Canada has no lookback window for a DUI. Border officers can see your full criminal history whenever you try to cross, so the real question behind “how far back does Canada check for a DUI” is not how many years they look, but whether enough time has passed, or the right application has been filed, to keep an old conviction from blocking you. For a single impaired driving conviction from before December 18, 2018, ten years after you finish your sentence can clear the problem automatically. For anything on or after that date, time alone will never fix it.
Why There Is No Simple Lookback Period
Canada does not judge your DUI by the label your state gave it. Officers translate the offense into its Canadian Criminal Code equivalent and apply Canadian penalties to decide whether you are admissible. A first-offense misdemeanor at home can carry the same immigration weight as a much more serious charge once it is mapped onto Canadian law.
The pivotal date is December 18, 2018. Before then, impaired driving in Canada carried a five-year maximum sentence, which placed it in the lower “criminality” tier of the Immigration and Refugee Protection Act. Bill C-46 raised that maximum to ten years, pushing impaired driving into “serious criminality” under Section 36(1).1Department of Justice Canada. Immigration and Refugee Protection Act SC 2001 c 27 – Section 36
Which tier applies to you depends on when you offended. Offenses before December 18, 2018 are assessed under the older, five-year framework, so a single DUI generally counts as ordinary criminality unless you actually served more than six months.2Canada.ca. Convicted of Driving While Impaired Offenses on or after that date fall into serious criminality no matter how lenient your actual sentence was.
The Ten-Year Automatic Reset
The closest thing to a lookback in Canadian immigration law is “deemed rehabilitation.” If your DUI happened before December 18, 2018 and it is your only conviction, you are automatically considered rehabilitated once ten years have passed since you finished every part of your sentence.3Department of Justice Canada. Immigration and Refugee Protection Regulations SOR/2002-227 – Section 18 There is no application, no fee, and no approval to wait for.
The clock does not start on the day you were convicted. It starts the day after you finish everything the court ordered: jail, probation, fines, and any driving prohibition.4Government of Canada. Rehabilitation for Persons Who Are Inadmissible to Canada Because of Past Criminal Activity If you were sentenced in 2012 but did not pay the final fine until 2014, your ten years run from 2014. Officers will ask for documentation, so bring court records that show the exact completion date of every piece of your sentence.
When Time Alone Will Not Fix It
Deemed rehabilitation is off the table for DUIs on or after December 18, 2018. Because the Canadian equivalent now carries a ten-year maximum, these offenses are classified as serious criminality, and the regulations exclude serious criminality from automatic rehabilitation.2Canada.ca. Convicted of Driving While Impaired Waiting will not clear a post-2018 DUI, no matter how many years pass.
Multiple convictions also change the calculation. Deemed rehabilitation covers a single conviction equivalent to a Canadian indictable offense. Two or more offenses that would each be summary conviction offenses in Canada can qualify after five years.5Canada.ca. Deemed Rehabilitation But if you have multiple offenses that would each be indictable in Canada, automatic rehabilitation is unavailable regardless of how much time has gone by. A formal application is the only path.
Criminal Rehabilitation: The Permanent Fix
When deemed rehabilitation does not apply, you can apply for Criminal Rehabilitation. Eligibility opens five years after you complete every part of your sentence, including probation and any driving prohibition.4Government of Canada. Rehabilitation for Persons Who Are Inadmissible to Canada Because of Past Criminal Activity Approval permanently resolves your inadmissibility for that offense.
The application is Form IMM 1444.6Government of Canada. Application for Criminal Rehabilitation IMM 1444 You submit certified court records, police clearance certificates from every jurisdiction where you have lived for six months or more since turning 18, and a copy of the foreign statute you were charged under so officials can map it to Canadian law. A personal statement explaining your rehabilitation rounds out the package.
Fees depend on classification: C$246.25 for ordinary criminality, C$1,231 for serious criminality.7Government of Canada. Citizenship and Immigration Application Fees – Fee List Processing generally runs over a year, so start well before any planned trip.
Temporary Resident Permits for Urgent Travel
If you need to enter Canada before you are eligible for rehabilitation, or while your application is pending, a Temporary Resident Permit is the only option. A TRP grants limited or one-time entry and expires; it is not a long-term solution, but it can get you across the border for a compelling reason.8Canada.ca. Temporary Resident Permit – Who Can Apply or Make a Request
Officers only issue a TRP when your need to enter outweighs any risk your presence might pose. Vacation does not qualify. An employment contract, a letter from a Canadian business partner, or medical documentation for a family emergency carries real weight. You will need the same background documents as a rehabilitation application, plus a persuasive statement of why entry is necessary. The fee is C$246.25.7Government of Canada. Expungements, Pardons, and Reduced Charges
A state-level expungement, record seal, or pardon does not automatically resolve inadmissibility. Canadian immigration law operates independently of the US system and does not recognize most foreign record dispositions the way your home state does.9Government of Canada. Overcome Criminal Convictions For pardons or discharges issued in another country, the Canadian government advises checking with the visa office serving your region to see whether the disposition is treated as valid.
Plea bargains offer less protection than you might expect. Canada looks at the Canadian equivalent of your conduct, not the label. Because many “wet reckless” statutes still reference impairment by alcohol, Canadian officials can treat them like a DUI. A standard reckless driving conviction, depending on the underlying facts, can also draw scrutiny.
Arrests Without Convictions
There is no presumption of innocence at the Canadian border. An arrest for impaired driving that never led to a conviction, or charges that were later dropped, can still show up in the databases Canadian officers use. Seeing an arrest with no conviction on record, an officer may assume the case is still pending and refuse entry on that basis.
If you were acquitted, had charges dismissed, or were never formally charged, you can usually enter provided you bring documentation of the outcome. Certified court records showing dismissal or acquittal are the simplest way to prevent a problem that should not exist in the first place.
What Happens at the Border
Screening starts the moment your passport is scanned. Primary inspection officers have indirect access to both the Canadian Police Information Centre and the FBI’s National Crime Information Center, which indexes US criminal records.10Federal Bureau of Investigation. Privacy Impact Assessment for the Fingerprint Identification Records System FIRS Integrated Automated Fingerprint Identification System IAFIS Any flag sends you to secondary inspection for a closer look.
In secondary, your documentation is what makes the difference. If you are relying on deemed rehabilitation, be ready to prove the exact date your sentence ended and that ten years have passed. If you hold an approved Criminal Rehabilitation or a TRP, present the originals. Officers have final discretion, and the time to sort out your admissibility is before you reach the booth, not during the interview.
