Government Debt Relief for Seniors: Student Loans, IRS, and Housing

Government debt relief for seniors comes through a handful of specific federal programs: student loan discharge for borrowers with a lasting disability, IRS settlement and hardship programs for back taxes, energy grants that pay overdue utility bills, and free HUD counseling to head off foreclosure. Federal law also shields most of your Social Security check from creditors. What these programs will not do is erase a private credit card balance or a medical bill from a private provider. For those, the practical relief is different: protecting the income and assets you still have.

What Federal Programs Can and Can’t Touch

The programs below apply to debts owed to, or guaranteed by, the federal government: federal student loans, IRS tax balances, HUD-insured mortgages. Private debt sits outside this system. But your income has a defense of its own. Section 207 of the Social Security Act makes benefits exempt from execution, levy, attachment, and garnishment by private creditors.1Social Security Administration. SSR 79-4 – Section 207 of the Social Security Act A credit card issuer or hospital cannot garnish your Social Security check. Once the money lands in your bank account, federal banking rules preserve that protection for two months.

The federal government itself is the exception. Through the Treasury Offset Program, it can intercept part of your benefits to collect delinquent federal taxes, defaulted federal student loans, and other federal debts. The first $9,000 a year, or $750 a month, is protected from offset.2Office of the Law Revision Counsel. 31 U.S.C. 3716 – Administrative Offset If an offset is causing genuine hardship, the Treasury Offset Program’s automated line at 1-800-304-3107 can tell you what’s being collected and how to dispute it.3Bureau of the Fiscal Service. Federal Student Loans

Total and Permanent Disability Discharge

A physical or mental condition that keeps you from working can qualify you to have federal student loans wiped out entirely under Total and Permanent Disability (TPD) discharge. It covers Direct Loans, FFEL Program loans, and Perkins Loans. A Parent PLUS loan you took out for a child or grandchild can be discharged too, based on your own disability.4eCFR. 34 CFR 685.213 – Total and Permanent Disability Discharge

There are three ways to qualify. If you already receive Social Security Disability Insurance or Supplemental Security Income and your next disability review is scheduled five to seven years out, your SSA notice of award is enough proof on its own. A physician, nurse practitioner, physician assistant, or licensed psychologist can certify that you have an impairment that has lasted, or is expected to last, at least 60 continuous months and prevents substantial gainful activity.5eCFR. 34 CFR 685.102 – Definitions Veterans determined unemployable due to a service-connected disability also qualify.

You apply through the Department of Education’s TPD Servicing center at studentaid.gov, or by mail to P.O. Box 300010, Greenville, TX 75403.6Federal Student Aid. Zero-Dollar Payments on Income-Driven Repayment

If you don’t qualify for disability discharge but live on modest Social Security or pension income, an income-driven repayment plan can drop your monthly payment to zero. Under the Income-Based Repayment (IBR) and Pay As You Earn (PAYE) plans, payments are calculated on income above 150% of the federal poverty level. When your income sits below that line, the required payment is $0.7eCFR. 34 CFR 685.209 – Income-Driven Repayment Plans A zero-dollar month still counts as a qualifying payment toward forgiveness after 20 or 25 years on the plan.

For a single-person household, 150% of the 2026 federal poverty level works out to roughly $23,000 in annual income. If your Social Security and pension combined come in below that, your IBR or PAYE payment is zero. The SAVE plan, which used a more generous 225% threshold, is blocked by a federal court order issued in March 2026; IBR, PAYE, and Income-Contingent Repayment remain available.8Federal Student Aid. One boundary worth knowing: Public Service Loan Forgiveness requires you to be employed full-time by a qualifying public service employer both when you make the 120 payments and when you apply.9Federal Student Aid. IRS Tax Debt

Offer in Compromise

An Offer in Compromise lets you settle a tax debt for less than you owe when your assets and income can’t cover the full balance, a standard the IRS calls “doubt as to collectibility.”10Internal Revenue Service. Topic No. 204 – Offers in Compromise The authority comes from 26 U.S.C. 7122.11Office of the Law Revision Counsel. 26 U.S. Code 7122 – Compromises

For seniors on fixed income, the arithmetic often works in your favor because projected future income is small. The application fee is $205, waived if your adjusted gross income falls below 250% of the federal poverty level.12Internal Revenue Service. Offer in Compromise You submit IRS Form 656 with Form 433-A (OIC), a detailed financial disclosure. Review typically runs seven to twelve months, and active levies and garnishments pause during that window. If the IRS doesn’t reject the offer within 24 months, it’s automatically accepted.11Office of the Law Revision Counsel. 26 U.S. Code 7122 – Compromises

Currently Not Collectible Status

When your monthly expenses consume your income and you have no meaningful assets, the IRS can place your account in Currently Not Collectible (CNC) status. The debt isn’t erased, but levies, garnishments, and seizures stop for as long as your financial picture stays the same.13Internal Revenue Service. Temporarily Delay the Collection Process Form 433-F, a simplified financial statement, is the usual request document.

CNC has a hidden edge for older debts. The IRS has 10 years from assessment to collect.14Office of the Law Revision Counsel. 26 U.S.C. 6502 – Collection After Assessment That clock keeps running while you’re in CNC. An Offer in Compromise, by contrast, pauses the clock during review. On a debt that’s already several years old, CNC can outlast the collection period entirely.

Installment Agreements and the Taxpayer Advocate

If you can pay something monthly but not the full balance, an installment agreement spreads it out. Balances up to $50,000 can be arranged online. Setup fees run from $22 for automatic bank withdrawals up to $178 for manual payments, and the direct-debit setup fee is waived when your income sits below 250% of the federal poverty level.15Internal Revenue Service. Payment Plans – Installment Agreements Interest and penalties keep accruing, but enforced collection stops.

When an application is rejected or stuck, the Taxpayer Advocate Service is a free, independent office inside the IRS that intervenes for you. You qualify if the debt is causing financial hardship, including trouble paying for housing, food, or medical care, or if the IRS has missed its normal timeframes. File Form 911 to open a case.16Taxpayer Advocate Service. Contact Us Case volume is high as of early 2026, so expect up to two weeks for an initial response.

Keeping the Utilities On and Staying in Your Home

LIHEAP for Overdue Energy Bills

The Low Income Home Energy Assistance Program provides grants that pay heating and cooling bills, including past-due balances that could trigger a shutoff. The income ceiling is 150% of the poverty level or 60% of your state’s median income, whichever is higher.17Office of the Law Revision Counsel. 42 U.S.C. 8624 – Applications and Requirements Households where someone receives SSI or SNAP automatically meet the income test. The statute directs states to reach out to households with elderly or disabled members, and payments generally go directly to the utility to reduce or clear the balance.

HUD Counseling for Mortgage Trouble

A HUD-approved housing counselor will work with your lender for free on loan modifications, repayment plans, and other alternatives to foreclosure. Reverse mortgage borrowers with a Home Equity Conversion Mortgage can access loss mitigation programs through the FHA’s National Servicing Center for loans in default or at risk of default.18U.S. Department of Housing and Urban Development. Avoiding Foreclosure

Move quickly. Once your lender sends the file to attorneys, usually around the fourth month of missed payments, legal fees start stacking onto the balance. Call a HUD counselor at 800-569-4287 or the Homeowners Hope Hotline at 888-995-HOPE before that point, and don’t set aside letters from the lender.

Property Tax Deferral

Most states run property tax deferral or exemption programs for homeowners 65 and older. Deferral turns the annual bill into a low-interest lien paid off when the home is sold or the owner dies, rather than a payment due now. Income limits and benefit sizes vary by state, so your county assessor’s office or state department of revenue is the place to check.

Medicaid Estate Recovery

Families are often blindsided by this one. Federal law requires every state to seek repayment from a deceased person’s estate for Medicaid benefits received after age 55, mainly nursing home and long-term care costs.19Office of the Law Revision Counsel. 42 U.S.C. 1396p – Liens, Adjustments, and Recoveries The state can file a claim against the home and other assets.

Protections exist. Recovery is blocked while a surviving spouse is alive, or while a child under 21 or a disabled child of any age lives in the home. Federal law also requires each state to run a hardship waiver process. Common grounds include the home being the sole income-producing asset for an heir, recovery depriving an heir of basic necessities, or administrative costs exceeding what would be collected. Criteria vary by state; if a recovery notice arrives, ask your state Medicaid office how to apply for a waiver.

How to Tell Real Relief From a Scam

Every program in this article is free or charges a modest government fee. A company that promises to erase your debt in exchange for a large upfront payment is running a scam. Federal law bars debt relief companies from charging fees before they’ve actually settled your debt.20Federal Trade Commission. Debt Relief Services and the Telemarketing Sales Rule

The patterns repeat. Callers impersonate the IRS or Social Security Administration, demand immediate payment by prepaid card, wire, or gift card, threaten arrest or loss of benefits, and spoof caller ID to show real government numbers. No federal agency operates that way. The IRS opens contact by mail, not by a phone call demanding instant payment. Social Security will not threaten to suspend your benefits over the phone.
