To ship fireworks legally in the United States, you need a product that carries a federal explosives approval number, a contract with a private ground carrier that accepts hazardous materials, completed hazmat training, DOT-compliant packaging and shipping papers, a 24-hour emergency response phone number on the paperwork, and confirmation that fireworks are legal where the package is going. The U.S. Postal Service will not carry them at all. FedEx will not carry them. UPS will only carry them under a hazmat contract with shippers who have regular volume and demonstrated compliance. Everything below assumes you are working within those constraints.
Who Will Actually Carry the Package
USPS prohibits all fireworks and pyrotechnic devices in the mail without exception. Publication 52 states, “All explosives are nonmailable. This includes all fireworks and other common pyrotechnic devices.”1United States Postal Service. Publication 52 – Hazardous, Restricted, and Perishable Mail Knowingly mailing fireworks violates 18 U.S.C. ยง 1716 and carries up to one year in prison, a fine, or both.2Office of the Law Revision Counsel. 18 US Code 1716 – Injurious Articles as Nonmailable
FedEx lists fireworks among items it does “not accept for delivery” across its services.3FedEx. How to Ship Hazardous Materials UPS lists common fireworks as prohibited but notes that certain prohibited items “will be accepted by UPS on a contractual basis for shippers with regular volume and the ability to comply with all applicable laws and regulations.”4UPS. List of Prohibited and Restricted Items for Shipping In practice, individuals and small businesses cannot hand a box of Roman candles across the counter at a UPS Store. You need a hazmat agreement, regular volume, and demonstrated compliance capability before UPS will take the package.
No carrier ships fireworks by air domestically. Ground service is the only option. Standard retail shipping locations such as franchise storefronts and office supply stores cannot accept hazardous materials. Shipments move through a dedicated hazmat customer counter, a regional terminal, or a scheduled pickup arranged with your account representative.
The Product Itself Must Be Approved
Before a consumer firework can legally enter the transportation system, it must carry either an EX number issued by the Pipeline and Hazardous Materials Safety Administration or an FC number issued by a DOT-approved Fireworks Certification Agency.5Pipeline and Hazardous Materials Safety Administration. Fireworks The EX number is the traditional route: the manufacturer submits an application including chemical composition, and PHMSA tests and approves the device. The FC number is a newer alternative where a private certification agency reviews the firework against industry standards and assigns a classification number.6eCFR. 49 CFR 173.65 – Fireworks Certification Agency Shipping a firework that lacks one of these numbers is a federal offense. Consumer fireworks ride under the proper shipping name “Fireworks,” UN identification number 0336, hazard class 1.4G.7Pipeline and Hazardous Materials Safety Administration. Hazmat Training Comes Before the First Box
Anyone who prepares, offers, or transports fireworks shipments must complete hazmat employee training before handling a package. Federal rules require general awareness of hazmat regulations, function-specific training on the tasks the employee actually performs, safety training covering emergency response and package handling, and security awareness. Training must be refreshed at least once every three years from the date of the last completed training.8Pipeline and Hazardous Materials Safety Administration. Hazmat Transportation Training Requirements Employers must keep training records for each hazmat employee for the length of employment plus 90 days after they leave.9eCFR. 49 CFR 172.704 – Training Requirements
Packaging, Markings, and Shipping Papers
The outer packaging must be heavy-duty and meet DOT performance standards for hazardous materials. Retail boxes do not qualify. Orientation arrows are required on two opposite vertical sides so handlers keep the box upright.
The outer package must display the proper shipping name and UN identification number. For consumer fireworks that means “Fireworks,” “UN0336,” and the hazard class 1.4G. Characters must be at least 12 mm high on standard packages; packages under 30 kg or 30 liters may use characters at least 6 mm high.10eCFR. 49 CFR 172.301 – General Marking Requirements for Non-Bulk Packagings The consignor’s or consignee’s name and address must also appear on the package.
Every fireworks shipment must travel with a shipping paper that includes four pieces of information for the hazardous material: the UN identification number, the proper shipping name, the hazard class or division number, and the total quantity by weight or volume.11eCFR. 49 CFR 172.202 – Description of Hazardous Material on Shipping Papers
The 24-Hour Emergency Response Number
The shipping paper must include an emergency response telephone number monitored at all times while the shipment is in transit. The person answering must know the specific material being shipped and be able to provide comprehensive emergency response information. Answering machines, beepers, and call-back services do not satisfy the rule.12eCFR. 49 CFR 172.604 – Emergency Response Telephone Number
Most shippers use a third-party service, and CHEMTREC is the most widely used. If you register with a provider, you must give them current information on the specific materials before handing the package to the carrier. The provider’s name or contract number must appear on the shipping paper near the telephone number.13eCFR. 49 CFR 172.604 – Emergency Response Telephone Number Contracting directly with CHEMTREC runs roughly $1,000 per year for the first location, though industry association memberships can reduce that.
What It Costs and How Long It Takes
Every carrier that accepts fireworks charges a hazardous materials handling surcharge on top of the ground rate, per package. For 2026, FedEx charges $57.25 per package for hazmat ground shipments.14FedEx. 2026 Changes to FedEx Surcharges and Fees UPS charges $58.00 per package for ground dangerous goods.15UPS. Revised Rates for Value-Added Services and Other Charges A multi-box shipment multiplies quickly, and CHEMTREC registration, specialized packaging, and training time all sit on top.
Transit times run longer than standard parcels because packages move only by truck and often follow routing restrictions that keep them away from certain tunnels and densely populated corridors. Carriers require a signature on delivery for dangerous goods.16FedEx. Signature Requirements and Delivery Options The signature level depends on carrier policy and shipper instructions. Packages containing explosives will not be left on a doorstep.
State Law at the Destination Can Undo a Legal Shipment
Federal law governs how fireworks move through the transportation system. State law governs whether the recipient can legally possess what arrives. One state bans all consumer fireworks outright. Roughly 18 states plus the District of Columbia restrict consumers to non-aerial, non-explosive devices such as sparklers and fountains. Some states regulate fireworks at the county level, so legality can change across a county line. The remaining states allow most consumer fireworks with varying permit and seasonal restrictions.
Shipping fireworks into a jurisdiction where they are restricted or banned exposes both sender and recipient to state criminal charges even when every federal requirement was met. Verify the law in both the origin and destination jurisdictions before shipping. Legal responsibility falls on the shipper, not the carrier.
Penalties
As of late 2024, the maximum civil penalty for a single hazmat transportation violation is $102,348. If the violation results in death, serious injury, or substantial property destruction, the maximum rises to $238,809. Each day a violation continues counts as a separate offense.17eCFR. 49 CFR Part 209 Subpart B – Hazardous Materials Penalties
Criminal prosecution is reserved for knowing or reckless violations and carries up to five years in prison, a fine, or both. If the violation involves the release of a hazardous material that causes death or bodily injury, the maximum doubles to ten years.18Office of the Law Revision Counsel. 49 USC 5124 – Criminal Penalty The statute does not require you to know the specific regulation you broke; recklessness a reasonable person would recognize is enough.
These penalties reach everyone in the chain: the person who packed the box, the person who filled out the shipping paper, and the company that offered the package for transport. Mislabeling contents, skipping the approval process, and using a carrier that has not authorized you for hazmat shipments are each separate violations that can each trigger their own penalty.
