Form NR is how you ask UK Visas and Immigration to reconsider a refused British citizenship application. There is no statutory right of appeal against a nationality decision, so this administrative review is the only route inside the Home Office before judicial review becomes the next option.1GOV.UK. Form NR – Reconsideration of Decisions to Refuse British Citizenship The form works when you can show the caseworker got the law wrong, departed from published policy, or missed evidence you had already provided. It does not work as a second bite at persuasion on the same facts.
When Form NR Will Be Accepted
The Home Office publishes the situations where it will reopen a refused nationality file. These include cases where the caseworker used the wrong legal requirements, refused because a response was on file but not linked to it, decided before allowing enough time for enquiries to come back, refused on character grounds based on a conviction that was later quashed or involved mistaken identity, or failed to consider documents already in Home Office possession.1GOV.UK. Form NR – Reconsideration of Decisions to Refuse British Citizenship
Errors of law are the strongest ground. Where a refusal reads as a mechanical application of policy with no engagement with your individual circumstances, that inflexibility is itself challengeable: the Home Office may adopt policies but must apply them with room for exceptions, as the court held in R (Hiri) v Secretary of State for the Home Department.2CaseMine. Hiri v Secretary of State for the Home Department
Certain arguments will not get you anywhere. The Home Office will not normally reconsider where the applicant simply failed to respond to enquiries or to arrange a citizenship ceremony, though it may do so in exceptionally compelling circumstances. It also rejects reconsideration requests founded on length of residence in the UK, the convenience of a British passport, cultural or ancestry connections, or past military service.1GOV.UK. Challenging a Good Character Refusal
Good character refusals are the most commonly contested. Under the current guidance, an applicant will normally be refused if they have received a custodial sentence of 12 months or more, in the UK or overseas, or if consecutive sentences add up to at least 12 months. The guidance also targets persistent offenders, anyone who has caused serious harm, and individuals with sexual offences or entries on a register such as the Sex Offenders Register. A Sexual Harm Prevention Order, Sexual Risk Order or similar order still in force will normally produce a refusal on its own, regardless of the sentence length.3GOV.UK. Nationality Policy – Good Character
Applications made before 31 July 2023 were assessed against a different framework: an automatic refusal for a custodial sentence of four years or more; a 15-year wait from the end of sentence for terms between 12 months and four years; a 10-year wait for sentences under 12 months; and three years since the date of a non-custodial sentence or out-of-court disposal.3GOV.UK. Nationality Policy – Good Character If your refusal letter applied the wrong set of thresholds to your application date, that is a direct policy error to raise on the form.
Completing the Form
Download the current version of Form NR from GOV.UK and check the publication date before submitting; using an outdated version causes delays.4GOV.UK. Application for Review When British Citizenship Is Refused – Form NR You will need your Home Office reference number and any case identification codes from the original nationality application, along with personal details that match the Nationality Review Team’s records.
The section asking why the refusal was wrong is where the request succeeds or fails. Be specific. Reference the exact paragraphs of your refusal letter and explain why each conclusion is wrong. If the caseworker misapplied a section of the British Nationality Act 1981 or departed from published policy, name the provision or the guidance passage.5legislation.gov.uk. British Nationality Act 1981 General complaints that the decision was unfair carry little weight; the reviewing officer needs a concrete reason to reach a different conclusion.
Attach evidence for every argument. For residency disputes, that means documents like P60s, employer letters, or tenancy agreements covering the contested period. For good character disputes, updated financial records or letters from professional bodies can help. Any document not in English or Welsh needs a certified translation. Always include a copy of the original refusal letter so the reviewer can see immediately what is being challenged.

Fee and Refunds
The reconsideration fee as of April 2025 is £513.6GOV.UK. Fees for Citizenship Applications and the Right of Abode From 9 April 2025 Nationality fees are updated each April, so check the current figure on GOV.UK before you pay. Payment goes through the official nationality fees payment slip or the designated online portal before mailing.
If reconsideration succeeds and the original refusal is overturned, the £513 fee is refunded.7GOV.UK. Immigration and Nationality Refunds Policy A refusal caused by Home Office administrative error is not treated as a ground for a fee refund under the standard refunds policy; that kind of maladministration complaint is handled instead through a separate ex gratia payments process, which can cover costs beyond the application fee on a case-by-case basis.8GOV.UK. Immigration and Nationality Refunds Policy
Your Immigration Status While You Wait
Filing Form NR does not protect your right to remain in the UK. Section 3C of the Immigration Act 1971 extends existing leave only when you make an in-time application to vary that leave. A citizenship application is not an application to vary leave, so neither the original citizenship application nor the reconsideration request triggers Section 3C protection.9GOV.UK. 3C and 3D Leave
If your underlying leave expires while reconsideration is pending, you could become an overstayer. Anyone whose leave is close to expiring should make a separate application to extend their immigration permission, independent of the citizenship reconsideration.
Advisers
You are not required to use a legal representative for Form NR. If you do instruct an immigration adviser, they must be regulated. The Office of the Immigration Services Commissioner classifies nationality reconsideration work by complexity: a Level 1 OISC adviser can handle straightforward cases such as the Home Office overlooking submitted information or deciding prematurely, but a reconsideration arguing the decision was wrong in law must be handled by an adviser authorised at a higher level.10GOV.UK. Guidance on Competence 2021 – Level 1 – Advice and Assistance Solicitors regulated by the Solicitors Regulation Authority can also represent you.
Outcome and Timing
There is no officially published processing time for reconsideration, and the wait varies. The outcome is binary. If the original refusal is overturned, you will receive instructions about arranging your citizenship ceremony, and the reconsideration effectively grants what was previously refused. If the refusal is upheld, the review letter should set out the reasons, and that letter matters for any judicial review because the court will look at whether the Home Office properly engaged with the evidence and arguments you raised.
If Reconsideration Fails
With no statutory appeal, judicial review is the next route. Under the Civil Procedure Rules a claim must be filed promptly and in any event no later than three months after the grounds for the claim first arose.11Justice UK. Part 54 – Judicial Review and Statutory Review Three months is the outer limit, not a target: courts have refused claims filed within three months that were not considered prompt enough.
Before issuing a claim you must follow the pre-action protocol. That means a formal letter before claim to the Home Office identifying the decision being challenged, summarising the facts and legal basis for the claim, and naming any interested parties. The letter should normally use the standard format at Annex A of the protocol, and for nationality cases it should be sent electronically to the Home Office’s Pre-Action Protocol email address or by post to the Litigation Allocation Unit. The Home Office is normally allowed 14 days to respond before you issue.12Justice UK. Pre-Action Protocol for Judicial Review
Judicial review is not a reassessment of whether you deserve citizenship. The court examines whether the Home Office followed the law and its own policies. If the decision is found unlawful, the court will typically send the case back for a fresh decision rather than grant citizenship directly. Legal representation is strongly advisable, and legal aid may be available depending on your finances.
Honesty on the Form
Section 46 of the British Nationality Act 1981 makes it a criminal offence to knowingly or recklessly make a false statement for the purpose of obtaining anything under the Act. The maximum penalty on summary conviction is three months’ imprisonment, an unlimited fine, or both.13legislation.gov.uk. British Nationality Act 1981 – Section 46
Separately, citizenship obtained through fraud, false representation, or concealment of a material fact can be stripped under Section 40(3). The guidance defines false representation as a deliberately dishonest claim that had a direct bearing on the application, and concealment as deliberately hiding a material fact rather than an innocent omission.14GOV.UK. Deprivation of British Citizenship If the earlier application contained a genuine error, the reconsideration is the moment to correct it plainly.
