Under FDA Food Code Section 3-201.14, fish received for sale or service must be commercially and legally caught or harvested, or approved for sale or service by a regulatory authority.1Food and Drug Administration. FDA Food Code 2022 Full Document That sourcing rule is the first checkpoint, but it isn’t the only one. A shipment also has to arrive cold enough, look and smell right, carry the correct paperwork if it’s shellfish or destined for raw service, and be labeled accurately. If any of those fail, the delivery gets refused.
Sourcing: Commercial, Legal, or Approved
Every fish product entering the establishment must be either commercially and legally harvested or specifically approved for sale or service. Recreationally caught molluscan shellfish are flatly prohibited from commercial use.1Food and Drug Administration. FDA Food Code 2022 Full Document A local angler’s cooler of clams cannot go on the menu, no matter how fresh it looks.
Section 3-201.11 reinforces this by requiring that all food come from sources complying with applicable law, and food prepared in a private home cannot be used or offered in a food establishment.2Food and Drug Administration. FDA Food Code 2022 Chapter 3 Food The wholesaler, distributor, or direct supplier needs to operate under proper licensing and regulatory inspection. That paper trail is where compliance begins.
Temperature at the Point of Delivery
Fish is a time-and-temperature-control-for-safety food. Under Section 3-202.11, refrigerated fish must arrive at 41°F (5°C) or below.1Food and Drug Administration. FDA Food Code 2022 Full Document Don’t take the driver’s log at face value. Use a calibrated probe thermometer and check the internal temperature yourself. A reading even a few degrees above 41°F is grounds for rejection.
Frozen fish follows a separate standard. Any product labeled and shipped frozen by a food processing plant must be received frozen, and the shipment cannot show evidence of previous temperature abuse.1Food and Drug Administration. FDA Food Code 2022 Full Document Warning signs include large ice crystals on the surface of the fish, water stains or frost damage on the packaging, and soft or spongy texture that suggests thawing and refreezing during transit. Any of those means the cold chain broke, and the shipment should go back.
Sensory and Physical Checks
A thermometer misses quality problems that your eyes and nose will catch. Fresh whole fish should have clear, shiny eyes, firm flesh that springs back when pressed, and red gills with no off-putting odor. Fillets should show no discoloration, darkening, or drying around the edges.3Food and Drug Administration. Selecting and Serving Fresh and Frozen Seafood Safely
Refuse the shipment if the fish smells sour, fishy, or like ammonia. Ammonia signals decomposition has already started, and cooking won’t fix it. Cloudy or sunken eyes, dull grey gills, and flesh that holds an indentation all point to product that has been out of safe conditions too long. Fish sold as “previously frozen” may lack the bright appearance of truly fresh product, but it should still smell mild.3Food and Drug Administration. Selecting and Serving Fresh and Frozen Seafood Safely When in doubt, turn it away.
Shellstock: Tags, Invoices, and the 90-Day Rule
Oysters, clams, and mussels carry a traceability burden that other seafood doesn’t. Every container must arrive with a source identification tag or label affixed by the harvester or dealer, showing the harvester’s identification number assigned by the shellfish control authority, the date of harvesting, and the most precise identification of the harvest location the control authority allows.4Food and Drug Administration. New Food Code Update: Maintaining Molluscan Shellfish Identification When contaminated shellfish sicken people, public health officials have to trace product back to a specific body of water within hours.
The 2022 Food Code update expanded acceptable documentation. Invoices are now acceptable for tracing molluscan shellfish back to the source, provided they include the dealer’s name and address, certification number, harvest location, harvest or shucking date, type and quantity, and any sell-by or best-if-used-by dates.4Food and Drug Administration. New Food Code Update: Maintaining Molluscan Shellfish Identification
Tags or labels stay attached to the container until it’s empty. When the last shellfish leaves the container, record that date on the tag, label, or invoice. Keep the documentation on file for 90 calendar days afterward, organized chronologically.4Food and Drug Administration. New Food Code Update: Maintaining Molluscan Shellfish Identification If shellfish are transferred to a different container before a customer orders them, source identification must be preserved, and product from different harvest batches cannot be mixed.
Parasite Destruction Before Raw or Undercooked Service
Fish served raw, raw-marinated, partially cooked, or marinated-partially-cooked must be treated to destroy parasites before service. Section 3-402.11 gives three freezing protocols:
- Frozen and stored at −4°F (−20°C) or below for at least 168 hours (seven days).
- Frozen at −31°F (−35°C) or below until solid, then stored at −31°F (−35°C) or below for at least 15 hours.
- Frozen at −31°F (−35°C) or below until solid, then stored at −4°F (−20°C) or below for at least 24 hours.
Certain tuna varieties are exempt, including yellowfin, bigeye, and both northern and southern bluefin. Aquaculture-raised fish such as farm-raised salmon may also qualify, but only if the fish were fed formulated feed containing no live parasites and, when raised in open water, were kept in net-pens. The supplier has to be able to document that those conditions were met.
Section 3-402.12 requires written records of the freezing temperature and duration for every batch of fish served raw. Those records stay on file at the establishment for 90 calendar days after the fish is sold or served. If you’re receiving product intended for raw service, ask for the supplier’s freezing documentation at delivery and file it alongside your own records.
Histamine-Forming Species Deserve Extra Scrutiny
Tuna, mahi-mahi, marlin, and bluefish produce dangerous levels of histamine when they sit at unsafe temperatures for even a few hours. The resulting illness, scombrotoxin poisoning, is one of the most common forms of seafood-related food poisoning.5Food and Drug Administration. Fish and Fishery Products Hazards and Controls Guidance Chapter 7 – Scombrotoxin (Histamine) Formation
Cooking doesn’t destroy histamine. Once it forms, the fish is unsafe no matter how it’s prepared. Toxic levels can develop within six to 12 hours of exposure without ice or refrigeration.6Food and Drug Administration. Scombrotoxin Poisoning and Decomposition When accepting tuna, mahi-mahi, or marlin, verify the 41°F threshold immediately and refuse anything above it. If the truck was delayed or the ice melted during transit, the damage may already be done even if the current reading looks close to acceptable.
Labeling to Verify at Receiving
Retailers that sell raw seafood directly to consumers face labeling obligations under 7 CFR Part 60. Grocery stores, supermarkets, and club warehouse stores must label wild and farm-raised fish and shellfish with the country of origin and the method of production, stated as “wild” or “farm-raised.” Marketing phrases like “ocean caught” or “line caught” don’t satisfy the requirement.7eCFR. 7 CFR Part 60 – Country of Origin Labeling for Fish and Shellfish Imported fish that undergoes substantial transformation in the United States gets a dual label: “From [country], processed in the United States.” A “Product of the U.S.” label requires meeting the U.S.-origin definition in the regulation.
Separately, the FDA requires seafood products to use an acceptable market name so that species substitution and mislabeling can be identified. The FDA’s Seafood List is the reference for recognized names.8Food and Drug Administration. The Seafood List – FDAs Guide to Determine Acceptable Seafood Names Using a generic group name like “snapper” for a different species entirely is the kind of substitution proper labeling is meant to prevent. Check that the product name on the invoice matches what’s in the box before you sign for the delivery.
