Virginia does not offer an automatic grace period for expired vehicle tags. Your registration expires on the last day of your assigned month, and the day after that you are driving illegally. The DMV Commissioner can declare a temporary grace period, but only in narrow circumstances, and it is not something an individual driver can request or rely on.
When Your Tags Actually Expire
Every Virginia registration expires on the last day of the twelfth month after it was issued.1Virginia Code Commission. Code of Virginia Title 46.2 – 646 Expiration and Renewal of Registration The DMV staggers expirations across all twelve months, so your deadline depends on when you first registered the vehicle. That month stays the same every year unless the Commissioner changes it.
The DMV sends a paper reminder about 90 days before expiration and follows up with email or text reminders around 30 days out.2Virginia Department of Motor Vehicles. Register Your Vehicle Missed reminders are not a defense if you get pulled over. If you moved and did not update your address, that is on you.
When the Commissioner Can Declare a Grace Period
Virginia law lets the DMV Commissioner declare a grace period, but the trigger has to be on the DMV’s side, not yours. It applies when the Commissioner finds good cause or when DMV systems are down long enough that people cannot reasonably complete their renewals. Think statewide outages, natural disasters, or emergencies that close DMV offices and take the online portal offline.
A separate provision lets the Commissioner extend expiring registrations when the Department cannot process renewals due to circumstances beyond its control, but only with the Governor’s authorization, and no single extension can run longer than 90 days.1Virginia Code Commission. A busy work week, a forgotten reminder, or a personal scheduling problem does not qualify. When a grace period is active, law enforcement cannot cite you solely for expired tags during that window. The moment it ends, normal penalties apply again.
What You Face if You Drive on Expired Tags
Driving a vehicle in Virginia without a valid registration is a Class 4 misdemeanor. It is the least severe misdemeanor class in Virginia, but it is still a criminal charge, and it carries a fine of up to $250. If your registration was revoked, canceled, or suspended rather than simply expired, the charge becomes a Class 3 misdemeanor with a fine of up to $500.3Virginia Code Commission. The knock-on effects usually cost more than the fine. Officers who cite you for expired tags will often check your insurance. If it has lapsed, you face a $600 non-compliance fee and an SR-22 filing requirement for three years on top of the registration charge.4Virginia Department of Motor Vehicles. What a Grace Period Would Not Cover
Even when the Commissioner does declare a grace period, it only extends the deadline for renewing your registration or replacing plates and decals. Every other obligation stays in force. Your liability insurance must remain active every day the vehicle is registered. Your annual safety inspection must stay current. If you live in a Northern Virginia emissions locality, that testing requirement is not paused either.
A grace period also does not reach backward. If your tags expired two months ago and no grace period was in effect during those two months, you were driving illegally the whole time, no matter what the Commissioner declares afterward.
How to Renew Before the Deadline
Virginia gives you three ways to renew:
- Online through the DMV website, which takes a $1 discount off your total. New decals arrive by mail within about 15 days.
- By mail, using the lower portion of your paper renewal reminder with payment. Same 15-day delivery window.
- In person at a DMV Select or full-service DMV office, with a completed Application for Registration (VSA 14).
Whichever method you pick, you have to certify that the vehicle carries the required liability insurance.2Virginia Department of Motor Vehicles. Register Your Vehicle The DMV calculates your fee automatically based on vehicle type and weight. Renewing as soon as the 90-day paper reminder arrives gives you plenty of buffer for mail delays and avoids the entire grace-period question.
What About the Inspection Sticker
Vehicle registration and the annual safety inspection sticker are separate requirements, and they are treated differently. Virginia requires every registered vehicle driven or parked on a public road to pass an annual safety inspection at an official inspection station.6Virginia Code Commission. Code of Virginia 46.2-1157 Inspection of Motor Vehicles Required Unlike your tags, an expired inspection sticker has a built-in grace period: law enforcement cannot pull you over for it until the first day of the fourth month after the sticker expired. A sticker that expired in January is not a valid basis for a stop until May 1.
Failing to have a current inspection is a traffic infraction, not a misdemeanor, and a court can dismiss the charge if you fix the problem and show proof.7Virginia Code Commission. There is no delay in when you can be stopped, and there is no fix-it dismissal built into the statute.
