Marriage benefits a man in concrete legal and financial ways: lower combined taxes in most households, automatic inheritance rights, guaranteed access to a spouse’s retirement accounts, Social Security spousal and survivor benefits, medical decision-making authority, job-protected leave to care for a sick spouse, automatic legal fatherhood of children born during the marriage, immigration priority for a foreign-born partner, and a form of property ownership that shields the home from one spouse’s individual creditors. None of these rights attach to a girlfriend, fiancée, or long-term partner.
A Lower Combined Tax Bill
For most couples, the biggest immediate benefit is federal income tax. The 2026 standard deduction for joint filers is $32,200, exactly double the $16,100 for a single filer, and the joint brackets are built to favor one-income or unequal-income households. The 24% bracket for joint filers covers taxable income up to $403,550 in 2026, while the same rate for a single filer tops out at $201,775.1Internal Revenue Service. IRS Releases Tax Inflation Adjustments for Tax Year 2026 When one spouse earns much more than the other, income that would have been taxed at a higher single rate drops into a lower bracket on the joint return.
The savings shrink as incomes equalize, and above the 32% bracket a two-high-earner couple can actually pay more jointly than they would as two single people. The 2026 joint threshold for the 35% bracket is $768,700, not the $1,281,200 that would be double the single threshold.1Internal Revenue Service. IRS Releases Tax Inflation Adjustments for Tax Year 2026 For most households that aren’t in that range, joint filing saves money.
One caveat: joint filers are jointly and severally liable for the full tax bill, including underpayments caused by the other spouse’s errors or omissions.2Office of the Law Revision Counsel. 26 USC 6013 – Joint Returns of Income Tax by Husband and Wife If a spouse underreports income, the IRS can collect from you. If one spouse carries federal student loans on an income-driven plan like PAYE, IBR, or ICR, joint filing uses combined income to calculate the monthly payment. Filing separately keeps the payment based on individual income but costs the student loan interest deduction and the Earned Income Tax Credit.4Federal Student Aid. 4 Things to Know About Marriage and Student Loan Debt Running both scenarios before the first married tax season is worth the time.
Social Security Spousal and Survivor Benefits
Marriage opens access to Social Security benefits built on a spouse’s earnings record. A husband can collect a spousal benefit of up to 50% of his wife’s primary insurance amount at full retirement age, and if his own retirement benefit is lower, the spousal amount tops him up.5Social Security Administration. Benefits for Spouses
Survivor benefits reach further. A widower at full retirement age collects 100% of the deceased spouse’s benefit. Reduced survivor benefits start as early as age 60, or age 50 with a disability, with the amount ranging from 71% to 99% of the deceased worker’s benefit depending on when the survivor claims.6Social Security Administration. Who Can Get Survivor Benefits A surviving spouse caring for a child under 16 receives 75% at any age.7Social Security Administration. Survivors Benefits
These benefits can survive a divorce. An ex-spouse who was married for at least 10 years can claim on the former partner’s record.8Social Security Administration. Who Can Get Family Benefits The 10-year rule is absolute. A marriage that ends at nine years and eleven months produces nothing.
Automatic Rights to a Spouse’s Retirement Accounts
Under ERISA, if a participant in a qualified plan like a 401(k) or pension dies, the account must be paid to the surviving spouse unless that spouse previously signed a written, notarized waiver consenting to a different beneficiary.9Office of the Law Revision Counsel. 29 USC 1055 – Requirement of Joint and Survivor Annuity and Preretirement Survivor Annuity A girlfriend or fiancée listed on the beneficiary form has no claim against a spouse who never signed the waiver.
The protection runs both directions. If your wife names her sibling as 401(k) beneficiary without your written, witnessed consent, the designation is invalid and the account goes to you. Pension plans must also offer married participants a joint-and-survivor annuity that continues payments after the participant’s death.
Inheritance Rights, Elective Share, and Estate Tax Portability
When a spouse dies without a will, state intestacy laws put the surviving spouse at or near the top of the line. A surviving husband typically receives at least half of the estate, and often all of it when the couple has no children from outside the marriage. The exact share depends on the state and whether the deceased left children or surviving parents.
A will that tries to leave the surviving spouse nothing generally doesn’t hold. Most states have elective share statutes letting a surviving spouse claim a minimum portion of the estate, usually around one-third to one-half, regardless of what the will says.
Marriage also unlocks the unlimited marital deduction: a spouse can transfer any amount to the other spouse during life or at death without federal gift or estate tax, as long as both are U.S. citizens.10Office of the Law Revision Counsel. 26 USC 2523 – Gift to Spouse11Office of the Law Revision Counsel. 26 USC 2056 – Bequests, Etc., to Surviving Spouse Retitling a house, funding a spouse’s investment account, or consolidating assets happens outside the ordinary gift tax limits that apply to everyone else.
For 2026, each person has a $15,000,000 federal estate tax exemption.12Internal Revenue Service. Whats New – Estate and Gift Tax Marriage effectively doubles that through portability. When the first spouse dies, the executor can file Form 706 to transfer any unused portion of the exemption to the survivor, so if the first spouse used $3,000,000, the survivor inherits the remaining $12,000,000 on top of their own $15,000,000.13Internal Revenue Service. Instructions for Form 706 The election must be made within five years of the death. Portability is a federal rule; most states with their own estate taxes don’t recognize it.
Medical Authority and Hospital Access
In a medical emergency, marriage replaces paperwork. Under the HIPAA Privacy Rule, healthcare providers can share a patient’s protected health information with a spouse involved in the patient’s care.14Department of Health and Human Services. HIPAA and Marriage In states that recognize spouses as healthcare decision-makers, the provider must treat the spouse as the patient’s personal representative, with full access to records and the right to make treatment decisions.15HHS.gov. Disclosures to Family and Friends
Federal hospital visitation rules at 42 C.F.R. 482.13(h) prohibit hospitals from discriminating in their visitation policies, and patients have the right to designate visitors.16U.S. Department of Health and Human Services. FAQs on Patient Visitation When a spouse is incapacitated, most states name the other spouse as the default healthcare surrogate. Without marriage, providers may defer to blood relatives who haven’t spoken to the patient in years. An unmarried couple can replicate some of this through a health care power of attorney, but marriage handles it automatically.
FMLA Leave and COBRA Continuation
The Family and Medical Leave Act gives eligible employees up to 12 weeks of unpaid, job-protected leave in a 12-month period to care for a spouse with a serious health condition.17GovInfo. 29 USC 2612 – Leave Requirement Eligibility requires 12 months with a covered employer, 1,250 hours in the prior year, and a worksite with 50 or more employees within 75 miles.18U.S. Department of Labor. Fact Sheet 28P – Taking Leave When You or Your Family Member Has a Serious Health Condition Under the FMLA Unmarried partners don’t qualify to use FMLA for each other.
If a husband is on his wife’s employer health plan and she loses her job or dies, COBRA keeps him on the group plan. Termination or a reduction in hours triggers 18 months of continuation coverage for the spouse. Death gets up to 36 months.19U.S. Department of Labor. An Employees Guide to Health Benefits Under COBRA The employer can charge the full premium plus a 2% administrative fee, so the cost often jumps. Access to the same plan during a crisis is still worth more than scrambling for individual coverage.
Automatic Legal Fatherhood
When a child is born to a married woman, her husband is automatically the legal father. This marital presumption operates in every state. The husband appears on the birth certificate, has standing to make medical decisions and participate in custody questions, and holds parental rights from the first day without genetic testing or court filings.
If the marriage later ends, the husband doesn’t have to prove biological parentage to keep his parental relationship. He already has full legal standing. Unmarried fathers typically have to sign a paternity acknowledgment or go to court to establish rights that the marital presumption confers automatically. Challenging the presumption is possible but time-limited, with state deadlines commonly running two to five years from the child’s birth. Once those windows close, the legal father-child relationship is generally permanent.
Immigration Priority for a Foreign Spouse
A U.S. citizen’s spouse is classified as an “immediate relative” for immigration, which carries no annual visa cap and no priority date wait.20U.S. Citizenship and Immigration Services. Green Card for Immediate Relatives of US Citizen Other family-based categories can involve waits of years or decades. A spouse already in the United States can file for adjustment of status without leaving the country, and the green card petition can be filed alongside the underlying family petition.
While the application is pending, the spouse can apply for work authorization and advance parole for international travel.20U.S. Citizenship and Immigration Services. Green Card for Immediate Relatives of US Citizen The citizen spouse files an Affidavit of Support (Form I-864) accepting financial responsibility. No other personal relationship offers this path.
Property Protection, With a Shared-Debt Trade-off
In roughly half the states, married couples can hold property as tenants by the entirety. A creditor with a judgment against only one spouse generally cannot seize or force the sale of property held this way, and neither spouse can sell, mortgage, or transfer the asset without the other’s consent. The protection ends at divorce or at the first spouse’s death.
The counterweight is the doctrine of necessaries, which most states have modernized into a gender-neutral rule. One spouse can be held responsible for the other’s essential expenses, particularly medical bills, even without agreeing to pay. The common exception is when the spouses were separated at the time the services were provided and the provider had actual notice of the separation. Household assets are shielded from one spouse’s individual creditors; household finances are exposed to the other spouse’s essential debts. Knowing both before merging accounts prevents surprises.
