How Late Can a Telemarketer Call? The 9 PM Rule

A telemarketer cannot legally call you before 8:00 a.m. or after 9:00 p.m. in your local time zone. That’s how late a telemarketer can call. The window is set by the FCC’s rule under the Telephone Consumer Protection Act and independently by the FTC’s Telemarketing Sales Rule, and it’s measured by the clock where you are, not where the caller sits.1eCFR. 47 CFR 64.1200 – Delivery Restrictions2eCFR. 16 CFR Part 310 – Telemarketing Sales Rule A call center in California dialing a New York number at 9:30 p.m. Eastern is breaking the law, even though it’s 6:30 p.m. where the caller sits.

Weekends and Holidays Are the Same

Federal law makes no exception for Saturdays, Sundays, or holidays. The 8:00 a.m. to 9:00 p.m. window applies every day of the year.3Federal Trade Commission. Complying with the Telemarketing Sales Rule Some states go further, shortening the allowed hours on Sundays or holidays or trimming the evening cutoff on any day. Whichever rule gives you more protection controls. If your state cuts sales calls off at 8:00 p.m., that earlier cutoff wins even though federal law would allow the call until 9:00.

What to Do When a Call Comes in Too Late

Write the details down while the call is fresh. You’ll want them whether you report the caller, sue, or both.

  • The date and the exact local time the call came in.
  • The number that showed up on your caller ID, even if you suspect it’s spoofed.
  • Your own phone number that received the call.
  • Any callback number the caller gave you.
  • The company name the caller used and what they were selling.

Spoofed numbers still matter. Carriers are required to implement STIR/SHAKEN, an authentication framework that verifies caller ID as a call moves through the network, and even a fake number leaves a trail investigators can follow.4Federal Communications Commission. You can file with the FTC through the form at DoNotCall.gov and with the FCC at fcc.gov/complaints under the phone category.5Federal Trade Commission. Which Calls Aren’t Bound by the Hour Rule

Not every late call breaks the law, because not every caller is a telemarketer. A few categories sit outside the sales-call rules:

Debt collectors aren’t telemarketers, so the TCPA’s sales-call rules don’t govern them. They follow the Fair Debt Collection Practices Act, which happens to impose the same 8:00 a.m. to 9:00 p.m. window and also bars calls at any time the collector knows is inconvenient to you.10Consumer Financial Protection Bureau. One more wrinkle. A company you’ve bought from in the last 18 months, or made an inquiry to in the last three months, can make live sales calls to you under the established business relationship exemption even if you’re on the Do Not Call Registry.11Federal Trade Commission. Complying with the Telemarketing Sales Rule – Section: The Established Business Relationship Exemption Those live calls still have to stay inside the 8:00 a.m. to 9:00 p.m. window. And any prerecorded or automated marketing message needs your prior express written consent regardless of purchase history.12Federal Communications Commission. Text Messages Follow the Same Hours

The FCC treats a text sent by autodialer as a “call” under the TCPA.13Federal Communications Commission. FCC Order on TCPA Consent Revocation Marketing texts sent to your number outside 8:00 a.m. to 9:00 p.m. local time violate the same rule as a late phone call, and the same damages are available.

Suing the Caller Yourself

Federal agencies chase large operations and move slowly. The TCPA gives you a private right of action, which means you can sue the violator directly. Each illegal call or text carries $500 in statutory damages, or your actual loss if it’s greater, and a court that finds the violation willful can triple the figure to $1,500 per call.14Office of the Law Revision Counsel. 47 USC 227 – Restrictions on Use of Telephone Equipment

The numbers add up quickly. Ten robocalls from the same company is $5,000 in standard damages, or $15,000 if a court finds willfulness. Small claims court handles many of these cases and doesn’t require a lawyer. The federal catch-all statute of limitations gives you four years from each individual violation, so there’s no rush, but a log of every unwanted call as it happens makes the case far easier to prove.

Consent shifts the analysis. A caller who has your prior express written consent, given to that specific seller with a clear disclosure that you’ll receive automated marketing messages, can send those messages lawfully.12Federal Communications Commission. One-to-One Consent Rule for TCPA Prior Express Written Consent Frequently Asked Questions You can revoke that consent any time using any reasonable method, whether a reply text, an email, a phone call, or a letter, and the caller must honor the revocation within ten business days.13Federal Communications Commission. FCC Order on TCPA Consent Revocation Revoking for texts also revokes for robocalls to the same number, and a company cannot force you to use a single exclusive opt-out channel. Calls that continue after a documented revocation are the easiest violations to prove.

Blocking Calls in Real Time

Legal remedies work after the fact. Blocking tools cut the noise now. AT&T’s ActiveArmor, T-Mobile’s ScamShield, and Verizon’s Call Filter all screen incoming calls and flag suspected spam, and landline providers like Comcast, Spectrum, and Frontier offer similar tools. iPhones include a “Silence Unknown Callers” setting that routes anything not in your contacts to voicemail, and Google Pixel phones offer a “Call Screen” feature that answers suspected spam and shows you a live transcript before you pick up.15Federal Communications Commission. Call Blocking Tools and Resources These filters catch some legitimate calls too, so the tradeoff is real, but if evening robocalls are the problem you’re trying to solve, they close the gap while the legal process runs its course.
