parent earns so much that the formula produces an amount exceeding the children’s needs, the court can reduce the order. The statute does not define “extraordinarily high,” so judges decide case by case, looking at documented expenses for food, housing, clothing, education, extracurriculars, and a reasonable standard of living.1California Legislative Information. California Code FAM 4057 A court taking this route still has to honor the principle that children share in both parents’ standard of living, so the reduction cannot leave the children with a lifestyle far below what the paying parent enjoys.

Custodial Time Without Matching Contribution

The formula assumes both parents spend money on the children during their respective parenting time. When that assumption breaks down, this factor applies. If a parent has substantial custodial time but is not actually spending at a level that matches it, the court can adjust the support amount.1California Legislative Information. California Code FAM 4057 This cuts both ways. A custodial parent might use it to argue for more support; a paying parent might use it to show the other side’s time does not translate into real spending on the children.

Low-Income Adjustment Cap

Section 4055 already includes a low-income adjustment, but the formula can still consume more than half of a low-income parent’s net disposable income after that adjustment. Factor 5 allows a further reduction so child support does not exceed 50% of net disposable income. Any reduction is capped at the amount by which the order exceeds that 50% threshold.1California Legislative Information. California Code FAM 4057

Special Circumstances

The last factor is a catch-all. The statute gives four examples but says the list is not exhaustive:1California Legislative Information. California Code FAM 4057

  • Different timeshare schedules for different children, such as when two siblings live primarily with one parent and a third lives primarily with the other.
  • Roughly equal timeshare where one parent spends a much larger percentage of income on housing than the other.
  • Children with special medical or other needs that push actual costs above the formula amount.
  • A child with more than two legal parents, a situation California recognizes but the standard two-parent formula does not handle cleanly.

The “unjust or inappropriate” language gives judges real flexibility here, but it is not open-ended. The parent asking for the deviation still has to show concrete evidence connecting the special circumstance to a specific dollar impact.

What the Court Must Put on the Record

A deviation is not final until the court makes findings. Section 4057(b) requires compliance with Family Code Section 4056, which says the court must state three things in writing or on the record whenever it departs from the guideline amount:4California Legislative Information. California Code FAM 4056

  • The exact dollar figure the guideline formula would have produced.
  • The specific reasons the guideline amount is unjust or inappropriate, tied to the evidence and to one or more of the six deviation factors.
  • The reasons the ordered amount serves the children’s best interests.

An order missing any of these findings is vulnerable on appeal. Either parent can also request additional written findings, including each parent’s net monthly disposable income, tax filing status, deductions from gross income, and percentage of custodial time.4California Legislative Information. California Code FAM 4056 Asking for those findings up front is worth doing if there is any chance of a later challenge.

Changing the Order After It Is Entered

An order entered under Section 4057 is not permanent. Family Code Section 3651 lets either parent ask for a modification at any time if the court finds it necessary.5California Legislative Information. California Code, Family Code FAM 3651 In practice, the parent seeking the change usually has to show a material change in circumstances since the last order, such as a significant income change, a job loss, a shift in custodial time, or a new medical need for the child.

The below-guideline stipulation carries its own rule. If the current order came from a Section 4065 agreement below the formula amount, either parent can seek a modification up to the guideline level without proving any change in circumstances.3California Legislative Information. California Code FAM 4065

Timing is critical. A modified order generally cannot be made retroactive earlier than the date the motion was filed.6California Legislative Information. California Code, Family Code FAM 3653 Support that accrued before that filing date is locked in. Waiting months after a job loss to file the paperwork means paying the old amount for those months with no way to recover the difference. File promptly.
