A work permit renewal processing time in 2025 runs anywhere from a few months to well over a year, depending on your eligibility category and the USCIS service center handling your case. That range matters more than it used to. For renewals filed on or after October 30, 2025, USCIS no longer grants the automatic extension that once let people keep working while a new Employment Authorization Document (EAD) was in production.1U.S. Citizenship and Immigration Services. DHS Ends Automatic Extension of Employment Authorization Your old card now expires on its printed date, and if the new one isn’t in your hand yet, you stop working.
Check the Estimate for Your Category
USCIS publishes case-specific estimates on its processing times tool. You pick Form I-765, your eligibility category (the code printed on your current EAD), and the service center listed on your receipt notice.2U.S. Citizenship and Immigration Services. Processing Times – Case Status Online Two applicants at the same center can see very different waits if their categories differ, so pull the code off the card rather than guessing.
The numbers reflect how long USCIS recently took to finish similar cases, and they move as application volume, staffing, and RFE response times shift.3U.S. Citizenship and Immigration Services. More Information About Case Processing Times Treat the estimate as a working guess, not a promise.
When to File to Avoid a Gap
USCIS recommends filing Form I-765 no more than 180 days before your current EAD expires, and no later than 90 days before expiration.4U.S. Citizenship and Immigration Services. I-765, Application for Employment Authorization Under the old rules, the 90-day cushion was usually enough because most renewal applicants got an automatic extension of up to 540 days once their card lapsed. Without that safety net, the earlier you file inside the 180-day window, the better your odds of a new card arriving before the old one dies.
File before the current EAD’s expiration date. Filing after it treats the submission as a new initial application, not a renewal, which can change both the fee and the processing timeline.
What Slows Cases Down
The delay you have the most control over is the one caused by your own paperwork. USCIS reviews every I-765 for completeness on arrival, and a missing signature, wrong fee, or missing document triggers a rejection.5U.S. Citizenship and Immigration Services. Form I-765 Instructions A rejection isn’t a denial. USCIS mails the package back and you start over, which can cost weeks you didn’t plan for.
After a clean filing, the next common holdup is a Request for Evidence. Most RFEs give you 87 days to respond, and your case sits idle from the day USCIS mails it until your reply reaches them and gets re-queued. Add that up and an RFE can stretch a case by several months. Background and security checks run in parallel and can extend processing without any visible signal on your end.
Ways to Move Faster
Premium Processing
For eligible categories, Form I-907 premium processing commits USCIS to act on your I-765 within 30 business days for an added $1,780 fee. Acting means approving, denying, or issuing an RFE, not necessarily approving, and the 30-day clock resets if an RFE goes out. F-1 students filing for Optional Practical Training or a STEM OPT extension are among the eligible categories.6U.S. Citizenship and Immigration Services. I-907, Request for Premium Processing Service Confirm your category is on the current premium processing list before paying.
Expedite Requests
If premium processing isn’t available for your category, you can ask USCIS to expedite for free, though the decision is discretionary. USCIS weighs expedite requests against specific criteria:7U.S. Citizenship and Immigration Services. Chapter 5 – Expedite Requests
- Severe financial loss to a company or individual, such as a business at risk of failing or losing a contract because of a worker’s authorization gap. Simply needing a work permit is not enough on its own.
- Humanitarian emergencies including serious illness, disability, or extreme circumstances like natural disasters. A humanitarian-based application by itself doesn’t qualify without time-sensitive factors.
- Government interests involving public safety, national security, or national interest.
- A clear USCIS error that caused the delay.
Expedite requests need supporting documentation. A general plea for speed without evidence tied to one of these grounds gets denied. You can submit the request through the USCIS Contact Center or your myUSCIS account once the application is on file.
Can You Work While You Wait?
The answer depends on when you filed, and the split matters because getting it wrong causes either an illegal work gap or unauthorized employment.
Filed On or After October 30, 2025
You generally get no automatic extension. Your current EAD expires on its printed date and you cannot legally work again until USCIS issues the new card.1U.S. Citizenship and Immigration Services. DHS Ends Automatic Extension of Employment Authorization Limited exceptions exist where an extension is provided by law or by a Federal Register notice, such as certain TPS-related documentation. This is why the 180-day early-filing window matters so much now — it is the buffer.
Filed Before October 30, 2025
The old rules still cover you. Eligible applicants receive an automatic extension of up to 540 days from their EAD’s expiration date, as long as the renewal stays pending, the renewal is in the same category as the current card, and the filing was timely.8U.S. Citizenship and Immigration Services. Automatic Extensions Based on a Timely Filed Application to Renew Employment Authorization and/or Employment Authorization Document Before Oct. 30, 2025 Eligible category codes include A03, A05, A07, A08, A10, C08, C09, C10, C16, C20, C22, C24, C26, C31, and A12 or C19 for TPS holders. To show a job that you’re still authorized, present the expired EAD together with the Form I-797C receipt notice for the pending renewal.
Tracking Your Case
Once USCIS accepts the renewal, it sends a Form I-797C, Notice of Action, with a 13-character receipt number.9U.S. Citizenship and Immigration Services. Form I-797C, Notice of Action Hold onto it. If you filed before October 30, 2025 and qualify for the legacy extension, this notice is also your proof of continued work authorization.
Use the receipt number to check status through the USCIS Case Status Online tool. A myUSCIS account is worth setting up because it pushes email or text alerts when the case moves, and once the new EAD is produced and mailed, a USPS tracking number often appears in the account.10U.S. Citizenship and Immigration Services.
