How Long Does It Take to Get a Work Permit After Marriage?

Most people filing a work permit application after marriage to a U.S. citizen or lawful permanent resident wait somewhere between two and seven months for approval. That range reflects the historical national median for Form I-765 filed alongside a marriage-based green card application, and it shifts year to year with USCIS workloads.1U.S. Citizenship and Immigration Services. Historic Processing Times Before you plan around any specific date, check the current estimate at egov.uscis.gov/processing-times, select Form I-765, and choose category (c)(9) for adjustment of status applicants. The number you see is a median, so half of applicants wait longer.

What Determines Your Wait

The Employment Authorization Document, or EAD, is the formal work permit, and category (c)(9) covers spouses who are adjusting status inside the United States.2U.S. Citizenship and Immigration Services. Employment Authorization Document Three things drive how long your case takes.

The first is which USCIS service center handles your application. Workloads vary between centers, and you don’t get to choose — assignment is based on your address and the forms you file. The second is overall application volume across all immigration categories at the time you file. The third, and the only one you control, is the completeness of your package. If USCIS finds missing information or inconsistencies, they issue a Request for Evidence, which pauses processing until you respond and can add weeks or months.3U.S. Citizenship and Immigration Services. How to File Without Adding Delay

File Form I-765 at the same time as your green card application (Form I-485) and the I-130 petition from your spouse. Can You Speed It Up?

Premium processing, which for some form types guarantees a decision within a set timeframe, is not available for marriage-based EAD applicants. USCIS does accept expedite requests, but approval is discretionary and the bar is high. The criteria are:12U.S. Citizenship and Immigration Services. Chapter 5 – Expedite Requests

  • Severe financial loss. You need more than the general desire to work. Documented job loss tied to the delay, inability to pay for essentials, or loss of critical public benefits can qualify. Simply needing employment authorization is not enough on its own.
  • Humanitarian emergency, such as serious illness, disability, or extreme circumstances affecting your welfare or your family’s.
  • A clear USCIS error that caused the delay.
  • Government interest, meaning cases involving public safety or national security.

Every expedite request needs documentation: termination notices, overdue bills, medical records, whatever supports the specific ground you’re citing. Submit the request by calling the USCIS contact center or through your online account after filing.

Renewal Timing Has Changed

If your green card case is still pending when your EAD approaches expiration, you’ll need to file a renewal Form I-765. This matters more now than it did a year ago.

Through October 2025, USCIS provided an automatic extension of up to 540 days for renewal applicants in eligible categories, including (c)(9). That policy ended on October 30, 2025. Renewal applications filed on or after that date no longer receive an automatic extension.13U.S. Citizenship and Immigration Services. Travel Documents Your EAD application goes down with it, and you may not be allowed to reenter the country. A narrow exception applies to people in H-1B, L-1, and K-3/K-4 status, who can travel on a valid visa without advance parole.15U.S. Citizenship and Immigration Services. What You Receive
