Adopting a child in Germany means meeting statutory age and relationship requirements, passing a suitability assessment by the Youth Welfare Office (Jugendamt) or an accredited agency, living with the child through a probationary care period, and receiving a final decree from the Family Court. Once granted, the adoption is permanent: the child gains the full legal status of a biological child of the adoptive parents, including the family name and inheritance rights.1Gesetze im Internet. German Civil Code BGB – Section 1754 Effect of Adoption Every decision turns on whether the arrangement serves the child’s best interests.2Bundesportal. Who Can Adopt
A single applicant must be at least 25 years old. When a married couple adopts together, one spouse must be at least 25 and the other at least 21.3Gesetze im Internet. German Civil Code BGB – Section 1743 Minimum Age There is no statutory maximum age. Agencies commonly apply an informal guideline that the gap between the younger parent and the child should not exceed roughly 40 years.
Married couples, including same-sex married couples, must adopt jointly. One spouse cannot adopt alone unless the other is legally incapacitated or under 21.4Gesetze im Internet. German Civil Code BGB – Section 1741 Admissibility of the Adoption Same-sex couples have had full joint adoption rights since same-sex marriage became legal on October 1, 2017.
Unmarried couples cannot adopt jointly. Only one partner can be the legal adoptive parent. A draft reform bill would open joint adoption to unmarried partners, but as of early 2026 it has not been enacted. Single people can adopt, though agencies tend to prioritize couples and may approve a single applicant mainly when a bond with a specific child already exists.
The Suitability Assessment
Before you are approved to adopt, the Jugendamt or a state-recognized private agency examines whether you can offer a stable, loving home. Specialists look at your reasons for wanting to adopt, the stability of your relationship if you apply as a couple, your health, your finances, and your readiness to parent a child who may have experienced early disruption.5Hessian Portal for Administrative Services. The assessment usually includes:
- Preparation seminars where prospective parents learn what adoptive parenting actually involves.
- Individual interviews covering your personal history, family background, and motivation.
- Home visits by a caseworker.
- A written life report: an autobiographical account of your life stages, family relationships, partnership, and desire to adopt.
- Official documents including a police clearance certificate, a health certificate, and proof of income. You pay the fees for issuing these yourself.5Hessian Portal for Administrative Services. Determining the Suitability of Adoption Applicants for a Domestic Adoption
Only applicants who receive a positive suitability determination enter the pool of approved parents waiting for a match. A negative result ends the process, though you can reapply if your circumstances change.
Which Type of Adoption Applies
Full Adoption of a Minor
The standard route for children is full adoption (Volladoption). It severs the child’s legal ties to the birth family entirely and creates a new, permanent bond with you. The child takes the legal position of your biological child, with full inheritance rights and parental custody transferring to you.1Gesetze im Internet. German Civil Code BGB – Section 1754 Effect of Adoption The relationship to the birth parents and their relatives expires.2Bundesportal. Parental Responsibility for Minor Children – Section: Adoption The decision is effectively irreversible.
Step-Parent Adoption
Step-parent adoption (Stiefkindadoption) is the most common form of adoption in Germany. It lets you adopt your spouse’s or registered partner’s child from a previous relationship, and the stepchild becomes your legal child with the same rights as a biological child.6Hessian Portal for Administrative Services. Stepchild Adoption of a Child in Germany Both biological parents must consent.7Service Portal Bremen. Adopt a Stepchild If the other biological parent has had their parental rights terminated, is deceased, or is unknown, that consent requirement falls away.
A Note on Adult Adoption
Germany also permits the adoption of adults, but it operates under different rules and normally takes a weaker form that leaves ties to the birth family intact. It sits outside the scope of adopting a child.
How the Process Runs
Application and Counseling
Start by contacting your local Jugendamt or a state-recognized private adoption agency. You will receive mandatory counseling and then move into the formal application, submitting your documents and writing your life report while the suitability assessment gets under way. The paperwork and investigation stage generally takes between four and nine months.8U.S. Department of State. Germany Intercountry Adoption Information
Matching and Probationary Care
Once approved, you wait to be matched. There is no fixed timeline, and more approved parents are waiting than there are children available. When a match is found, the child moves into your home for a probationary care period (Adoptionspflege). This trial phase gives both sides time to bond, and the Jugendamt monitors how the relationship develops. The law requires the period to be “adequate in length” for the court to see whether a real parent-child bond has formed. In practice it typically lasts about a year.9City of Ettlingen. Consents
Two sets of consent are needed before finalization. The birth parents must agree to the adoption. For newborns, consent cannot be given until the child is at least eight weeks old, a cooling-off period that protects birth mothers from deciding too soon after delivery.10Bundesportal. Waiver by the Father of the Transfer of Custody If the child is 14 or older, they must personally consent as well.6Hessian Portal for Administrative Services. Stepchild Adoption of a Child in Germany
The Court Order
The final step is a proceeding before the Family Court (Familiengericht). You or your notary files a notarized adoption application.9City of Ettlingen. Procedure for Adoption as a Child – Applying for Adoption of Minors The court reviews the Jugendamt’s recommendation, confirms that all consents were properly given, and evaluates whether the adoption serves the child’s best interests. If everything is in order, it issues an adoption decree (Adoptionsbeschluss), and the child legally becomes yours.4Gesetze im Internet. What It Costs
Counseling and placement through the Jugendamt is free. What you do pay: notary fees for the adoption application, court fees at the Family Court, and the document-issuing fees for items like your police clearance and health certificate.11FAMILIENPORTAL.NRW. Adoption and Adoption Mediation: Costs Compared with many other countries, this is modest. Private adoption agencies may charge their own placement fees, which vary. Adopting from abroad is significantly more expensive because of accredited agency fees, travel, certified translations, and legal proceedings in two countries.
Adopting a Child From Abroad
Germany has been a party to the Hague Convention on Intercountry Adoption since March 1, 2002, and the Federal Office of Justice (Bundesamt für Justiz) is the national Central Authority for these cases.12Federal Office of Justice. Information on Intercountry Adoption You cannot handle an intercountry adoption on your own. German law prohibits unmediated foreign adoptions; the process must go through an accredited placement agency.13Gesetze im Internet. Act on Adoption Placement and Support – Section 2b Unmediated Foreign Adoption
The suitability assessment has two layers. Your local Jugendamt handles the general evaluation. The accredited international agency then conducts a country-specific evaluation to confirm you meet the requirements of the child’s country of origin.
After a foreign adoption is finalized abroad, it still needs to be recognized in Germany. Hague Convention adoptions with a certificate from the competent Central Authority are generally recognized automatically.14Bayernportal. Application for Recognition or Conversion of an Adoption of a Foreign Child Otherwise, you apply to the Family Court for a formal recognition ruling.15Bundesportal. Adoption – Application for Recognition or Conversion of an Adoption of a Foreign Child If the foreign adoption has weaker effects than a German full adoption, for example because it does not fully sever ties to the birth family, the court can convert it into a full German adoption on a notarized application.
Citizenship and Name After the Adoption
A child adopted as a minor by at least one German citizen on or after January 1, 1977, automatically acquires German citizenship. If the adoption took place outside Germany, it must meet the recognition requirements first.16Federal Foreign Office. Obtaining German Citizenship
Upon adoption, the child receives your family name. For a married couple, that is normally the shared marital name. The child’s previous family name ceases to apply.
