How Old Do You Have to Be to Buy Kratom by State?

The minimum age to buy kratom by state ranges from no requirement at all to a full ban at any age, but in most states that regulate it, you must be either 18 or 21. Ten states now set the floor at 21, several set it at 18, five ban kratom entirely, and the remainder have no statewide age rule. Where you live decides which rule applies to you.

Why the Age Rule Depends on Your State

Kratom is not scheduled at the federal level, and there is no nationwide age minimum. Each state decides whether to allow it, ban it, or regulate it with age limits and product standards. That means the same product a 19-year-old can legally buy in one state can be a criminal offense in the state next door.

States Where You Must Be 21

As of 2026, ten states require buyers to be 21: Colorado, Florida, Georgia, New York, Oregon, South Dakota, Tennessee, Vermont, Virginia, and West Virginia.

Colorado prohibits selling kratom to anyone under 21.1Colorado General Assembly. SB25-072 Regulation of Kratom Florida’s Kratom Consumer Protection Act uses the same threshold.2Florida Senate. Florida Kratom Consumer Protection Act Georgia goes a step further and prohibits both the sale to and the possession by anyone under 21.3Justia Law. Georgia Code 16-13-121 – Possession and Sale of Kratom Oregon treats a sale to an underage buyer as a Class C misdemeanor for the retailer.4Oregon State Legislature. South Dakota is stricter than most. Selling to someone under 21, possessing while underage, and even buying on behalf of someone under 21 are all Class 2 misdemeanors, unless the buyer is the young person’s parent or guardian.5South Dakota Legislature. South Dakota Codified Laws 34-20B-115 – Kratom Restrictions Virginia raised its age floor to 21 in 2023 and added a warning-label requirement.6Virginia Department of Health. Kratom New York signed legislation in December 2025 setting the age at 21 alongside detailed labeling rules, with civil penalties for labeling violations of up to $500 for a first offense and $1,000 for repeat violations.7New York State Senate. NY State Senate Bill S8780 Vermont, which previously banned kratom, reversed course and enacted its own act with a 21-year floor; selling to someone 21 or younger can bring up to a year in jail or a $1,000 fine for a first offense, doubling for repeat violations.8Vermont General Assembly. Vermont H.416 Kratom Consumer Protection Act West Virginia is the harshest: a sale to someone under 21 is a felony carrying up to five years in prison and a $5,000 fine.

States Where You Must Be 18

Arizona, Illinois, Nevada, Oklahoma, Utah, and Louisiana set the minimum age at 18.

Arizona’s statute prohibits processors and retailers from selling kratom products to anyone under 18.10Arizona Legislature. Arizona Revised Statutes 36-795.02 – Kratom Product Regulations The Illinois Kratom Control Act bans both selling to and purchasing by anyone under 18.11Illinois General Assembly. Kratom Control Act Nevada bars sales of any kratom-containing product to anyone under 18.12Nevada Legislature. Nevada Revised Statutes 597.998 Oklahoma bars vendors from distributing, selling, or displaying kratom in ways accessible to anyone under 18. Utah applies the 18-year floor to its licensed kratom processors.13Utah Legislature. Utah Code Section 4-45-105 Louisiana’s current law also prohibits distribution to anyone under 18.

States With No Age Requirement

A number of states have no statewide age restriction. In those places, there is no state-mandated minimum, though individual stores and online vendors often set their own policies, typically 18 or 21. You may be asked for ID even where no law requires it.

States Where Kratom Is Banned Entirely

Five states ban kratom outright, meaning it is illegal to buy, sell, or possess at any age: Alabama, Arkansas, Indiana, Rhode Island, and Wisconsin. Indiana lists mitragynine and 7-hydroxymitragynine under its statutory definition of synthetic drugs, alongside other controlled substances.

Arkansas has introduced legislation to reverse its ban and set up a consumer-protection framework instead, but as of mid-2026 the ban remains in force. Kansas is actively considering a statewide ban. If you are traveling, check the law in your destination before carrying any kratom across state lines.

What Else the State Law Regulates

Many states with age limits enacted them as part of a broader framework commonly called the Kratom Consumer Protection Act. Age is one piece; the rest determines whether the product itself is legal to sell.

  • Labeling. Products must display the amounts of mitragynine and 7-hydroxymitragynine, list all ingredients, and carry warnings about interactions and habit-forming effects. New York’s version also requires disclosure of whether a product contains any semi-synthetic or synthetic kratom compounds.7New York State Senate. NY State Senate Bill S8780
  • Purity. Sellers cannot offer kratom that has been adulterated, contaminated, or mixed with compounds known to cause dangerous interactions.
  • Synthetic alkaloids. Most of these states explicitly prohibit products containing synthetic mitragynine or synthetic 7-hydroxymitragynine. Arizona, Colorado, Oklahoma, South Dakota, Texas, and Utah all have these bans.

Concentrated 7-hydroxymitragynine products, sold as pills, shots, or extracts and marketed as “7-OH,” are the fastest-moving area. In July 2025, the FDA recommended scheduling certain 7-OH products under the Controlled Substances Act, calling them dangerous opioids.14U.S. Food and Drug Administration. Whether a product contains natural leaf or synthetic alkaloids is worth checking before you buy.

Local Bans and Store Policies

Even where state law allows kratom, cities and counties can ban it. San Diego and Oceanside in California banned kratom in 2016, Sarasota County in Florida has its own ban, and Jerseyville in Illinois has restricted it locally. State legality does not guarantee legality inside every city within that state.

Retailers set their own rules too. Many stores and online sellers voluntarily require buyers to be 18 or 21 even in states with no age mandate, which is standard risk management in an industry without federal oversight.

Buying Kratom Online

Online vendors are bound by the same state age laws as physical stores. If your state requires 21, the vendor must verify your age before completing the sale, no matter where the vendor operates from. Reputable sellers use age-gate popups, verification software that checks your name and date of birth against public records, or ID upload for first-time buyers. They also refuse to ship into states where kratom is banned.

Online age gates are easier to bypass than a clerk asking for ID, but the legal liability sits with the seller. West Virginia specifically requires kratom websites to use a neutral age-screening mechanism for in-state buyers, and sellers who skip that face the same penalties as an in-person violation.
