Jared Fogle, the former Subway spokesperson, is serving a federal prison sentence of 188 months, which works out to 15 years and 8 months. He pleaded guilty in 2015 to distributing and receiving child pornography and to traveling across state lines to pay for sex with minors. His projected release date is March 24, 2029.
What He Pleaded Guilty To
Fogle admitted to two federal offenses. One was distributing and receiving child pornography under 18 U.S.C. § 2252.1Office of the Law Revision Counsel. 18 U.S.C. 2252 – Certain Activities Relating to Material Involving the Sexual Exploitation of Minors The other was traveling from Indiana to New York to engage in commercial sex acts with minors, charged under 18 U.S.C. § 2423(b).2Office of the Law Revision Counsel. 18 U.S. Code 2423 – Transportation of Minors
The pornography count grew out of his relationship with Russell Taylor, who ran Fogle’s charitable foundation and secretly recorded minors with hidden cameras between 2011 and 2015, passing the footage to Fogle.3United States Department of Justice. How the 188 Months Was Set
The court imposed 188 months on each count, running them concurrently.5United States Court of Appeals for the Seventh Circuit. United States v. Fogle, No. 15-3770 Fogle was also ordered to pay $1.4 million in restitution to 14 victims, a $175,000 fine, and to serve lifetime supervised release after prison.4United States Department of Justice. The 188 months exceeded what the plea agreement contemplated. Prosecutors had agreed not to seek more than 12.5 years, and Fogle had agreed not to ask for less than 5.6Courthouse News Service. Judge Tanya Walton Pratt concluded the advisory guidelines range did not adequately account for Fogle’s conduct and went above both the prosecution’s cap and the guidelines calculation.5United States Court of Appeals for the Seventh Circuit. United States v. Fogle, No. 15-3770
Fogle appealed. The Seventh Circuit affirmed the sentence, and later post-conviction motions have also been rejected, one of them dismissed by Judge Pratt as frivolous. None of his challenges have reduced his time.
When He Gets Out
Fogle is held at the Federal Correctional Institution in Englewood, Colorado, a low-security facility. His earliest projected release date is March 24, 2029.
That date already reflects federal good-time credit. Under 18 U.S.C. § 3624, inmates with clean disciplinary records can earn up to 54 days per year, which translates to serving roughly 85% of the imposed sentence.7Office of the Law Revision Counsel. 18 U.S. Code 3624 – Release of a Prisoner On 188 months, that credit cuts roughly two and a half years. It isn’t automatic; the Bureau of Prisons can withhold it for discipline violations.
Fogle cannot shorten his time further through the First Step Act’s earned time credit program. Convictions under 18 U.S.C. § 2252 are on the disqualifying offenses list, so rehabilitation programming will not move his release date up.8Federal Bureau of Prisons. Good Time Disqualifying Offenses
What Happens After Prison
Release in 2029 will not end federal oversight. Fogle’s lifetime supervised release keeps him on permanent federal probation, with conditions far more restrictive than ordinary supervision. He cannot leave his assigned judicial district without written permission, cannot associate with anyone who has a criminal record without approval, and must participate in sex offender treatment as directed.9eCFR. 28 CFR 2.204 – Conditions of Supervised Release
Technology restrictions are especially tight. Every computer, phone, tablet, and connected device has to be disclosed and approved, monitoring software can be installed, and probation officers can conduct unannounced searches of electronic equipment.10U.S. Courts. Chapter 3 – Cybercrime-Related Conditions (Probation and Supervised Release Conditions) Maintenance polygraphs are typically administered every six months, with additional exams available if the supervision team suspects a violation.11U.S. Courts. Chapter 3 – Polygraph for Sex Offender Management (Probation and Supervised Release Conditions) Any violation of a supervision condition can send him back to prison.
Fogle also has to register as a sex offender for life. Because he pleaded guilty to distribution, he falls under Tier III of the federal Sex Offender Registration and Notification Act, the most serious classification. He must appear in person every three months to verify his information and provide a current photograph, and keep authorities updated on his address, workplace, vehicles, email addresses, phone numbers, and international travel plans.12eCFR. 28 CFR Part 72 – Sex Offender Registration and Notification States can add requirements beyond the federal floor, so the practical burden will depend in part on where he lives.
